Interpreting Biological Similarity: Ongoing Challenges For Diverse Decision Makers, Sarah M. Cork 2013 University of Michigan Law School

Interpreting Biological Similarity: Ongoing Challenges For Diverse Decision Makers, Sarah M. Cork

Michigan Telecommunications & Technology Law Review

Similarity is an elusive and complicated concept facing comparisons of biological molecules, as even minute changes to a molecule's structure can dramatically affect its function in the body. Yet the flood of biologic drugs on the market will increasingly force these similarity comparisons. These concerns are particularly relevant to two groups of drugs: families of biologic drugs that closely resemble each other in structure and function, here termed "similar-impact biologics," and the biosimilars, which are intended to closely approximate generic forms of biologic drugs. In bringing biologic drugs to the market, manufacturers are likely to face dual obstacles: FDA approval …

E-Legislating, K.K. DuVivier 2013 University of Denver

E-Legislating, K.K. Duvivier

Sturm College of Law: Faculty Scholarship

The United States has been plagued with a deadlocked, “do nothing” Congress for the last several years, but today there is a new game in town. Senator Chris Dodd declared, when he first encountered the full force of e-legislating, “It’s a new day [in Washington]... Brace yourselves.” Digital technologies have fundamentally changed the relationship of citizens to their governments. Since e-democracy was first identified in the 1990s, at least four subcategories have emerged. This article debuts the newest member of the e-democracy family: e-legislating — the use of Internet and social media to influence federal legislation. The federal legislative process …

Cuotas En Materia Electoral: Frecuencia Y Eficacia, Richard E. Matland

Political Science: Faculty Publications and Other Works

The Incredible Shrinking Antitrust Law And The Antitrust Gap, C. Paul Rogers III. 2013 Southern Methodist University, Dedman School of Law

The Incredible Shrinking Antitrust Law And The Antitrust Gap, C. Paul Rogers Iii.

Faculty Journal Articles and Book Chapters

Substantive antitrust law has dramatically shrunk. The shrinkage, which began in the 1970s with the transition from the Warren Court to the Burger and then Rehnquist Courts, has accelerated in the last decade. Much of the shrinkage has to do with the expansion of the rule of reason and its displacement of per se rules. The Supreme Court has gone so far as to state that it "presumptively" applies the rule of reason while per se illegality is limited to a "narrow category of activity." This article considers the impact of modem antitrust law on the gap that is the …

Religious Freedom Legislation In The 2013 Virginia General Assembly, Ellis M. West 2013 University of Richmond

Religious Freedom Legislation In The 2013 Virginia General Assembly, Ellis M. West

Richmond Journal of Law and the Public Interest

This article consists of the following sections: Section one presents the content of the proposed amendment and explains the ways in which it is unclear, redundant, and otherwise poorly written. Section two addresses the issue of whether the provisions intended to protect religious expression, including prayer, are necessary and can solve the problems they are intended to solve. It also identifies the crucial challenge in cases involving religious expression - namely, determining correctly whether it is the government or a private individual or group that is expressing or promoting a religious belief or practice. This determination must be made because …
