บทความวิจัยนี้มุ่งศึกษาถึงแนวคิดและหลักความรับผิดเพื่อละเมิด โดยเฉพาะความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นอันเกิดจากข้อสันนิษฐานความรับผิดตามกฎหมายภายใต้แนวคิดที่ว่าบุคคลนั้นอาจมีส่วนผิดอยู่ด้วยในการที่เกิดความเสียหายแก่บุคคลอื่น หรือมีความบกพร่องในการควบคุมดูแลจึงเกิดความเสียหายขึ้น การศึกษาวิจัยครั้งนี้เป็นการวิจัยเชิงคุณภาพ โดยเน้นการวิจัยเอกสารโดยศึกษาค้นคว้าจากหนังสือ งานวิจัย วิทยานิพนธ์ ตลอดจนบทบัญญัติกฎหมายที่เกี่ยวข้องกับความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นทั้งภาษาไทยและภาษาต่างประเทศ โดยนำข้อมูลต่าง ๆ มาศึกษาและวิเคราะห์เพื่อนำมาพัฒนากฎหมายความรับผิดเพื่อละเมิด จากการศึกษาพบว่ากฎหมายได้กำหนดความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นเอาไว้หลายกรณีโดยพิจารณาจากความสัมพันธ์ตามกฎหมาย ตามสัญญา ตามหน้าที่ในฐานะพิเศษ เช่น ความรับผิดของนายจ้างลูกจ้าง ความรับผิดของตัวการตัวแทน ความรับผิดของบิดามารดา ความรับผิดของครูบาอาจารย์ แต่ไม่พบกรณีความรับผิดของคู่สมรส ซึ่งคู่สมรสนั้นถือว่าเป็นบุคคลที่มีนิติสัมพันธ์ระหว่างกันตามกฎหมายอันก่อให้เกิดสิทธิ หน้าที่ และความรับผิด ด้วยเหตุนี้ จึงสมควรแก้ไขปรับปรุงกฎหมายโดยเฉพาะในเรื่องความรับผิดเพื่อละเมิดอันเกิดจากการกระทำของบุคคลอื่นของคู่สมรสเพื่อให้พัฒนาและสอดคล้องกับสภาพสังคม เพิ่มความระมัดระวังของบุคคลที่มีความสัมพันธ์เกี่ยวข้องในการดำเนินชีวิตทางสังคม ตลอดจนมุ่งเยียวยาและเพิ่มโอกาสให้ผู้ที่ได้รับความเสียหายได้รับการชดใช้ค่าสินไหมทดแทนอย่างเป็นธรรมอันเป็นไปตามเจตนารมณ์ของกฎหมายละเมิด

แม้ว่าองค์การการค้าโลกจะไม่สามารถทำอะไรกับภาษีทรัมป์ได้และปล่อยให้สหรัฐอเมริกาขึ้นอัตราภาษีกับประเทศคู่ค้า 59 ประเทศ ในรูปแบบการเจรจาแบบทวิภาคีก็ตาม แต่ระบบการค้าเสรีแบบพหุภาคีก็อาจยังไม่ถึงขั้นล่มสลาย เนื่องจากเหตุผลสองประการ ประการแรก คือ ประเทศคู่ค้า (ยกเว้นจีนและแคนาดา) ไม่ได้ขึ้นอัตราภาษีนำเข้าตอบโต้และสัดส่วนการค้าของสหรัฐอเมริกาในการค้าโลกคิดเป็นเพียงร้อยละ 11 เท่านั้น ประการที่สอง คือ ภาษีทรัมป์ที่มีพื้นฐานแนวคิดของลัทธิกีดกันทางการค้ามีความขัดแย้งอย่างมากกับแนวคิดพื้นฐานของเศรษฐศาสตร์กระแสหลักที่เชื่อในการค้าเสรีแบบพหุภาคี ทำให้เชื่อได้ว่าภาษีทรัมป์จะไม่ยั่งยืนตลอดไป อย่างไรก็ตาม มี “การแตกร้าว” ในระบบการค้าเสรีแบบพหุภาคีที่มีองค์การการค้าโลกเป็นผู้กำกับดูแลและบริหารกฎเกณฑ์ กล่าวคือ การไม่มีผู้ตัดสินในองค์กรอุทธรณ์ ส่งผลให้กลไกการระงับข้อพิพาทขององค์การการค้าโลกกลายเป็นอัมพาตและสหรัฐอเมริกาเป็นประเทศเดียวที่มีสถานะเหนือประเทศสมาชิกอื่น ๆ อีก 165 ประเทศ เนื่องจากเป็นสมาชิกประเทศเดียวในองค์การการค้าโลกที่สามารถกำหนดอัตราภาษีนำเข้าได้ตามอำเภอใจโดยอ้างเหตุผลด้านความมั่นคงของชาติ

Framing China In Conflict Reporting: A Critical Discourse Analysis Of Transitivity In Chinese And Western Media, Tingting Geng, Hongmei Tang

