The Impact Of Artificial Intelligence On Access To Justice: Predictive Analytics And The Legal Services Market, Matthew Dylag
Dalhousie Law Journal
This paper examines how developers of predictive analytics—a technology using artificial intelligence (AI) to predict the outcomes of legal disputes—position their product vis-à-vis access to justice. In particular, it examines how two companies market their software to better understand how this technology is being integrated into the legal services market and to comment on the software’s potential impact on access to justice. The first part of this paper reviews the access to justice landscape and examines existing critiques of AI supported technology from an access to justice perspective. The second part briefly outlines the scope and design of the study, …

Navigating Crisis: An Intersectional Analysis Of Marginalized Women’S Role In Sustaining Community Cooperatives Through The Covid-19 Pandemic, Rizky Septiana Widyaningtyas
The Indonesian Journal of Socio-Legal Studies
This study analyzes the challenges faced by PEKKA women in Bantul regarding economic empowerment amid the Indonesian government's social restriction policies. It also explores the strategies these women have implemented to survive and strengthen community cooperatives during and after the pandemic. Using a socio-legal method with an intersectional approach, the results indicate that the pandemic and social distancing measures have significantly impacted the economies of female-headed households compared to those supported by both husbands and wives. This impact is particularly pronounced for women who run small businesses that had to close during the pandemic. PEKKA women work collectively in community …

From Australian Influence To Rohingya Refugees: A Systematic Literature Review Of Asylum Seekers And Refugees In Indonesia, Bilal Dewansyah
The Indonesian Journal of Socio-Legal Studies
The fact that Indonesia hosts asylum seekers and refugees attracted not only policy debate and media attention but also academic research. However, no systematic review has been conducted to assess the scholarly literature on this topic. This article is intended to fill this gap by presenting a systematic literature review (SLR) on asylum seekers and refugees in Indonesia. As a result, I found five major themes in the reviewed literature: (1) the focus on the Indonesia – Australia relationship; (2) people smuggling; (3) refugees’ journey and living conditions in Indonesia; (4) Rohingya refugees; (5) legal protection and refugee status. However, …

Faculty Scholarship
In April 2020, the U.N. Committee on Economic, Social and Cultural Rights released General Comment No. 25, which provides an authoritative interpretation of the right to science—a right that has hitherto not received much attention. In light of this publication and the recent celebration of the 75th anniversary of the Universal Declaration of Human Rights, this article examines the complex interplay between intellectual property and the right to science, with a view toward the human rights challenges brought about by both the COVID-19 pandemic and the arrival of generative AI.
The article begins by documenting the historical evolution of the …

New York City Misses The Exit To Traffic Safety, Joseph Caffrey
Capstones
New York City Misses the Exit to Traffic Safety investigates New York City’s mounting traffic violence crisis through the lens of a devastating crash that killed a Brooklyn mother and her two daughters. It examines the city’s inconsistent enforcement of reckless driving and the failure of the Dangerous Vehicle Abatement Program (DVAP), which aimed to reform recidivist speeders. The piece investigates the imperfections of Vision Zero, public backlash to automated enforcement, and the broader failure to prevent recidivist speeding. It also explores policy alternatives like Intelligent Speed Assistance (ISA), highlighting legislative efforts to revive accountability and save lives, while advocating …

Holding Up A Mirror To Hostile Gender Legislation: The Impact Of Drag Bans On The Theater Industry, Claire B. Epstein
Pace Law Review
States, particularly infringing upon the rights of the LGBTQIA+ community. Certain states have sought to introduce “drag ban” laws under the guise of protecting children from viewing obscene content. These laws, in effect, are harmful to people, children especially, and have a chilling effect on expression, leaving critical harm in their wake. Laws such as these cast a wide net of regulation, opening up otherwise innocent citizens to criminal and civil liability. The theater industry is particularly affected by these regulations, even if lawmakers do not acknowledge this potential harm. This article will focus on three laws seeking to regulate …

One of the world’s most influential leaders in the health ecosystem never thought he’d make it to college, let alone to the C-Suite of a major corporation helping diversify the American health care workforce. But Steve Beard isn’t your average CEO.
Raised on the south side of Chicago, Beard just assumed he was destined for a blue collar career after high school. But a guidance counselor, seeing something in Beard that he didn’t see in himself, urged him to apply to college. Four years later Beard was a graduate of the University of Illinois. A brief stint in banking led …

