Pretrial Commitment And The Fourth Amendment, Laurent Sacharoff

Today, the Fourth Amendment Warrant Clause governs arrest warrants and search warrants only. But in the founding era, the Warrant Clause governed a third type of warrant: the “warrant of commitment.” Judges issued these warrants to jail defendants pending trial. This Article argues that the Fourth Amendment Warrant Clause, with its oath and probable cause standard, should be understood today to apply to this third type of warrant. That means the Warrant Clause would govern any initial appearance where a judge first commits a defendant—a process that currently falls far short of fulfilling its constitutional and historical function. The Gettysburg Address: Lincoln’S Model Legal Argument, Patrick J. Long

The Gettysburg Address does not appear to be a legal argument. One cannot find a rule anywhere in its few words. Nor does there seem to be any application of a rule to the facts of the case. There is a simple reason for this absence: the law in 1863 was wrong. Lincoln knew that, but he was too much the lawyer to advocate law-breaking. Instead, he used all the skills he had learned from his years in the courtroom to urge his listeners to look beyond the law’s flaws to find the truth of the Declaration’s “self-evident truth.”

This Article’s purpose is to propose a heuristic for effectively resolving complex litigation problems that are not clearly or concisely defined, do not present any immediate solutions, frequently involve novel situations or applications of legal doctrine, and suggest a var­­­­iety of possible approaches. The features of this heuristic are derived from and compatible with what we know about good scientific theories and cognitive studies on acquiring knowledge and expertise in any area. Aelet Fishbach is a professor at the University of Chicago Booth School of Business who has studied how people seek out and process negative feedback. One of the ways she has done this is through a classroom exercise in which she divides the students into two groups: feedback givers and feedback receivers. The givers are told to pair up with a receiver and communicate the following feedback in a one-on-one setting: The person's performance s unsatisfactory; improvement is needed; and there are concrete ways they can get on the right track.

Role Of Fat Talk On The Relationships In The Bruneian Chinese Society, Shee Ping Khoo, Brice Tseen Fu Lee

International Review of Humanities Studies

This research paper examines the role of “fat talk” in relationships in Bruneian Chinese society. “Fat talk” refers to negative comments about one's weight or body shape towards oneself or others. Using qualitative research methods, the study explores the perceptions and experiences of Bruneian Chinese individuals regarding “fat talk”, factors leading to the discussion of the topic, and its impact on their relationships with their peers. One of the most influential K-pop groups in the world is Bangtan Sonyeondan, abbreviated as BTS. BTS' success can also be determined by their extensive community of fans who create a fandom culture worldwide, including in Indonesia. This paper investigates the BTS fandom consumerism behavior, which is called ARMY, and its relation to Indonesia's participatory fan culture. Both Thailand and Laos are predominantly Buddhist countries, following Theravada Buddhism. Influenced by Indian Buddhism, both countries celebrate several similar festivals, such as Songkran, Makha Bucha, Visakha Bucha, and Vixakha Souvana. Among all these celebrations, Songkran is considered the most lively, and this is the focus of this article. The article compares and analyzes the culture of Songkran in Laos and Thailand, including the festival's themes, cultural significance, and activities, to highlight the similarities and differences between the two. A descriptive survey research approach was chosen for the investigation. The method of inquiry was chosen since the researcher employed a questionnaire to collect information from respondents. The population includes 41 undergraduates with hearing impairment at Alvan Ikoku Federal College of Education, Owerri, Imo State and 7 lecturers. The study sample consists of thirty-four (34) out of 41 students with hearing impairment who were registered for regular /evening programmes and, seven (7) lecturers who taught them remotely.
