Does Regulation Chill Democratic Deliberation? The Case Of Gmos, Alison Peck 2013 West Virginia University College of Law

Does Regulation Chill Democratic Deliberation? The Case Of Gmos, Alison Peck

Law Faculty Scholarship

Breakthroughs in science and technology pose a challenge to the U.S. legal system: either regulate under pre-existing laws using a business-as-usual approach, or pass new laws to deal with new relationships and conflicts created by these breakthroughs. How does the legal process determine when to regulate and when to legislate? Does that process adequately ensure deliberative democratic debate and implementation of democratic consensus? Does it adequately protect urgent interests in the meantime? Currently, this determination is ongoing with regard to new scientific developments such as climate change science, and new technological developments such as hydraulic fracturing of unconventional natural gas …

European Decisions About The 'Whack-A-Mole' Game, Drew L. Kershen 2012 University of Oklahoma College of Law

European Decisions About The 'Whack-A-Mole' Game, Drew L. Kershen

Drew L. Kershen

This article reports on several court decisions in Europe that illustrate the seemingly unending delays and barriers, within the EU structure, for genetically-engineered crops. Like the fun-park children’s game—wherein each time the player whacks a mole, another mole instantly pops to the surface so that the player must whack again—each time a producer of a GE crop appears to have approval for planting, another delay and barrier arises.

Luis González Vaqué

The European Commission Proposal to Simplify, Rationalise and Standardise Food Controls: Towards a New Concept of “Food Law” in the EU? There is no doubt that ensuring a high level of health for humans is a leading objective of the European Union (EU): This was set by the Treaty, has been declared unequivocally by the Community legislator and has been repeatedly confirmed by the Court of Justice of the EU (CJEU).

Agricultural Secrecy: Going Dark Down On The Farm: How Legalized Secrecy Gives Agribusiness A Federally Funded Free Ride, Rena I. Steinzor, Yee Huang

Rena I. Steinzor

This briefing paper examines the agricultural secrecy granted by section 1619 of the 2008 Farm Bill, its implications for transparency and oversight, and its impact on other federal agencies such as the U.S. Environmental Protection Agency (EPA). In an era of fiscal responsibility, tight budgets, and increasing pressure on the environment, the public has a right to know whether the U.S. Department of Agriculture (USDA) is making the best decisions about how to allocate public funds. Each year, agricultural producers in the United States receive billions of dollars in federal payments: crop subsidies, crop insurance, conservation payments, disaster payments, loans, …

“Winds Of Change”: Explaining Support For Wind Energy Developments In Ontario, Canada, Chad JR Walker 2012 The University of Western Ontario

“Winds Of Change”: Explaining Support For Wind Energy Developments In Ontario, Canada, Chad Jr Walker

Electronic Thesis and Dissertation Repository

This thesis addresses a major gap in the wind turbine and risk assessment literatures. It explains local support for wind energy in some areas in spite of vocal opposition in others. Findings from Port Burwell and Clear Creek, Ontario indicate that social and contextual forces may help explain much of the difference in opinion between the two communities. The case study was focused through 21 in-depth interviews. The interviews were analyzed verbatim using NVIVO 9 software. The findings were found to be consistent with Kasperson’s theory of the Social Amplification of Risk and seem to explain why Port Burwell is …

Farming Alone? What’S Up With The ‘‘C’’ In Community Supported Agriculture, Antoinette Pole, Margaret Gray

Department of Political Science and Law Faculty Scholarship and Creative Works

This study reconsiders the purported benefits of community found in Community Supported Agriculture (CSA). Using an online survey of members who belong to CSAs in New York, between November and December 2010, we assess members’ reasons for joining a CSA, and their perceptions of community within their CSA and beyond. A total of 565 CSA members responded to the survey. Results show an overwhelming majority of members joined their CSA for fresh, local, organic produce, while few respondents joined their CSA to build community, meet like-minded individuals or share financial risk with farmers. Members reported that they do not derive …
