What Is Quality? Advancing Value-Added Approaches To Assessing Law School Bar Exam Performance, Jason M. Scott, Josh Jackson

U.S. News & World Report rankings and tier groupings are often used as proxy measures of law school quality. But many of the factors that contribute to both law school outcomes and U.S. News rankings (e.g., undergraduate GPAs [UGPA], LSAT scores, admission rates) do not reflect the impact law schools have on student outcomes, such as bar passage and employment. We propose a method for measuring institutional quality that is based on a school’s ability to improve its graduates’ likelihood of first-time bar passage while controlling for those students’ preadmission characteristics. Using a value-added modeling technique, we first isolate each …

Law School Rankings And The Impossibility Of Anti-Racism, Rory D. Bahadur

This Article uses the U.S. News law school rankings to illustrate how powerful, invisible, and stubborn systemic racism is. This Article does not level allegations of intentionally blameworthy conduct at U.S. News, or any person or entity. More broadly, this Article does not address conscious and deliberate racism, or the examples of this type of racism with which America’s history is replete. Nor is this Article attempting to undervalue the significant impact of deliberately racist actions in American history on the economic disparity between white people and people of color.

Using Artificial Intelligence In The Law Review Submissions Process, Brenda M. Simon

The use of artificial intelligence to help editors examine law review submissions may provide a way to improve an overburdened system. This Article is the first to explore the promise and pitfalls of using artificial intelligence in the law review submissions process. Technology-assisted review of submissions offers many possible benefits. It can simplify preemption checks, prevent plagiarism, detect failure to comply with formatting requirements, and identify missing citations. These efficiencies may allow editors to address serious flaws in the current selection process, including the use of heuristics that may result in discriminatory outcomes and dependence on lower-ranked journals to conduct …
