New York’s special election system for filling vacancies in the U.S. House of Representatives and the State Legislature excludes voters from the candidate selection process. Instead of voters selecting nominees, political party leaders designate their parties’ respective candidates. In this report, the Fordham Law School Rule of Law Clinic recommends reforming this system by implementing open special elections using ranked choice voting. All candidates who meet petition signature requirements, regardless of party affiliation, would compete in a single election. This reform would improve participation, representation, and accountability without sacrificing efficiency.

Hyperpartisanship has hit century-long highs in American politics and is emboldening state government attempts to undermine election outcomes by using control over state lawmaking structure to strip away authority, and sometimes outright unseat, partisan opponents after they win elected office. Even as traditional norms against such moves have eroded, the Supreme Court has taken a pro-partisanship turn in removing judicial checks against such moves under equal protection and constitutional structure. This Article will highlight examples of antiabortion politicians abusing their positions throughout the initiative process to maintain their preferred antiabortion status quo during the 2024 election cycle, before Election Day—despite broad and increasing support for legal abortion. Ultimately, in only Arkansas, Florida, Nebraska, and South Dakota, antiabortion politicians succeeded; in Arizona, Colorado, Missouri, Montana, and Nevada citizens voted to expressly protect abortion in their state constitutions through the citizen-led initiative process.

While constitutional doctrine formally distinguishes between racial and partisan gerrymandering, this distinction has become increasingly untenable in the modern electoral landscape. In many jurisdictions, particularly in the South, race and political affiliation are deeply intertwined. As a result, what courts treat as “partisan” redistricting often operates as de facto racial gerrymandering, shielding racially discriminatory practices from judicial review. The legal separation of race and party not only reflects a formalist fiction but also undermines the protections the Equal Protection Clause and the Voting Rights Act were designed to provide. Section 2 of the Voting Rights Act now stands at a paradoxical crossroads. Though it remains the statute’s central protection against racial vote dilution after Shelby County v. Holder, it is increasingly undermined by a constitutional framework that treats race-conscious remedies as suspect rather than necessary under Section 2. This Essay argues that Section 2 is being quietly unmade—not through direct invalidation, but through the convergence of Equal Protection Doctrine, racial-gerrymandering jurisprudence, and an ascendant commitment to colorblind constitutionalism. Presidential elections do more than choose a leader; they give us an inside look at how identity shapes voters’ choices. The 2024 election made this especially clear. Election litigation is surging. But just as litigants pursue more election claims in federal courts than ever before, federal courts are growing more skeptical about their authority to hear them.