Journal of English and Applied Linguistics

This study employs a corpus-based critical discourse analysis (CDA) grounded in Halliday’s transitivity framework to investigate how China’s diplomatic stance is discursively constructed within conflict reporting. Focusing on media coverage of the Russian-Ukrainian War and the Palestinian-Israeli Conflict (2023), the study investigates how Chinese and Western mainstream media depict China’s stance. Based on a self-built corpus of 153 news reports and analyzed via AntConc, the study quantitatively and qualitatively identifies distinct patterns in the use of transitivity processes across the two corpora. "Creative constructions" are defined as patterns which deviate slightly but noticeably from grammatical, fully licensed structures in English (and are therefore sometimes branded as "wrong"), inviting specific cognitive associations to make sense of them. It is argued that such structures offer a window into the nature of the cognitive manipulation of linguistic innovations and change. Government-funded adult English as a second language (ESL) programs in Anglophone countries increasingly encounter students with histories of trauma, displacement, and structural adversity due to existing and emerging geopolitical conflicts and unsettling sociopolitical realities. These conditions shaping English language teaching (ELT) inevitably influence learners’ cognitive and emotional engagement in language learning, as well as their relationships with teachers and peers. Protecting Graduate Students From Burnout With Self-Compassion And Authenticity, Michael S. Leeman, Joshua J. Castleberry, Anna A. Ellenson, Morgan Wallbrown

Journal of Social, Behavioral, and Health Sciences

This study investigated whether practicing self-compassion and embracing one's authentic self could protect graduate students from burnout. Researchers also empirically examined the mediating effect of authenticity in the relationship between self-compassion and burnout. A total of 318 master's degree students in a helping profession completed surveys assessing their levels of self-compassion, authenticity, and burnout. Results found that graduate students with higher levels of self-compassion and authenticity tended to have lower levels of burnout. Additionally, authenticity mediated the relationship between self-compassion and burnout. The findings suggest that practicing self-compassion and embracing one's authentic self may lead to lower levels of burnout …

Foreign language learning anxiety remains a critical affective variable influencing learners’ performance in English as a foreign language (EFL) classrooms. This study examined the association between translanguaging as a pedagogical strategy and foreign language anxiety among Saudi university students. Adopting a quantitative descriptive-correlational design, data were collected from 200 undergraduate EFL students using a structured questionnaire. While the study design allowed for correlational analysis, the individual participant data required to compute a correlation coefficient between the primary constructs was not provided in the report. In this study, Partial Least Squares Structural Equation Modelling (PLS-SEM) is employed to examine the relationships among employee engagement, inclusive management, creativity, and organizational diversity climate in a Saudi university (University of Tabuk). Based on Social Exchange Theory (SET) and Leader-Member Exchange (LMX) theory, the research offers empirical evidence that inclusive leadership enhances the organisational diversity climate, thereby raising employee engagement and creativity. The study aimed to explore the experiences of intellectual education teachers with behavioural problems among adolescent students with intellectual disabilities within intellectual education programmes. The study adopted a qualitative methodology by conducting interviews with a sample of intellectual education teachers in Riyadh city, analysing the data using thematic analysis following the framework proposed by Braun and Clarke. The results revealed that the most common behavioural problems were aggression, hyperactivity, lethargy, and bullying, with an observed increase in their occurrence in the middle of the school day. The study aimed to investigate the role of digital learning in developing creative thinking skills among gifted middle school students from the perspective of parents. The sample included 200 parents, with a mean age of (36.42) years and a standard deviation of (5.52). The study adopted a mixed-methods approach, using both a questionnaire and semi-structured interviews. The results indicated that digital learning contributes positively to the development of creative thinking skills. This study aims to identify knowledge that teachers of students Autism Spectrum Disorder (ASD) have regarding (AI) and to what extent these teachers use it in their educational practices. The study aimed to identify effective leadership styles that enhance school happiness among male and female teachers in general education schools in Hafr Al-Batin Governorate, adopting a qualitative approach based on grounded theory. Data were collected through semi-structured interviews with a purposive sample of 45 teachers, ensuring diversity in educational stage and years of experience, during the first semester of the academic year 1447/2025. This essay explores the figure of the tragic mulatta in Lydia Maria Child’s The Quadroons and Dion Boucicault’s The Octoroon, analyzing how mixed-race female characters critique the racial and gender hierarchies of 19th-century America. Using an intersectional lens, it examines how race, gender, and class shape the identities and tragic fates of Xarifa and Zoe—women who were socially excluded from both Black and White communities. This qualitative study examines religious trauma experiences among Santri in a modern Indonesian pesantren, focusing on how teachers weaponize Qur'anic verses and hadiths as tools of symbolic violence. Data were collected through semi structured interviews with five Santri and alumni from Bumi Shalawat Islamic Boarding School, a pseudonym. Findings reveal that selective quotation, decontextualization, and threat based hermeneutics, which I term scriptural violence, are systematically used to enforce conformity, suppress doubt, and induce shame. This scriptural violence operates through three mechanisms. Theological gaslighting denies Santri's interpretive agency. Eschatological blackmail threatens divine punishment. A study was carried out to examine the economic performance of small-scale vegetable farmers and how effectively they are using their resources in Ido Local Government Area of Oyo State. The study involved eighty vegetable farmers who were chosen randomly, and information was gathered from them using structured questionnaires. Different tools such as budget analysis, linear regression, frequency distribution, percentages, and the stochastic frontier production function were used to examine the data that was collected.
