Poverty As An Everday State Of Exception, Julie Nice

This essay applies the provocative theory of Italian philosopher Giorgio Agamben to Poverty Law. It is forthcoming as a book chapter in a multidisciplinary volume of papers exploring the relations between accumulation and insecurity. Professor Nice distills Agamben's theory of the state of exception, that the dominant paradigm of modern democracy is founded on the state's power to exclude from rights those who are otherwise included within the political order. Professor Nice posits that the state's abandonment of poor people exemplifies an everyday example of the state of exception. In 2007, the International Organization for Adolescents (IOFA), under the leadership of Katherine Kaufka Walts the then Executive Director, developed and launched the Building Child Welfare Response to Child Trafficking project. The purpose of this project is to build the capacity of child welfare agencies and service providers to identify and respond to this often invisible and underserved population. The primary goals are to ensure that children are correctly identified as trafficked persons and that they receive the appropriate protections and referrals to specialized services to which they are entitled under federal and state laws. Foster care is supposed to be a temporary safe haven for abused and neglected children, a place where they are cared for while their parents solve the problems that led to their mistreatment. For many children, foster care undoubtedly serves this function well. However, thousands of children live in foster care for extended periods of time, many leaving care only when they become adults. Recent studies show that for many of these children, foster care is not a safe, nurturing place. Questioning Child Support Enforcement For Poor Families, Leslie J. Harris

American law and culture have always assumed that providing for children economically is a private obligation, ordinarily belonging to the parents. The principal was given real teeth in 1975, when Congress enacted the federal-state child support enforcement program. The legislation's two related goals were to reduce childhood poverty and to reduce the welfare rolls. The goals were linked by the assumption that childhood poverty is largely attributable to the failure of absent parents (overwhelmingly fathers) to pay their fair share of child support, even though they are able to do so. Civil society participation can facilitate sound energy, climate, and water governance. This article analyzes the dynamics of transnational decision-making. Part II discusses sound energy strategy in light of a shrinking water-resources base due to climate change. Part III considers how public participation in international decision-making can sustain trust in governments and strengthen the legitimacy of legal decisions. Part IV concludes that process and outcome are both integral to addressing water, climate, and energy challenges.

This Article considers the advantages and disadvantages of market-based program design, natural gas regulation, and enhanced international understanding. Transitioning to a green economy involves dedicating efforts towards environmentally sound energy innovation. RGGI, natural gas, and climate change represent sustainability challenges. Optimizing cooperative transboundary green innovation can facilitate inclusive decision-making just as public participation by civil society can help economies transition to environmentally sound energy use.
