Urgensi Memahami Arbitrase Bagi Pemangku Kepentingan Dunia Bisnis Di Indonesia, Bambang Hariyanto, Saptarini Saptarini

Jurnal Hukum & Pembangunan

Abstract The resolution of business disputes through arbitration forums is increasingly favored by the majority of business actors in Indonesia. One indication of this is the growing number of business actors, both from the private sector and state-owned enterprises, who include arbitration agreements as dispute clauses in their contracts. Arbitration has even attracted the interest of MSMEs (Micro, Small, and Medium Enterprises) as a forum to resolve their business disputes. This phenomenon ultimately highlighted the urgency for stakeholders in the business world to understand arbitration. Using normative juridical methods, this article contained a series of analyses of primary materials, including …

These days, American attorneys regularly represent clients in mediation. This representation is a complex process, and attorneys and law students need guidance about how to serve clients well in this context. This article offers a theoretical framework for analyzing mediation representation based on Real Practice System Theory. It reviews books that outline elements of mediation representation and identify practical techniques that attorneys can use when representing clients in mediation. It supplies several suggestions for faculty who teach mediation, including teaching courses combining the perspectives of both mediators and mediation representatives.

Opening Up The In-House: A Model For Collaborative Holistic Services And Education In Law School Clinical Programs, Melina Healey

Individual in-house clinics too commonly operate autonomously behind separate walls. These barriers impair the meaningful holistic representation of clients and the educational opportunities of clinic students. This article provides an argument and framework for opening the doors between clinics to enrich clinic student education and enhance client representation. Part I identifies the benefits of holistic inter-clinic collaboration for both clinic students and the clients they serve. Part II shares a model for how to integrate education and client service across practice areas of clinical programs. A forthcoming article, published separately, will further describe how clinical programs can be improved by …

*This contribution has not been peer-reviewed.

When the COVID-19 pandemic moved law classes online, the University of Saskatchewan College of Law admitted an additional twelve students. These students had the lowest index scores in their class. This paper reviews their first year academic performance, compares it to other students admitted in the same year, and concludes that at least at the margin, applicants’ index score is not an accurate predictor of academic success. The author recommends that admissions committees use additional criteria, at least for applicants at the margin.

Critical Race Theory As Legal Epistemic Justice, Jasmine Gonzales Rose 2024 Boston University School of Law

Critical Race Theory As Legal Epistemic Justice, Jasmine Gonzales Rose

Faculty Scholarship

“Critical Thinking: Not Critical Race Theory” and “Teach Truth: Not CRT,” proclaimed the front and back of a T-shirt on a fellow traveler passing in the airport. I was startled by the blatant misconceptions. The core pursuits of critical race theory (“CRT”) are to think critically, discover truth, and diversify knowledge about race and racism. Although I was aware of then-President Trump’s executive order barring federal diversity training and bills modeled after it, nothing had prepared me for the realization that my academic subfield had become so widely criticized that it was now the subject of T-shirt slogans. A few …
