For many years, most scholars have assumed that the strength of reputational incentives is positively correlated with the frequency of repeat play. Firms that sell more products or services were thought more likely to be trustworthy than those that sell less because they have more to lose if consumers decide they have behaved badly. That assumption has been called into question by recent work that shows that, under the standard infinitely repeated game model of reputation, reputational economies of scale will occur only under special conditions, such as monopoly, because larger firms not only have more to lose from behaving …

Our society faces major challenges in numerous areas, including climate change and healthcare. Addressing these problems with technological advances are of great importance. Increasingly, however, consumers are resisting or rejecting such technological interventions based on inappropriate assignment of risk. In other words, the consumer assessment of risk is not in line with evidence-based assessment of risk. This article focuses on two controversial areas, vaccines and genetically engineered food, as examples in which consumers assign a high risk despite an evidence-based assessment of low risk. O Brother Where Art Thou? The Struggles Of African American Men In The Global Economy Of The Information Age, Kenneth G. Dau-Schmidt

Indiana Journal of Law and Social Equality

As early as the late 1980’s, William Wilson argued that widespread economic transitions had altered the socioeconomic structure of American inner cities to the detriment of African Americans. Wilson identified declines in manufacturing work and its replacement with poorly compensated service sector work as driving racial segregation and leaving African Americans jobless, poor and alienated from American society. These transitions were particularly problematic for African American men since manufacturing work was their primary gateway to middle-class employment while African American women had already focused more on service work.

This Article explores the growing divide between the Roberts Court’s treatment of the free speech rights of wealthy individuals and corporations in campaign finance cases as compared to its treatment of the rights of public-sector labor unions and their members. First, it highlights some internal contradictions in the Janus Court’s analysis. Then, it discusses the growing—yet mostly ignored—divergence in the Court’s treatment of corporate and labor speakers with respect to the use of market influence to achieve political influence.

Distributive Justice And Rural America, Ann M. Eisenberg

Today’s discourse on struggling rural communities insists they are “dying” or “forgotten.” Many point to globalization and automation as the culprits that made livelihoods in agriculture, natural resource extraction, and manufacturing obsolete, fueling social problems such as the opioid crisis. This narrative fails to offer a path forward; the status quo is no one’s fault, and this “natural” rural death inspires mourning rather than resuscitation. This Article offers a more illuminating account of the rural story, told through the lens of distributive justice principles. Occupational choice at the margin depends on both the incentives for entry and barriers to entry. The primary entry barrier determined by regulation is an occupational license. These are government laws determining the minimum qualifications to enter an occupation including education, testing, fees, and background checks. These regulations are currently enforced on 25% of the US labor market. The laws are crafted to protect consumers from unsafe goods and services but also have important consequences in labor market outcomes. The consequences may include fewer workers entering the profession, changes to which workers enter the profession, and altering competition, all of …

In this Article, I extend a prior inquiry into the costs borne by society due to the lack of enough decent, affordable housing units. I previously outlined those costs and suggested a combination of public cost savings and public and private benefits that would accrue by providing that housing. I posited that the savings and benefits, in the aggregate, could at least substantially offset the costs and might even exceed them. If that is so, I queried, why has society not produced the needed units? In answering that question, I offered several possible responses: inadequate resources, racism, and public choice …

Labor, Trade, And Populism: How Ilo-Wto Collaboration Can Save The Global Economic Order, Sungjoon Cho, Cesar F. Rosado-Marzan

Populists are trying to take down the global economic order and its institutions. While some of those forces might be fueled by racism, they also play to legitimate social concerns that include massive plant closings and deindustrialization, inadequate skills programs, and lack of decent jobs. Some of these problems also concern the Global South, as workers there face exploitation, unhealthy working conditions, and other social ills caused by global capitalism. In light of these problems, this Article argues that the International Labor Organization (ILO) should design new conventions on lead firm liability and mass layoffs. The Sherman Act Is A No-Fault Monopolization Statute: A Textualist Demonstration, Robert H. Lande, Richard O. Zerbe

The drafters of the Sherman Act originally designed Section 2 to impose sanctions on all monopolies and attempts to monopolize, regardless whether the firm had engaged in anticompetitive conduct. This conclusion emerges from the first ever textualist analysis of the language in the statute, a form of interpretation originally performed only by Justice Scalia but now increasingly used by the Supreme Court, including in its recent Bostock decision.

Following Scalia’s methodology, this Article analyzes contemporaneous dictionaries, legal treatises, and cases and demonstrates that when the Sherman Act was passed, the word “monopolize” simply meant that someone had acquired a monopoly. …

The deterrence of copyright infringement and the evils of piracy have long been an axiomatic focus of both legislators and scholars. The conventional view is that infringement must be curbed and/or punished in order for copyright to fulfill its purported goals of incentivizing creation and ensuring access to works. This Essay proves this view false by demonstrating that some rightsholders don’t merely tolerate, but actually encourage infringement, both explicitly and implicitly, in a variety of different situations and for one common reason: they benefit from it. Copyright provides a long term of legal excludability, ostensibly to encourage the production of new creative works. How long this term should last, and the extent to which current law aligns with the economic incentives of copyright owners, has been the subject of vigorous theoretical debate. We investigate the economic viability of content in a major content industry—commercial music—using a novel longitudinal dataset of weekly sales and streaming counts. We find that the typical sound recording has an extremely short commercial half-life—on the order of months, rather than years or decades—but also see evidence that subscription streaming services are extending …

