William & Mary Law School’s Conference for Excellence in Online Teaching Legal Research & Writing

This presentation will focus on centering the mental wellbeing of students for the 2020-21 academic year. This presentation will give practical strategies to engage with students that facilitate and foster mental health, with an eye to anchoring our tactics within a legal research and writing curriculum. The presentation aims to encourage healthy dialogue on how to de-stigmatize mental wellbeing and best support our students. This goal, more so now …

The mission was to determine effective combination of apps to support both the workflows and the social connectedness of a collegial staff forced to pivot to working from home with one week’s notice

The University of Georgia’s Alexander Campbell King Law Library has a staff of around 25 with a strong culture of face-to-face communication, collegiality and socialization. Our work is often team-driven, and small groups walk to nearby coffee shops nearly daily for informal meetings and camaraderie. When we transitioned rapidly to a work-from-home environment in mid-March, the library’s leadership was concerned not only that every staff member would …

Surving Covid With The Breakfast Club: Tools For Telework Task Management And Communication In A Multi-Generational Workplace, Carol A. Watson, Geraldine R. Kalim, Wendy Moore, Rachel S. Evans

Presentations

As librarians around the world scrambled earlier this year to set up physical spaces to work from home, at UGA Law Library we were fortunate to have a few apps already in place. In this session we put our recent and personal experiences to use, as well as adding a newer tool into the mix, and successfully pivoted employees, teams, departments and services all online within a week. Individuals and small teams had been using various platforms for years to collaborate more effectively and track progress on long-term objectives, all while maintaining business as usual. Our library is also made …

No Matter How Loud I Shout: Legal Writing As Gender Sidelining, Leslie Culver 2020 S.J. Quinney College of Law, University of Utah

No Matter How Loud I Shout: Legal Writing As Gender Sidelining, Leslie Culver

Utah Law Faculty Scholarship

In this essay, I argue that viewing legal writing as a mode of gender sidelining uncovers the urgency for law schools to provide unitary tenure for legal writing programs across all law schools. I recognize that many legal writing faculty are employed under ABA Standard 405(c), a seemingly second-best option to traditional tenure tracks. As Professor Kathy Stanchi (UNLV) comments, however, while Standard 405(c) offers some respite from “job insecurity, intellectual disparagement, and pay inequity,” it ultimately serves as an “institutionalized bar to professional advancement divorced from any reasonable measure of merit.” This essay takes Stanchi’s framing of 405(c) as …

Quintilian’S Curriculum, Kirsten A. Dauphinais 2020 University of Nevada, Las Vegas -- William S. Boyd School of Law

Quintilian’S Curriculum, Kirsten A. Dauphinais

Nevada Law Journal

This Article argues that modern legal educators should revisit Quintilian, the quintessential law professor, by intentionally implementing his recommended pedagogical strategies in the law school classroom and curriculum. In recent decades, while the literature of law school teaching and learning has been casting about to find new paradigms for legal education in the face of widespread critique of impracticality and ineffectiveness, examination of the philosophies of the great Roman rhetors, and in particular, Quintilian and his principal work Institutio Oratoria, has largely been limited to jurisprudential and rhetorical study. However, a perch in the best practices of law school teaching …

Speaking The Truth: Supporting Authentic Advocacy With Professional Identity Formation, Laura A. Webb 2020 University of Nevada, Las Vegas -- William S. Boyd School of Law

Speaking The Truth: Supporting Authentic Advocacy With Professional Identity Formation, Laura A. Webb

Nevada Law Journal

When law students are asked to articulate legal rules in a persuasive communication such as a brief, they may experience internal tension. Their version of the rule, as framed to benefit a particular client’s position, may be different from the way they would articulate the rule if they were not taking on an advocate’s role. The conflict between those two versions of a legal rule leads some students to wonder if advocacy itself is deceptive, if an advocate’s role requires one to sacrifice ethics for success, and if ancient Greek philosophers were correct when they derided persuasive communication as “trickery …

Korean Code Of Ethics For Attorneys, Wonji Kerper, Changmin Lee 2020 University of Washington School of Law

Korean Code Of Ethics For Attorneys, Wonji Kerper, Changmin Lee

Washington International Law Journal

In 2009, Korea implemented a law school educational system, which not only changed the legal education system, but the legal landscape as a whole. This has led to rapid growth in the number of attorneys. Although the increased number of attorneys has resulted in lower barriers to accessing justice, it has also brought the unintended consequence of cut-throat competition. With the number of disciplinary actions rising by four-fold in the last three years, the current version of the Korean Code of Ethics for Attorneys is certainly a step in the right direction but may not be enough to strengthen attorneys’ …

Comprehensive Rezonings, Sara C. Bronin 2020 Brigham Young University Law School

Comprehensive Rezonings, Sara C. Bronin

BYU Law Review

Of all powers given to local governments, the power to zone is one of the most significant. Zoning dictates everything that gets built in a locality—and thus effectively dictates all of the key activities that take place within it. Nationwide, most zoning codes were adopted in the first half of the twentieth century. Many, including the zoning codes of New York City and Chicago, were significantly revised in the 1960s. While these codes have been revised piecemeal, just a few American cities have undergone a comprehensive revision: replacing the old code with a completely new one.

A comprehensive rezoning can …
