A daunting welter of variables confronts anyone who sets out to systematize the First Amendment's effect on the government's role in regulating social services operated by religious organizations. The task is further complicated because the regulations in question often were promulgated as a consequence of the monitoring that inevitably accompanies government spending on private-sector welfare programs. The most suitable methodology should take into account: 1) the nature of the organizations that are the object of the government's regulation or program of aid; 2) the interrelationship between government and religious organizations that results from the regulation or aid; and 3) the …

The Uniform Land Security Interest Act (ULSIA or Act) seeks to improve the collection process in cases of default; indeed, most of the text and commentary of the Act deals with that topic. ULSIA has the blessings of the American College of Real Estate Lawyers and the Real Property Section of the American Bar Association. However, though it was first promulgated in 1985, the Act has not yet been adopted in any jurisdiction, nor has it received much consideration in the law reviews or trade journals. As a result, state legislatures do not have much existing analysis to aid them. …

On August 2, 1990, the whole world witnessed an unprecedented event in modern history, the unprovoked invasion of Kuwait by Iraqi armed forces. The invasion itself was historic in the sense that in this day and age it was still possible for one militarily powerful Asian Arab State to invade and overrun its relatively weaker sister State and to proceed to declare its annexation without fear of adverse reactions from the international community. After more than a decade of debate, the United States Congress enacted the omnibus Immigration Reform & Control Act of 1986 (IRCA), which ushered in a period of "legalization" or adjustment of status to allow undocumented aliens "to emerge from the shadows."

Part I of this article explores the rationale of the legalization program, the experience of other countries in encouraging applications for their respective "amnesty" or "regularization" programs, and the components of the American approach designed to maximize participation through massive outreach and broad confidentiality.

The argument of this Article proceeds on several fronts. First, using the example of transport of hazardous materials, and, occasionally, more general issues surrounding regulation of toxic substances, this Article will document the absence of a local voice in federal administrative law. Because of the dangers involved in the use of hazardous materials, they present a particularly troubling example of the risks and possible consequences involved in neglecting local initiatives. California Art Legislation Goes Federal: Progress In The Protection Of Artists' Rights, Thomas Goetzl

On January 6, 1993, continuing its tradition of off-site meetings, the American Association of Law Schools (A.A.L.S.) Art Law Section left San Francisco and crossed the Bay Bridge to hold its annual meeting and field trip at the Oakland Museum. The program was entitled "California Art Legislation Goes Federal." Because the Visual Artists Rights Act of 1990 (VARA) has its historic roots in legislation pioneered in California, we took this opportunity to gather individuals who could review that history and offer some insights into the future of artists' rights at the federal level.
