During the Survey period, the Supreme Court of the United States in Knick v. Township of Scott gave aggrieved property owners in Georgia a federal taking claim for inverse condemnation resulting from a zoning regulation that the Georgia Supreme Court had previously denied them under state law in Diversified Holdings, LLP v. City of Suwanee. The Georgia Court of Appeals further refined York v. Athens College of Ministry. Finally (on a note inseparable with zoning), the Georgia Supreme Court encountered a case defining the parameters of the Georgia Open Meetings Act.

Due to a remarkable convergence of criticisms from both the right and the left, zoning is under more sustained attack than at any time in the last seventy-five years. A consensus is building that zoning is what ails America. Simultaneously, the traditional justifications for zoning like separating incompatible uses, have become increasingly anachronistic in an age of mixed-use development and a desire for vibrant, dynamic places. We study the effects of foreign direct investment (FDI) on the rate of exhaustion of bioproductive physical land. We test for differential ecological performance of FDI in developed vs. developing countries, as well as in “clean” vs. “dirty” sectors. We examine the impact of six sector-level FDI flows on four ecological footprints (EF): Consumption EF, Production EF, Imports EF, and Exports EF, compiled by the Global Footprint Network. We estimate a dynamic panel model incorporating an Environmental Kuznets Curve (EKC) and differentiating across country development levels. The findings are intriguing. Despite an academic consensus that easing land use regulations to increase the supply of housing can help lower housing prices, local opposition to new development remains prevalent. Onerous zoning regulations and resistance to new housing persist not only in wealthy suburbs, but also in lower-income urban neighborhoods. In addition to making housing more expensive, such policies increase residential segregation, exacerbate urban sprawl, and have detrimental environmental effects. If increasing supply tends to reduce costs, what explains this opposition, particularly during a period of rising housing costs?

The Takings Clause of the Fifth Amendment has long been controversial. It allows the government to take private property for the purpose of “public use.” But what does public use mean? The definition is one of judicial interpretation. It has evolved from the original meaning intended by the drafters of the Constitution. Now, the meaning is extremely broad. This Note argues that both the original and contemporary meaning of public use are problematic. It explores the issues with both definitions and suggests a new test, solidified in legislation instead of judicial interpretation.

In 1981, the Supreme Court issued its decision in Montana v. United States, severely restricting the ability of Indian Tribes to assume civil regulatory and adjudicatory jurisdiction over non-tribal members for activities taking place on non-Indian lands within Indian reservations. The Court in Montana stated that “it could readily agree” with the Court of Appeals’ holding that the tribe could regulate the conduct of non-member on tribal lands. When it comes to housing policy, the current hope is that the Housing Choice Voucher Program (formerly the Section 8 Voucher Program) can provide an or ambitiously the answer to this perennial societal question. Penelitian ini membahas pengaruh gender dalam pembuatan akta Notaris, dengan studi khusus pada transgender dan khuntsa. Ketika Notaris membuatkan akta, terdapat komparisi yang berisikan mengenai identitas para pihak. Saat pihak ini merupakan seorang transgender atau khuntsa, yang biasanya terdapat perbedaan antara fisik yang ditampilkan dan jenis kelamin yang terdapat di kartu identitas, maka penulisan identitas di dalam komparisi akan membingungkan. Penelitian ini membahas perlindungan hukum terhadap kreditur atas pelaksanaan piutang secara cessie dan akibatnya terhadap jaminan hak tanggungan berdasarkan putusan Pengadilan Tinggi Jawa Barat Nomor 126/PDT/2018/PT BDG tentang perkara pengalihan piutang secara cessie. Permasalahan dari penelitian adalah mengenai bentuk pertanggungjawaban notaris dalam pelaksanaan jabatannya. Metode penelitian yang digunakan adalah yuridis normatif dengan melakukan penelusuran data sekunder melalui studi kepustakaan, sedangkan pendekatan analisis dilakukan secara kualitatif dengan tipe deskriptif analitis.
