The Effect Of Piracy Website Blocking On Consumer Behavior, Brett Danaher, Jonathan Hersh, Michael D. Smith, Rahul Telang

Economics Faculty Articles and Research

In this study, we ask what drives the success or failure of various supply-side anti-piracy enforcement actions such as piracy website blocking. We do this in the context of three court-ordered events affecting consumers in the United Kingdom: We first study Internet Service Providers’ blocking of 53 video piracy sites in 2014 and of 19 piracy sites in 2013, and we then study the blocking of a single dominant site, “The Pirate Bay,” in 2012.

We show that blocking 53 sites in 2014 caused treated users to decrease piracy and to increase their usage of legal subscription sites between 7% …

Reconsidering The Rationale For The Duration Of Data Exclusivity, Jonathan Kimball, Srividhya Ragavan, Sophia Vegas

Faculty Scholarship

The paper’s focus is the singular one question of whether the 12-years of exclusivity that was needed in 2008 remains justified in 2019 given that technological advancement reduces the cost and the time for drug discovery? Basically, new and emerging technologies are deployed every day to enhance efficiencies and reduce the time it takes to bring a drug to the market. The paper asserts that as new technologies are adopted and advances in scientific understanding are leveraged, it results in shorter drug development timelines. This factum, the paper asserts should have a bearing to reduce the period of exclusivity granted …

China's Innovative Turn And The Changing Pharmaceutical Landscape, Peter K. Yu

Faculty Scholarship

For more than a decade, China has been the world's leading supplier of active pharmaceutical ingredients. Today, it is not only the world's second largest pharmaceutical market, behind only the United States, but it also produces about four percent of the world's new pharmaceutical products. Despite these impressive accomplishments, China does not have internationally recognized pharmaceutical brands that are comparable to those found in Europe or the United States, such as Johnson & Johnson, Merck, Novartis, Pfizer, Roche and Sanofi. Nor does China rival India in its status as the "pharmacy of the world," providing generic drugs to needy countries …

Throughout the biotechnology age, fears about the distortionary effects of property and other legal institutions upon the health and self-determination of individuals and societies have accompanied more popularly sensational fears about unscrupulous choices within the scientific community itself. Still, for most of that time the prevailing legal regime both in the United States and in Europe remained generally permissive of ownership of, and exclusionary power over, the fruits of much biomedical research, though this leniency took different forms and came about in different ways. In particular, the policy of the United States Patent and Trademark Office to grant patents on …

Issued Patents In A University’S Institutional Repository, Suzanne Reinman, Janet Ahrberg

Journal of the Patent and Trademark Resource Center Association

Beginning in 2016, patents issued by the U.S. Patent and Trademark Office (USPTO) granted to Oklahoma State University were included in SHAREOK (https://shareok.org/.). The joint institutional repository for the Oklahoma State University Libraries (OSU) and the University of Oklahoma Libraries (OU), SHAREOK serves as the home for the intellectual output of both communities and will ultimately include digital dissertations, faculty publications, digital special collections, open access publications, and open educational resources. Including patents has increased the depth of the collection and allows them to be searched or indexed by date, author, title, and subject/classification. Using DSpace software, the contents of …

Sovereign Immunity Issues For Tech Transfer Programs At State Universities, Agnes Gambill 2020 Appalachian State University

Sovereign Immunity Issues For Tech Transfer Programs At State Universities, Agnes Gambill

Journal of the Patent and Trademark Resource Center Association

Technology transfer is the process of transforming research and ideas into viable commercial opportunities. Notable examples of tech transfer include Google, artificial intelligence, life-saving vaccines, and renewable energy technology. Universities and colleges play an important role in the technology transfer process, ranging from brokering commercial partnerships, negotiating license agreements, and protecting intellectual property. Valuable patents are often at stake, and as a result, universities should anticipate litigation risks. State universities, in particular, face new and unusual challenges as a result of their status as state entities. Under the 11th Amendment, state universities, as an arm of the state, can claim …

Patent And Trademark Resource Center Websites: A Content Analysis, Jared Hoppenfeld

Journal of the Patent and Trademark Resource Center Association

Patent and Trademark Resource Centers (PTRCs) serve as an off-site connection to the United States Patent and Trademark Office (USPTO). Approximately 85 PTRCs exist to assist inventors, entrepreneurs, and researchers by providing facilities, resources, and expertise. Most of these libraries also have a website which, in addition to USPTO webpages, serves as a gateway to the world of patent and trademark research. These websites provide access to various resources while also functioning as an outreach tool to the public.

This study included a content analysis of 79 websites belonging to PTRC libraries. After a literature review of other website studies, …

Piug: Patent Information Users Group, Inc.: A History Of The International Society For Patent Information Professionals, Barbara J. Hampton

Journal of the Patent and Trademark Resource Center Association

Efforts to view and analyze patents began soon after the first patents were filed in the novel system founded in the U.S. Constitution. In the succeeding 200 plus years, classification and indexing tools have evolved from paper to digital, with searching demanding ever-higher skills. Answering the need of patent researchers and analysts for advocacy, scholarship, and professional education, leading searchers founded the Patent Information Users Group, Inc., now the pre-eminent professional organization for patent searchers in the United States. It offers formal coursework for prospective patent searchers, colloquia, and conferences where novice searchers can master their craft. Searchers, who often …

A Logical And Lawful Application Of § 101 Jurisprudence: The Uspto’S 2019 Subject Matter Eligibility Guidance, Dustin Luettgen

Journal of Law and Policy

In recent years, 35 U.S.C. § 101 has been a topic of great concern within the patent bar due to uncertainty surrounding the patentability of inventions drawn to the three judicial exceptions to patent-eligible subject matter: abstract ideas, natural phenomena, and laws of nature. In response to this lingering uncertainty and in an effort to provide for the lawful and consistent application of patent law, the United States Patent and Trademark Office released guidance as to the subject matter eligibility of claims drawn to judicial exceptions. This Article provides a review of § 101 jurisprudence, summarizes the USPTO Guidance, and …

Breaking Up Melodic Monopolies: A New Approach To Originality, Substantial Similarity, And Fair Use For Melodies In Pop Music, Johannes Hoffman

Journal of Law and Policy

Progress in the arts—the fundamental goal of copyright law in the United States—requires a balance between granting creators exclusive rights over their works and allowing others the room to create new works. This is particularly crucial in pop music, where melodies are composed within narrow musical structures out of a limited set of notes. Recent verdicts, however, have shown that courts are becoming more willing to find copyright infringement based on relatively simple melodies in pop music, even where such melodies do not constitute the “hook” or most memorable part of the allegedly infringing work. This Note posits that, in …
