Addressing Access To Justice Through New Legal Service Providers: Opportunities And Challenges, Alice Woolley, Trevor C. W. Farrow

Most informed observers of the Canadian and American legal systems accept the existence of a significant crisis in access to justice. One possible solution is to permit paralegals, notaries or other licensed individuals with training more limited than that enjoyed by a licensed attorney to practice in certain areas of law. This paper supports these developments, arguing for a regulated and incremental introduction of new legal service providers into the legal services market. It considers the appropriate training and scope of practice for new legal service providers, and some of the associated opportunities and challenges.

In the fall semester of 1964, a young Douglas Kahn joined the faculty of the University of Michigan Law School. During the spring semester of 2016, he will teach his final course as a full-time faculty member. For the interim fifty two years, he has been a fixture of the Michigan law school community. As a tax professor, former student, and his son, I am pleased and honored to write this introduction for an edition of the Michigan Business & Entrepreneurial Law Review honoring Professor Kahn’s tenure at the University of Michigan.

Doug has always been a bit of a departure from the professorial norm. On SMU’s part, it had set what might well be a world record by reaching eight international championship finals in just the 2014/15 season alone. During that season, it became the first law school from Singapore in more than 10 years to reach the Vis final, and also became the first ever law school from Singapore to win the Vis East and International Criminal Court (“ICC”) moots. A couple of seasons before that, it also became the first law school from Singapore in almost 10 years to reach the Jessup final, a result it repeated in 2013/14.
