Sexual Orientation In Canada's Revised Refugee Determination System: An Empirical Snapshot, Sean Rehaag

This is one of several articles in a special issue to celebrate Nicole LaViolette's research contributions relating to intersections between gender and sexual orientation in Canadian and international law of forced migration. Inspired by three aspects of LaViolette's research, the article offers a snapshot of how Canada's recently revised refugee determination system addresses refugee claims involving allegations of persecution due to sexual orientation. Using data obtained through access to information requests about 18,221 principal applicant refugee determinations from 2013 to 2015, the article examines patterns in outcomes in cases categorized by the Immigration and Refugee Board as involving sexual orientation. …

Multilateral human rights diplomacy is a product of the triad relationship between intergovernmental organizations (IGOs), civil society organizations (CSOs), and states. This paper examines the emergence of LGBT rights within the context of the UN human rights system. Recently, the global debates around LGBT rights have become much more public and increasingly complex: Ministers, leaders, and even the UN Secretary-General routinely call on states to do more to protect sexual minorities. Countries such as Uganda and Russia are labeled “homophobic” — not just by human rights activists, but by other states. These “accusations” are delivered both bilaterally and in multilateral …

Sending A Dear John Letter: Public Information Campaigns And The Movement To “End Demand” For Prostitution In Atlanta, Ga, Samantha Majic

This paper examines “Dear John”, a public information campaign that ran from 2006–2008 in Atlanta, GA, to ask what narrative it conveys about commercial sex and those who engage in it, in order to understand the gendered (and other) discursive constructions it produces, reflects, and complicates about these activities and subjects. Drawing from both policy and sex work/trafficking scholarship, this paper argues that Dear John used symbolic images and direct and consequential text to convey a “male demand” narrative, which holds that men’s demand for sexual services harms girls and young women and will not be tolerated. Oliari And The European Court Of Human Rights: Where The Court Failed, Vito John Marzano

The European Court of Human Rights revisited the issue of legal recognition for same-sex partnerships on July 21, 2015 when it decided Oliari and Others v. Italy. This Note explores the implications of that decision and what it may mean for same-sex couples within Italy and throughout the Council of Europe. Through a careful analysis of the decision, this Note concludes that Oliari provides slight yet important movement on the issue of a Contracting State’s obligation to afford legal recognition for same-sex partnerships, but a practical implementation of the Court’s holding likely will yield little additional movement in more conservative …

The purpose of this Note is to critique the current paradigm in place for resolving the sex trafficking of youth in Washington and compare it to the current model utilized in Minnesota. The Minnesota model should be used to provide a framework for Washington to revise its current model because Washington’s current model allows for sexually exploited youth to be funneled in and out of the criminal justice system, limiting the chances for trafficked victims to reach out to members of the community for assistance. Columbia Law School’s Public Rights/Private Conscience Project and Muslim Advocates filed an amicus brief in the U.S. Supreme Court case Masterpiece Cakeshop v. Colorado Civil Rights Commission on behalf of a coalition of 15 diverse civil rights and faith organizations. At issue in Masterpiece Cakeshop is whether the owners of a Colorado public establishment may, due to their own private religious beliefs, refuse service to individuals because of their sexual orientation.

The rights of transgender individuals has been in the headlines during 2017 - ranging from President Trump's tweet to announce a ban on transgender individuals from serving in the military due to the "tremendous medical costs" to a nationwide injunction imposed by a federal district court on the HHS regulations that prohibit health-care discrimination against transgender individuals under the Affordable Care Act (ACA).

In the early same-sex marriage debates advocates and opponents of marriage equality often relied upon comparing mixed-race marriage jurisprudence and the Loving v Virginia decision in order to conceptualize same-sex marriage cases. Liberal commentators relied upon the analogy between the Loving decision in order to carve out space for the protection of same-sex marriage rights. Conservative scholars, however, denounced the equal protection and due process claims that relied on the sameness of race and sexuality as inexact parallels. Since I disapproved of stereotypes, I found myself trying to comprehend Italian-American culture after I became executive director of the largest shelter in Rhode Island for battered women and their children. Many of those I met were fleeing Italian-American men. On 60 Minutes, Lesley Stahl reported from Italy about the large number of single men who still live with their parents and are known as mammoni, or “mama’s boys.” Their mothers dutifully cook and clean for them. Obergefell’S Ambiguous Impact On Legal Parentage, Leslie Joan Harris

For more than thirty years, the central questions of the law of parentage have been when and to what extent determinations of legal parenthood should be based on biological relationship, marriage to a child’s biological parent, or functioning as or intending to be a parent. In Obergefell v. Hodges, the Supreme Court endorsed the claim that children whose parents are married are better off socially and legally than nonmarital children; its language could easily be taken to support legal rules that encourage or prefer childrearing within marriage.
