Judicial Review As An Instrument Of Natural Rights Theory: An Intellectual History, James M. Masnov
Judicial Review As An Instrument Of Natural Rights Theory: An Intellectual History, James M. Masnov
Dissertations and Theses
The unique and antidemocratic power of judicial review by the United States Supreme Court is not a bug, but a feature. Its role was critical in establishing and affirming a separation of powers horizontally among the federal branches as well as vertically between the federal government and the individual states. More than this, the Court's power of judicial review acts as an instrument of rights theory and is informed by a rich and rarely-discussed intellectual history. Though judicial review as a mode of constitutional law and the legal history surrounding it has been discussed by various legal scholars, political scientists, …

Waive It Away: Systemic Injustices Against Black And Brown Faculty And Staff Professionals, Past And Present, Marquis B. Holley
USF Tampa Graduate Theses and Dissertations
This study investigates perceptions and experiences of systemic injustices/racism, which is reflected in policy misuse and/or abuse at a large Research One (R1) university located in the Southeastern United States. In particular, the study will provide a lens for viewing the shortcomings regarding hiring practices, with the misuse of the Waiver of Advertisement, which was an initiative aimed at addressing the underrepresentation of Black and Brown professionals in faculty and staff/administrative positions. It is critical to note that the assumption of this project is that white faculty and staff/administrators are the beneficiaries of the waiver. The study will assess this …

A Comparative Thematic Analysis Of Newspaper Articles In France After The Bataclan And In The United States Of America After Pulse, Simon Rousset
USF Tampa Graduate Theses and Dissertations
This project interrogates unequal power relations that underlie newspaper representation of terrorism and reinforced Orientalism discourse following the 13 November 2015 mass murders in Saint-Denis and Paris, France, and following the 12 June 2016 mass shooting in Orlando, Florida, United States of America (U.S.A.). It was not surprising to bear witness to the ways national media took hold of these major socio-political events. These events, and the stories that have been published about them, are interpreted through the prism of terrorism, moral panic, and Orientalism, in the sense that the media tend to transcribe the shock of the attacks as …

The Effects Of A Shared Vision Of Teacher Leadership On Classroom Teachers’ Instruction, Tiffany L. Bockelmann

Narrative Inquiry In Practice: A Study Identifying Themes Of Persistence And Barriers In The Educational Journeys Of American Indian Students In Higher Education, Kristina Cirks
The Interactive Journal of Global Leadership and Learning
Increasing in popularity, the use of narrative inquiry in qualitative research study offers a unique perspective and context in sharing lived experiences. This article utilizes a narrative inquiry study to improve the knowledge of why American Indian students have the lowest college graduation rates in the United States. These narratives helped define the barriers that have discouraged American Indian students from persisting in higher education. Predominantly, participants identified the lack of financial support, lack of cultural competency, emotional distress, time poverty, afraid to ask for help, afraid to succeed, and navigating through the college processes as barriers to their educational …
Aid For Justice? Analyzing The Impact Of Foreign Aid On Recipient Transitional Justice Implementation, Marc S. Polizzi, Jeffrey King
Aid For Justice? Analyzing The Impact Of Foreign Aid On Recipient Transitional Justice Implementation, Marc S. Polizzi, Jeffrey King
Faculty & Staff Research and Creative Activity
Some limited scholarship, focused on the US as donor, links the allocation of foreign aid to the implementation of transitional justice (TJ) mechanisms in post-authoritarian recipient states. However, no scholarship systematically examines the link between aid from the global donor population and the implementation of TJ mechanisms more generally. Further, we know little about how foreign aid influences the types of mechanisms that recipients implement because of aid. According to work on the ‘justice cascade,’ the international community (i.e. donor states) advance criminal accountability of former perpetrators in the transitional process, often at the expense of other transitional goals. In …

Interview data from 30 African American adolescents with overweight and obesity (Mage = 15.30 ± 2.18; MBMI%-ile = 96.7 ± 3.90) were transcribed and coded for themes using inductive and deductive approaches by two independent coders. Inter-rater reliability was acceptable (r = 0.70–0.80) and discrepancies were resolved to 100% agreement. The …

Climate change is increasingly recognized as a threat to global peace and security. This paper intends to provide a better understanding of the nature of interactions between climate change and events that undermine peace through a systematic review of recent literature. It highlights major methodological approaches adopted in the literature, elaborates on the geographic focus of the research at the nexus of climate change and peace, and provides further information on how various climatic stressors, such as extreme temperature, floods, sea-level rise, storms, and water stress may be linked to different events that undermine peace (e.g. civil conflict, crime, intercommunal …

Cognition In Context: Pathways And Compound Risk In A Sample Of Us Non-Hispanic Whites, Jennifer W. Robinette, Jason D. Boardman
Psychology Faculty Articles and Research
The population of individuals with cognitive impairment and dementia is growing rapidly, necessitating etiological investigation. It is clear that individual differences in cognition later in life have both genetic and multi-level environmental correlates. Despite significant recent progress in cellular and molecular research, the exact mechanisms linking genes, brains, and cognition remain elusive. In relation to cognition, it is unlikely that genetic and environmental risk factors function in a vacuum, but rather interact and cluster together. The purpose of the present study was to examine whether aspects of individual socioeconomic status (SES) explain the cognitive genotype-phenotype association, and whether neighborhood SES …

The present study assesses the degree to which temperature affects the crime rates in all 62 counties in the State of New York. Five different crimes (i.e., robbery, aggravated assault, burglary; larceny, and motor vehicle theft) for the year 2019 were selected from the Division of Criminal Justice Services of New York to be examined. The current study examined whether the rate of these crimes was associated with the changes in weather, with the assumption that higher weathers would lead to higher property and violent crimes, when controlling for the effect of various control variables. The findings suggest that the …

One-Way Routes Complicate Cooperation In Migrant Crises, Alessandro Del Ponte, Peter Discioli, Aidas Masiliunas, Noah Lim
Political Science Faculty Articles and Research
How can countries cooperate to shelter migrants? We use experimental economics to study the distinct challenges of cooperation in migrant crises. We designed an economic game, pass the buck, where participants are leaders of countries who decide whether to shelter migrants or pass them to the next country. We examine the difficulties posed by one‑way migration and differences in wealth. We find that leaders sheltered migrants less often when they received them first on a one‑way route, compared to when everyone received migrants at the same time. Moreover, the first leader became more likely to shelter migrants when the last …

Nomadic Pastoralism in the Southern Provinces of Morocco: A Systematic Comparison
The article presents a systematic approach to the subject of nomadic pastoralism, based on its new transformations and problems in the southern provinces of the Kingdom of Morocco.
The researcher conducts field research to clarify the ambiguities -socially and economically- surrounding the subject, especially in the southern desert regions in which nomadic pastoralism is still active, and in which many systems and mechanisms have been developed in line with socio-economic transformations.
