High Anxiety: Racism, The Law, And Legal Education, Elayne E. Greenberg

Faculty Publications

Conspicuously absent from the United States’ ongoing discourse about its racist history is a more honest discussion about the individual and personal stressors that are evoked in people when they talk about racism. What if they got it wrong? The fear of being cancelled - the public shaming for remarks that are deemed racist - has had a chilling effect on having meaningful conversations about racism. What lost opportunities!

This paper moves this discussion into the law school context. How might law schools rethink their law school curricula to more accurately represent the role systemic racism has played in shaping …

Bridging The Legal Writing Skills Gap: Pre-Mediation Statements, Elayne E. Greenberg 2023 St. John's University School of Law

Bridging The Legal Writing Skills Gap: Pre-Mediation Statements, Elayne E. Greenberg

Faculty Publications

(Excerpt)

In our settlement-dominated legal culture, it is no longer sufficient for legal writing courses to teach students how to write for the court alone. Instead, to be considered practice-competent it is necessary for students to also be able to write for non-adversarial, collaborative settings such as mediation. Mediation has become the primary dispute resolution process to settle legal cases, and it has become common practice for judges to strongly encourage litigating parties to try to settle their case in mediation. While the current legal writing curriculum teaches students how to draft legal memoranda, motions, and appellate briefs for court, …

Unmasking Aall’S Idea Special Committee: A Closer Look At The Committee’S Process For Creating Aall’S New Diversity, Equity & Inclusion Policy, Ronald E. Wheeler

Faculty Scholarship

The goal of this column is to describe the process used by the American Association of Law Libraries (AALL) Inclusion, Diversity, and Equity Awareness (IDEA) Special Committee, which provided the foundation and resources for AALL to create the new Diversity, Equity & Inclusion Policy. The committee, initially appointed and charged by the 2020 AALL President Emily R. Florio, began meeting in 2020, and started its work with discussions aimed at defining and narrowing the scope of its charge and finding consensus on what we were setting out to accomplish. During this initial stage, our discussions helped us find commonality to …

The Association Of Participating In A Summer Prelaw Training Program And First-Year Law School Students’ Grades, Heather M. Buzick, Christopher Robertson, Jessica Findley, Heidi Burross, Matthew Charles, David M. Klieger

Faculty Scholarship

This study estimates the association of participation in a nine-week online educational program to prepare students for post-graduate (juris doctorate) education and law school grades. We collected registrar data from 17 U.S. law schools for participants and non-participants from the same year and a prior year. We compared first-semester law school grades between participating and non-participating students weighted by propensity scores. Course participation was associated with improved first-semester grades in a keyed course (Contracts Law) and overall grade point average. According to pre- and post-survey responses, a substantial portion of those who completed the program reported feeling more prepared for …

The Secret Sauce: Examining Law Schools That Overperform On The Bar Exam, Derek T. Muller, Christopher J. Ryan Jr.

Journal Articles

Since 2010, law schools have faced declining enrollment and entering classes with lower predictors of success despite recent signs of improvement. At least partly as a result, rates at which law school graduates pass the bar exam have declined and remain at historic lows. Yet, during this time, many schools have improved their graduates' chances of success on the bar exam, and some schools have dramatically outperformed their predicted bar exam passage rates. This Article examines which schools do so and why.

Research for this Article began by accounting for law schools' incoming class credentials to predict an expected bar …

Unsettling Human Rights Clinical Pedagogy And Practice In Settler Colonial Contexts, Jocelyn Getgen Kestenbaum, Caroline Bishop Laporte 2023 American University Washington College of Law

Unsettling Human Rights Clinical Pedagogy And Practice In Settler Colonial Contexts, Jocelyn Getgen Kestenbaum, Caroline Bishop Laporte

American University Journal of Gender, Social Policy & the Law

In settler colonial contexts, law and educational institutions operate as structures of oppression, extraction, erasure, disempowerment, and continuing violence against colonized peoples. Consequently, clinical legal advocacy often can reinforce coloniality—the logic that perpetuates structural violence against individuals and groups resisting colonization and struggling for survival as peoples. Critical legal theory, including Third World Approaches to International Law (“TWAIL”), has long exposed colonial laws and practices that entrench discriminatory, racialized power structures and prevent transformative international human rights advocacy. Understanding and responding to these critiques can assist in decolonizing international human rights clinical law teaching and practice but is insufficient in …

Fifty Years Of Clinical Legal Education At American University Washington College Of Law: The Evolution Of A Movement In Theory, Practice, And People, Robert D. Dinerstein, Elliott S. Milstein, Ann C. Shalleck

American University Journal of Gender, Social Policy & the Law

Clinical legal education has evolved substantially in the fifty years since Elliott Milstein initiated the clinical model at American University Washington College of Law (“WCL”) that, notwithstanding numerous changes in program and personnel since that time, remains essentially in effect today. In this Article, we explore the theoretical, pedagogical, structural, programmatic, and personnel developments that have occurred during this period. We link these developments to broader developments within the national and international clinical legal education spheres. WCL’s Clinical Program, and its clinical faculty, have been leaders in shaping these developments, but, in the best clinical tradition, we have not done …
