Regulating Medicines In A Globalized World With Increased Recognition And Reliance Among Regulators: A National Academies Report, Lawrence O. Gostin, Alastair J. Wood, Patricia A. Cuff

Research and development of pharmaceuticals are now complex global endeavors, with drug companies operating worldwide using global supply chains. Pharmaceutical companies source their products from many countries, conduct trials in multiple sites, and market essential drugs and vaccines globally. Yet oversight of drug safety and effectiveness is primarily the responsibility of national regulators of variable capacities. National agencies often undertake product reviews without recognizing that similar reviews are occurring elsewhere, sometimes simultaneously. The result is duplication and redundancy, which benefits neither national nor global public health. Supported by the US Food and Drug Administration (FDA), the National Academies of Sciences, …

The Dangers Of Disclosure: How Hiv Laws Harm Domestic Violence Survivors, Courtney K. Cross
Washington Law Review
People living with HIV or AIDS must decide whether, how, and when to disclose their positive status. State laws play an outsized role in this highly personal calculus. Partner notification laws require that current and former sexual partners of individuals newly diagnosed with HIV be informed of their potential exposure to the disease. Meanwhile, people who fail to disclose their positive status prior to engaging in sexual acts—even acts that carry low to no risk of infection—can be prosecuted and incarcerated for exposing their partners to HIV. Although both partner notification laws and criminal HIV exposure laws were ostensibly created …

Trump V. Commonwealth Of Pennsylvania: Brief For Nicholas Bagley And Samuel L. Bray As Amici Curiae Supporting Petitioners, Nicholas Bagley
Appellate Briefs
Amici curiae are professors of law who have expertise that bears directly on one of the questions before this Court: Whether the court of appeals erred in affirming a nationwide preliminary injunction barring implementation of the final rules challenged by respondents.<\p>
This case squarely raises the propriety of an accelerating trend in the lower federal courts issuing injunctions that extend beyond the parties to bar enforcement of a challenged federal law or policy across the Nation. These injunctions are variously called "national," "universal," or "nationwide." They are inconsistent with the proper role of the federal courts in our constitutional structure …

Institute for the Study of Free Enterprise Working Papers
The 2010 Patient Protection and Affordable Care Act (ACA) introduced a mandate requiring chain restaurants to post calorie counts on menus and menu boards. This paper investigates whether and why calorie posting laws work. To do so, we develop a model of calories consumed that highlights two potential channels through which mandates influence choice and outlines an empirical strategy to disentangle these alternatives. We test the predictions of our model using data from the Behavioral Risk Factor Surveillance System to compare changes in body mass index (BMI), obesity, and consumer well-being in locations that implemented calorie-posting laws between 2008 and …

As the New York State legislature considers legalizing compensated gestational surrogacy this legislative session, this report provides insight into (1) the impact of surrogacy on the medical and mental health of women who become surrogates and the children born through gestational surrogacy, and (2) how other state legislatures have addressed compensated gestational surrogacy in recent years.
Medical research demonstrates that there is significant growth in gestational surrogacy in the United States. The number of families working with gestational surrogates has quadrupled in the new millennium. Weill Cornell Medicine physicians and medical students reviewed the published literature on the medical and …

Fluoridation: Our History, Our Legacy, James Wieland Dds
The Journal of the Michigan Dental Association
2020 marks the 75th anniversary of one of the world’s most dramatic public health initiatives, a public health project that dramatically improved the oral health of millions of people, not only in the United States but throughout the world. On Jan. 25, 1945, the Grand Rapids Study was launched and the Furniture City became the world’s first to adjust the fluoride level of its public water supply.
This landmark trial established the use of fluoridation as a safe, effective, and economical public health measure to prevent tooth decay.
How the Grand Rapids Study began is a fascinating story. Even though …

The Flint Water Crisis And Community Water Fluoridation: A Lesson In Communication. Communicating With The Public And Connecting With Community Leaders, Traci J. Dantzler Dds, Raymond Gist Dds
The Journal of the Michigan Dental Association
This article presents how not only was Flint’s water compromised lead contamination of residential waterlines during the Flint Water Crisis, but area dentists had to work hard to refute unsubstantiated claims that adding fluoride to the community water supply increased the level of lead in the water. Oral health advocacy to reassure citizens and build confidence in the community water supply following remediation efforts required sharing the best evidence while most importantly actively listening to assure that community members were heard; that they felt that they have a voice, and to know that we are here to listen to their …

A goal of the 3rd phase of the Electronic Medical Records and Genomics (eMERGE3) Network was to examine the return of results (RoR) of actionable variants in more than 100 genes to consenting participants and their healthcare providers. Each of the 10 eMERGE sites developed plans for three essential elements of the RoR process: Disclosure to the participant, notification of the health care provider, and integration of results into the electronic health record (EHR). Procedures and protocols around these three elements were adapted as appropriate to individual site requirements and limitations. Detailed information about the RoR procedures at each site …

The Dynamism Of Health Law: Expanded Insurance Coverage As The Engine Of Regulatory Reform, Gabriel Scheffler

Can law improve the delivery of health care? The predominant view is that law serves as a barrier to reforming the health care delivery system. Health law scholars of all stripes blame regulations for impeding innovation, limiting competition, and exacerbating fragmentation in health care.
I argue that this view neglects an important-but overlooked-feature of health law: the dynamic relationship between laws that expand health insurance coverage and laws that regulate the delivery of health care. By expanding health insurance coverage and increasing the demand for health care, laws such as Medicare, Medicaid and the Affordable Care Act catalyze policymakers to …

Maybe If We Turn It Off And Then Turn It Back On Again? Exploring Health Care Reform As A Means To Curb Cyber Attacks, Deborah Farringer

The health care industry has moved at a rapid pace away from paper records to an electronic platform across almost all sectors — much of it at the encouragement and insistence of the federal government. Such rapid expansion has increased exponentially the risk to individuals in the privacy of their data and, increasingly, to their physical well-being when medical records are inaccessible through ransomware attacks. Recognizing the unique and critical nature of medical records, the United States Congress established the Health Care Industry Cybersecurity Task Force under the Cybersecurity Information Sharing Act of 2015 for the purpose of reviewing cybersecurity …

Florida regularly has been ground zero for election news during the 21st century. During elections in Florida, both individual and public health issues resonate strongly, because of the state’s demographics and history. Health care policy is certain to be a key issue in the upcoming election season.
To educate voters about a slate of core, national health law and public health law election issues, NSU Law will host national expert James G. Hodge, Jr., the Peter Kiewit Foundation Professor of Law at the Sandra Day O’Connor College of Law, Arizona State University.

At this writing, the final results of the Iowa caucuses remain unreported. No one yet knows which candidates did well and which did poorly. We do know that health policy is a defining cleavage between left and liberal Democrats this primary season. Much of the press coverage will naturally focus on the implications of this vote for Democrats’ commitment to an incremental public option or a full-throated single-payer plan.
