Much of the information and the format used herein, are based upon a fine article published in 1981 in the South Texas Law Journal by Frank B. Mapel, III, and Charles J. The Bayh–Dole Act & Public Rights In Federally Funded Inventions: Will The Agencies Ever Go Marching In?, Ryan Whalen

Northwestern University Law Review

For over thirty years, the Bayh–Dole Act has granted federal agencies the power to force the recipients of federal research funding to license the resulting inventions to third parties. Despite having this expansive power, no federal agency has ever seen fit to utilize it. This Note explores why Bayh–Dole march-in rights have never been used, and proposes reforms that would help ensure that, in the instances when they are most required, the public is able to access the inventions it bankrolled.

This thesis discusses transparency as a principle in the World Trade Organization. Transparency is used in many contexts within the organization in order to describe phenomena ranging from Agreement provisions to soft law or general principle and from the obligation of member states to publish national trade laws to civil society participation in the WTO. I argue that they all these transparency variations are linked as they relate to the organization’s democratization potential.
