Foundations For Platform Liability, Kathryn E. Spier, Rory Van Loo

From spreading misinformation to selling deadly products, bad actors use technology platforms to their advantage while causing devastating harms to privacy, health, and even democracy. Despite their central role in enabling these bad actors, the platforms almost entirely escape liability. This legal immunity is purportedly grounded in economics. From the beginning, courts and legislatures feared that liability would chill innovation, growth, and user access. They also speculated that platforms have sufficient market incentives to voluntarily police bad actors, making liability unnecessary.

This case note examines the governance implications arising from the onset of accelerated satellite internet expansion and explores potential regulatory solutions for effective governmental oversight. Due to the interconnected nature of the internet and its global network, international organizations and treaties play a crucial role in content and data regulation, and rapid technological evolution presents increasing difficulties for these regulatory frameworks to keep pace. Facial recognition technology has been employed by law enforcement agencies and private companies for decades. This technology promises safer and more efficient processes to identify individuals in the name of safety. However, not everyone approves of their biometric data being collected. This Article provides an overview of the current use of facial recognition technology by the Transportation Security Administration (TSA) in airport security checkpoints. It begins by explaining the underlying technology behind facial recognition and explores the safety and security concerns behind it. Regulation of autonomous vehicles continues to be a daunting task in the United States, and the federal government has not yet succeeded in creating a regulatory scheme that intelligently addresses the risks and benefits of these vehicles. There are multiple reasons for this regulatory lag. Autonomous vehicles are developing at such a rapid pace that lawmakers, who often struggle with technological literacy, struggle to keep up. Additionally, government agencies lack the level of expertise, experience, and data that the industry possesses.

Generative AI platforms are developed by scraping data from other platforms. This raises complex copyright infringement issues that are yet to be resolved. Courts have attempted to address these problems using the fair use doctrine, which evaluates four factors to determine whether a use infringes on copyright: (1) the purpose and character of the use, (2) the nature of the use, (3) the amount and substantiality of the copyrighted work’s use, and (4) the impact of the use on the market for the original work. At the height of the pandemic, some 110,000 restaurants shut down. The increasing complexity of cybersecurity challenges necessitates a holistic educational approach that integrates both technical skills and humanistic perspectives. This article examines the importance of infusing humanities disciplines such as history, ethics, political science, sociology, law, and anthropology—into cybersecurity education. Through a pilot course developed for Staten Island Technical High School, aligned with the New York State K-12 Computer Science and Digital Fluency Standards, students were introduced to an interdisciplinary curriculum that combined technical cybersecurity training with historical analysis, ethical reasoning, and sociopolitical context. The rapid development of technology in the last decade has affected all levels of society. Corporate governance has not been immune to these changes. In the future, Artificial Intelligence (“AI”) fiduciaries may be technologically capable of serving as independent corporate directors. This could be an effective way to address the challenge of the absence of truly independent directors in the traditional governance framework. Artificial fiduciaries could also offer a way to mitigate agency costs and improve overall corporate governance.
