Calls To Eliminate Bar Exams Are Premature, A. Benjamin Spencer
Popular Media
Calls for eliminating bar exams to improve fairness and diversity in the legal profession are increasing, but A. Benjamin Spencer, dean of William & Mary Law School, argues that eliminating them is not the answer. They should be transformed into a more effective gauge of professional readiness, which, he contends, can be achieved if more states adopt the Uniform Bar Exam.

Advice, Sean H. Williams
Utah Law Review
This Article seeks to resurrect an ancient technology for enhancing the welfare of others: peer advice. For decisions as variable as whether to eat a marshmallow or which dialysis treatment to undergo, advice-giving is a powerful and as-yet-unrecognized debiasing tool. In fact, it is one of the most comprehensive and effective debiasing tools ever studied. People who succumb to motivated reasoning, hyperbolic discounting, and a host of other biases offer advice that is untainted by them. When advising others, we are more creative, process information and probability more rationally, and see the forest rather than the trees. Far from the …

The Intersectional Race And Gender Effects Of The Pandemic In Legal Academia, Angela Onwuachi-Willig
Faculty Scholarship
Just as the COVID-19 pandemic helped to expose the inequities that already existed between students at every level of education based on race and socioeconomic class status, it has exposed existing inequities among faculty based on gender and the intersection of gender and race. The legal academy has been no exception to this reality. The widespread loss of childcare and the closing of both public and private primary and secondary schools have disproportionately harmed women law faculty, who are more likely than their male peers to work a “second shift” in terms of childcare and household responsibilities. Similarly, women law …

Law Schools, Law Firms Must Share Responsibility For Diversity, A. Benjamin Spencer
Popular Media
Law schools and law firms must partner to ensure that a pipeline of underrepresented students apply to law school and receive the professional development support they need to remain and advance at firms, William & Mary Law School Dean A. Benjamin Spencer says. Those who make, interpret, and apply the law must reflect the full range of human experiences, thought, and insight into the human condition, he says.

Approaching The Bar: An Analysis Of Post-Graduation Bar Exam Study Habits, Joshua L. Jackson, Tiffane Cochran

For most law graduates, passing the bar exam is the culmination and most critical outcome of their legal education. The typical two months spent preparing after law school graduation are essential to success. However, empirical understanding of post-graduation bar preparation is limited; only a few studies in the legal academy have examined this period. Generally, law graduates are advised to treat bar preparation like a full-time job. But we lack research and data on the specific time management strategies and tactics that are correlated with bar passage. Given impending changes to the bar exam, such inquiries are critical to determining …

Legal Education's Curricular Tipping Point Toward Inclusive Socratic Teaching, Jamie Abrams
Scholarly Articles in Law Reviews & Journals
Two seismic curricular disruptions create a tipping point for legal education to reform and transform. COVID-19 abruptly disrupted the delivery of legal education. It aligned with a tectonic racial justice reckoning, as more professors and institutions reconsidered their content and classroom cultures, allying with faculty of color who had long confronted these issues actively. The frenzy of these dual disruptions starkly contrasts with the steady drumbeat of critical legal scholars advocating for decades to reduce hierarchies and inequalities in legal education pedagogy.
This context presents a tipping point supporting two pedagogical reforms that leverage this unique moment. First, it is …

The Clerkship-Academia Continuum, Merritt E. Mcalister, Katherine Mims Crocker
Popular Media
In the spring 2021 edition of Judicature (Vol. 105 No. 1), Florida International University Law Professor Howard Wasserman published data analyzing the number of current law professors who have served in clerkships and for which judges those professors clerked. His study offered a compelling picture of “academic feeder judges,” or those on the bench whose clerks tended to matriculate professionally in large numbers within the halls of the academy.
We asked two law professors, Merritt McAlister at the University of Florida, and Katherine Mims Crocker of William & Mary Law School, to reflect on Wasserman’s findings and to offer a …

The Paradox Of Criminal History, Eric S. Fish
Cardozo Law Review
Criminal history is all-important in the criminal and immigration systems. But these systems have little substantive information about past crimes. This creates a paradox. A person’s past convictions dictate whether they will face new criminal charges, make bond, suffer a lengthy sentence, or be targeted for deportation, among many other consequences. Yet, despite the vital role that criminal history plays in these decisions, judges and prosecutors know very little about the prior crimes of the people they process. Factually rich accounts of a person’s convictions are rarely available. The system instead relies on rap sheets that record only basic facts—the …