The Real Impact Of General Deterrence: Empirical Insights From The Robbery Data Of Three American Cities, Andrew W. Eichner
Catholic University Law Review
General deterrence theory relies on the critical assumption that prospective offenders will be deterred from committing crimes when they are aware of the apprehension and punishment of others. This idea has been reiterated across thousands of years of Western political thought and has significant implications in modern American criminal sentencing, though it has not been historically subjected to rigorous testing. The recent availability of voluminous crime data permits a deeper examination of the real impact of sentencings on crime trends and allows the opportunity for previously impossible analyses regarding the efficacy of general deterrence.
To examine whether there is evidence …

When Poison Is On The Menu: Proposing The Adoption Of Ireland’S Stricter Allergen Regulations In America’S Food Establishments, Katherine Fitzgerald
Journal of Law and Policy
In the modern era, a growing number of children and adults have been diagnosed with deadly food allergies. For the approximately 33 million Americans who have at least one food allergy, restaurants, aside from the home, are the most likely place where deadly reactions could occur. In order to adapt to this expanding and sensitive population, the federal government should pass legislation that protects these citizens from suffering a preventable, untimely death. Luckily, the legislators of the European Union, and specifically Ireland, have already put food labeling legislation in place that serves to protect those with food allergies. This Irish …

Pragmatics And Textualism, Lawrence B. Solum
Journal of Law and Policy
In theoretical linguistics the word “pragmatics” refers to the roles of context and communicative intentions in the production of meaning. Those roles include contextual disambiguation and the communication of implicit content via what is called “pragmatic enrichment.” Textualism is sometimes characterized as the view that the meaning of statutory texts should not take context into account, but that characterization is incorrect. Not only do self-identified textualists explicitly maintain that context should be considered when interpreting statutes—all good textualists must do so. Absent consideration of context, the meaning of statutory texts would be pervasively ambiguous, sparse, and incomplete. Good textualism requires …

America’S Rampant Gun Epidemic: How 3d Printers Are Only Adding Fuel To The Fire, Haley Lustbader
Journal of Law and Policy
The assassination of the United Healthcare CEO in December of 2024 captivated national attention, specifically over the killer’s use of a homemade three dimensional (“3D”) printed gun. The use of 3D printing poses a breadth of opportunity for useful and valuable innovation across a variety of fields, such as allowing advancements in medical technology. However, with technology expansion comes associated risk and, in this case, that risk is the potential for increased presence of illegal firearms. Anyone with access to a 3D printer can download the necessary files and print weapon parts to create their own unregistered, untraceable firearms, including …

A Stronger Future For Family Law Arbitration: Enhancing The Uniform Family Law Arbitration Act To Shield The Vulnerable, Jayden Solomon
Journal of Law and Policy
The rising popularity of alternative dispute resolution (“ADR”) methods, particularly arbitration, has transformed family law practices, offering more accessible and efficient means of resolving disputes. This Note explores the critical role of the Uniform Family Law Arbitration Act (“UFLAA”) in safeguarding vulnerable populations, specifically children and domestic violence survivors, within the arbitration process. While the UFLAA offers important protections, these measures should serve as a starting point rather than a benchmark for ensuring these safeguards. This Note advocates for the integration of more robust protections within the UFLAA to better protect these individuals throughout arbitration. It examines the history of …

Unveiling The Underbelly Of Artificial Intelligence: The Inadequacies Of The Legal System With Regard To Victims Of Nonconsensual Sexual Deepfakes, Zilana Lee
Journal of Law and Policy
Artificial intelligence-powered deepfake technology has ushered a new era of digital sexual abuse, allowing for the seamless fabrication of explicit images that violate bodily autonomy with alarming realism. With little more than a photograph scraped from social media, individuals can use AI tools to fabricate hyper-realistic nude images and pornographic videos of people without their consent. These nonconsensual sexual deepfakes are rapidly spreading online, often going viral before victims are even aware of their existence. The technology can affect anyone, but women and girls remain disproportionately targeted. Recent incidents involving minors highlight both the reach and severity of this harm. …

Shaping A More Equitable Election System: A Canadian Approach To Solving The Voting Rights Crisis In America, Michelle Gutowski
Journal of Law and Policy
In 1965, the Voting Rights Act was passed, ushering in a new era of voting freedom. The Act brought an end to many of the overtly discriminatory practices that had persisted for nearly two centuries. Over time, however, states began to introduce more subtle and complex voting regulations that gradually undermined the gains achieved through the civil rights movement. In 2021, the Supreme Court dismantled an essential safeguard for voters, significantly weakening the protections the Act once guaranteed. This erosion of protections is largely attributable to a single doctrinal standard within the Act, known as the totality of the circumstances …
