Patent Privateers And Antitrust Fears, Matthew Sipe

Patent trolls are categorically demonized as threatening American innovation and industry. But whether they are a threat that antitrust law is equipped to deal with is a complex question that depends on the particular type of patent troll and activities they engage in. This Article looks specifically at privateer patent trolls: entities that acquire their patents from operating entities and assert them against other industry members. In the particular context of privateering, antitrust law is almost certainly not the proper legal solution. Privateering does raise significant issues: circumventing litigation constraints, evading licensing obligations, and raising the cost and frequency of …

The Proposed Separation Of Powers Restoration Act Goes Too Far, Jack M. Beermann

If passed, the Separation of Powers Restoration Act would require federal courts conducting judicial review of agency action to decide “de novo all relevant questions of law, including the interpretation of constitutional and statutory provisions and rules.” Although I have long been highly critical of Chevron, see, e.g., Jack M. Beermann, End the Failed Chevron Experiment Now: How Chevron Has Failed and Why It Can and Should be Overruled, 42 Conn. L. Rev. 9 (2010), and also have misgivings about Auer deference, I fear that the proposed Act goes too far in completely eliminating deference to agency legal determinations.

The invention of chemically embossed cushioned vinyl flooring revolutionized the flooring industry in the mid-1900s, and the patents on this technology became the basis for large-scale litigation between two of the industry's leaders. This is the story of Mannington Mills, Inc. v. Congoleum Corp.-a case that implicated foreign patent rights and the territorial nature of patent law, the extraterritorial scope of U.S. antitrust law (at a time when this scope was changing and uncertain), competing doctrines of jurisdiction and abstention, and emerging international comity concerns. Ask almost anyone in Massachusetts, or in any other predominantly liberal American state, what they think about Justice Antonin Scalia, and you are bound to hear comments, not a few of them derisory, about original intent as an approach to constitutional law. This was true long before his death on February 13, 2016, and is still true today. The theory of originalism, the notion that the Constitution should be interpreted in accordance with the intent of its framers, had become so closely associated with Scalia that the man had become the living embodiment of the theory.

The aim of the paper is to present the impact of the Regulation on market abuse (MAR) on duties placed on companies trading in commodity derivatives. It also tackles the issue of the influence of the MAR Regulation on the commodity market and its relation to other legislation regarding the energy and gas market (REMIT, EMIR, MiFID II). The paper discusses also the precariousness and consequences of such legislative scope. Moreover questions are posed regarding the planned implementation schedule for the MAR Regulation as well as challenges for entities active on the energy market.

The amended Energy Law Act entered into force on 11 September 2015 and implements the REMIT Regulation into the Polish legal system. This article focuses on the penal sanctions specified in section 7a of the Polish Energy Law Act. Criminal liability is new for the domestic energy sector. The analysis includes issues such as: the purpose of introducing penal provisions, the catalogue of criminal sanctions (and their nature) as well as procedural standards (the investigation). This analysis was conducted in accordance with generally applicable laws, taking into account the views of jurisprudence and criminal law doctrine.

The aim of this article is to analyse the district heating sector in the context of unilateral anti-competitive behaviours of companies acting on local district heating markets. The lack of an ‘unbundling’ rule in the district heating sector, and the problematic issue of ‘third party access’ results in companies being relatively more willing to abuse their dominant positions held in local markets. The decision-making practice of the President of UOKiK, the Polish NCA, has been presented in order to better illustrate such unilateral behaviours alongside a description of the characteristic features of the district heating sector.