The conventional wisdom is that property rules induce more—and more efficient—contracting, and that when faced with rigid property rules, intellectual property owners will contract into more flexible liability rules. A series of recent, private copyright deals show some intellectual property owners doing just the opposite: faced with statutory liability rules, they are contracting for more protection than that dictated by law, something this Article calls “super-statutory contracting”—either by opting for a stronger, more tailored liability rule, or by contracting into property rule protection. การเปลี่ยนแปลงและการพัฒนาที่รวดเร็วของเทคโนโลยีดิจิทัล ส่งผลให้พฤติกรรมของคนเปลี่ยนไป ใน หลายๆ ด้าน ซึ่งรวมถึงการทำธุรกรรมต่างๆ ในปัจจุบันที่มีแนวโน้มที่จะปรับเปลี่ยนวิธีการทำธุรกรรมจากการ ติดต่อโดยตรง ไปสู่การทำธุรกรรมทางอิเล็กทรอนิกส์มากขึ้น เนื่องจากการทำธุรกรรมทางอิเล็กทรอนิกส์มีความ รวดเร็ว และมีประสิทธิภาพ และเพื่อให้การทำธุรกรรมทางอิเล็กทรอนิกส์มีสถานะทางกฎหมาย จึงมีการตรา พระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 และฉบับแก้ไขเพิ่มเติมขึ้น มีเจตนารมณ์เพื่อรับรอง การทำธุรกรรมทางอิเล็กทรอนิกส์ และส่งเสริมการทำธุรกรรมของผู้ประกอบการเอกชนเพื่อยกระดับอุตสาหกรรม ให้มีความน่าเชื่อถือมากขึ้น ดังนั้น จึงมีความจำเป็นในการมุ่งศึกษาปัญหาของพระราชบัญญัติว่าด้วยธุรกรรมทาง อิเล็กทรอนิกส พ.ศ. 2544 การประเมินผลสัมฤทธิ์ของพระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 และฉบับแก้ไขเพิ่มเติม เพื่อเสนอแนวทางที่เหมาะสมเบื้องต้นในการปรับปรุงเพิ่มเติมแก้ไขกฎหมายและ แนวทางการปฏิบัติระหว่างหน่วยงานที่เกี่ยวข้อง เพื่อส่งเสริมการทำธุรกรรมทางอิเล็กทรอนิกส์ของประเทศไทย จากการประเมินผลสัมฤทธิ์ของพระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 และฉบับ แก้ไขเพิ่มเติม ในมุมมองของภาคเอกชนที่เป็นผู้ประกอบธุรกิจ พบว่า ผู้ประกอบการเห็นถึงความจำเป็นของการ ตราพระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 และฉบับแก้ไขเพิ่มเติม แต่ในมิติของการบังคับ ใช้กฎหมายพบว่า พบว่า ปัจจุบันกฎหมายยังไม่สามารถใช้บังคับได้อย่างมีประสิทธิภาพ เนื่องจากความไม่พร้อม ของภาครัฐที่ส่งผลกระทบต่อความเชื่อมั่น จึงมีข้อเสนอแนะดังนี้ ภาครัฐที่เกี่ยวข้องควรมีการส่งเสริมให้หน่วยงานภาครัฐอื่นๆ สามารถรับรองธุรกรรมอิเล็กทรอนิกส์โดย ผลักดันภาครัฐที่เกี่ยวข้องให้สร้างความตระหนักรู้ให้แก่บุคลากรภาครัฐในหน่วยงานต่างๆ เพื่อให้เกิดความรู้ความ เข้าใจ รวมไปถึงความจำเป็นในการทำธุรกรรมทางอิเล็กทรอนิกส์ การรับรองพยานหลักฐานอิเล็กทรอนิกส์เพื่อให้การปฏิบัติจริงสอดคล้องกับกับเจตนารมณ์ทางกฎหมาย แม้ว่าพระราชบัญญัติว่าด้วยธุรกรรมทางอิเล็กทรอนิกส์ พ.ศ. 2544 มีเจตนารมณ์เพื่อรองรับผลทางกฎหมายของ ข้อความที่อยู่ในรูปของข้อมูลอิเล็กทรอนิกส์ให้มีความเท่าเทียมทางกฎหมายให้เท่าเทียมกับข้อความที่อยู่ในรูปของ เอกสารกระดาษ การเพิ่มเติมส่วนของกระบวนการประเมินผลสัมฤทธิ์ทางกฎหมายให้ชัดเจนมากขึ้น โดยการมีหลักเกณฑ์ที่ ชัดเจนในการเปรียบเทียบระหว่างผลกระทบและผลสัมฤทธิ์ รวมถึงแนวทางในการนำผลสัมฤทธิ์มาไปพิจารณา ต่อไป การส่งเสริมและสนับสนุนผู้ประกอบธุรกิจดิจิทัลและธุรกิจพาณิชย์อิเล็กทรอนิกส์ เพื่อสนับสนุนและ ส่งเสริมการพัฒนาธุรกรรมทางอิเล็กทรอนิกส์และพาณิชย์อิเล็กทรอนิกส์ของประเทศ หน่วยงานรัฐควรมีการ ส่งเสริมและสนันสนุนให้ผู้ประกอบการมีการทำธุรกรรมทางอิเล็กทรอนิกส์ เพื่อสร้างความเชื่อมั่นให้แก่ ผู้ประกอบการ โดยออกแนวทางหรือมาตรฐานที่ครอบคลุมและมีความเหมาะสมกับบริบทของแต่ละธุรกิจ
