Legal Remedies For Deep Marine Oil Spills And Long-Term Ecological Resilience: A Match Made In Hell, Robin Kundis Craig 2011 Brigham Young University Law School

Legal Remedies For Deep Marine Oil Spills And Long-Term Ecological Resilience: A Match Made In Hell, Robin Kundis Craig

BYU Law Review

The Deepwater Horizon oil spill that lasted from April to September 2010 was not only the worst oil spill disaster in United States history, but also the first to occur at great depth. Drilling at great depth multiplies the risks and complications of offshore oil extraction. It also, as this Article explores, makes natural resource damages a decisively inadequate remedy for the injuries done to the Gulf of Mexico’s (the “Gulf”) ecosystems, especially the poorly understood but highly productive ecosystems that exist almost a mile below the surface. This Article argues that our current natural resource damages regimes for oil …

CCSI strongly supports the transparency of contracts and tax flows. CCSI shares the belief of many stakeholders that transparency is essential to leverage extractive industries for sustainable development and is in the mutual interest of all stakeholders. However, some industry players continue to voice the concern that increased transparency would be harmful for their business. Therefore, CCSI is working to also establish the business case for transparency.

In one such case, some industry players have been lobbying against the regulations developed by the Security and Exchange Commission to implement the mandatory disclosure provisions of the Dodd Frank Wall Street Reform …

Singapore: Building A Future Without Cheap Oil, Singapore Management University

Perspectives@SMU

Singapore’s investment and long history of involvement in the oil industry has been a major factor in the development of its economy. In the 272-page book 'Singapore, The Energy Economy: From The First Refinery To The End Of Cheap Oil, 1960 to 2010' by Ng Weng Hoong, he traced the evolution of Singapore’s economy over a 50-year period beginning from 1960, showing how energy has been a powerful but little noticed thread in the country’s rise from a struggling Third World country to an affluent city-state it is today.

Organizational Apologies: Bp As A Case Study, Erin O'Hara O'Connor

Vanderbilt Law Review

This Article examines the conduct of BP executives in the weeks following the Deepwater Horizon oil spill to illuminate the use of apology by organizations. After briefly describing the value of apology and its nuances from an evolutionary perspective, the Article describes how apology and other responsibility-accepting behaviors can be mobilized by organizations to avoid the costs of its apparently careless conduct. In particular, organizations can designate particular agents as spokespersons who possess the ability to portray a sense of sincerity and regret. Moreover, reconciliation by ingroup members appears to be more common than is reconciliation by outgroup members, likely …

The Rise Of Hydraulic Fracturing: A Behavioral Analysis Of Landowner Decision-Making, Jared B. Fish

Buffalo Environmental Law Journal

High volume "slickivater" horizontal hydraulic fracturing ("hydrofracking" or 'fracking") is an innovative technology nov widely used to extract natural gas from shale rock. Proponents hail fracking as a way to promote energy independence, bring jobs to economically distressed communities, and mitigate climate change by switching from oil and coal to natural gas. Yet the process has come under increased public scrutiny in recent years as thousands qf reports surfaced linking hydrofracking to groundwater contamination, air pollution, and various maladies. Despite an explosion qf media reports on the potential risks associated with fracking, landowners continue to lease their mineral rights to …

Columbia Center on Sustainable Investment Staff Publications

The Australian government is rapidly increasing aid to Africa. But the real story about the country's engagement in Africa is the massive investment by Australian companies in extractive industries.

More than 150 Australian resource companies are active in more than 40 African countries with a total investment greater than $20 billion, including in coal in Mozambique, copper and uranium in Zambia, gold in Eritrea and uranium in Malawi.

Looking Backward from the Year 2099: Ecozoic Reflections on the Future

Abstract by Samuel Alexander

Story, myth, and narrative played a central role in Thomas Berry’s writings. He told new stories about the Universe and our place in it, stories not only about where we have been and where we seem to be going, but also stories about where we could go, if only we exercised our freedom in different ways. Inspired by Berry, in this paper I have dared to experiment with story, by attempting to look back on the 21st century from the vantage point of the year …

Faculty Law Review Articles

On April 20, 2010, British Petroleum's ("BP") Deepwater Horizon oil platform exploded, killing eleven workers. When the platform sank to the bottom of the Gulf of Mexico two days later, oil erupted out of the riser-a 5000-foot pipe connecting the platform to the well on the ocean floor. 2 Efforts to stem the flow failed when a safety device, the "blowout preventer," could not be activated.' Finally, after a number of attempts to stop the leak, BP capped the well on July 15.4 Nearly five million barrels of oil were released over the course of eighty-six days, making the Deepwater …

Zambezi Valley Development Study, Lisa E. Sachs, Perrine Toledano

Columbia Center on Sustainable Investment Staff Publications

In June 2011, CCSI released a consultative draft report on Resource-Based Sustainable Development in the Lower Zambezi Basin, the result of a year-long inquiry into how the vast resource deposits in Tete province, combined with other major investments along the Nacala and Beira corridors, can be the basis for sustainable, equitable and inclusive growth in the Lower Zambezi Basin.

The report recommends a framework of actions by Mozambique and its public and private partners to ensure that Mozambique reaps a major boost to economic development from its vast resource endowments, while also respecting the profitability of private-sector investments in …

Best Management Practices (BMPs): What? How? And Why? (May 26)

The Environmentally Friendly Drilling Systems (EFD) Program, managed by the Houston Advanced Research Center, works to identify, develop and transfer critical, cost effective, new technologies that can provide policy makers and industry with the ability to develop natural gas reserves in a safe and environmentally friendly manner. Funding for the EFD Program is through a grant from the Research Partnership to Secure Energy for America, established under the 2005 Energy Act. Within the EFD Program, some projects focus on technologies for developing energy sources in environmentally sensitive areas; others (like the NRLC’s BMP Project) seek ways to reduce the environmental …
