This paper analyses CBN’s Agent Banking policy and its role in promoting financial inclusion through the lens of mechanism design theory. It sought to evaluate how effective the policy has been in bringing together the incentives of key stakeholders—customers, agents, and banks—with the ultimate goals of the Bank’s financial inclusion policy. The scope covers the design and evolution of the policy, the incentives of the different stakeholders, and finding potential information asymmetries, moral hazard, and adverse selection issues. Children’S Perspectives On Playfulness: A Child-Centred Qualitative Study, Risa Rylander, Stephanie Burns, Jocelyn Dautel

International Journal of Playwork Practice

This qualitative study examines children’s lived experiences of play and playfulness through interviews and creative methods with 10 children aged 8–11 in a Playwork setting. Thematic analysis identified three core themes: playfulness as an internal experience; the contextual nature of playfulness; and Playwork theory in practice. Children described play as joyful, immersive, and intrinsically motivated, shaped by factors such as comfort, outdoor access, social relationships, and autonomy. They valued adult support that preserved freedom. Findings challenge narrow definitions of playfulness, emphasizing calm, solitary, and open-ended play, with implications for designing responsive, child-centred play environments.

This study aims to analyze the impact of earnings volatility on the debt financing structure of Iraqi banks, using an analytical descriptive approach and financial data from a sample of private Iraqi banks listed on the Iraq Stock Exchange for the period (2017-2024). A multiple linear regression model was applied to examine the relationship, while controlling key variables (liquidity ratio and bank size). The results revealed a statistically significant negative impact of earnings volatility on the reliance on debt financing, where increased volatility led to reduced dependence on debt in the capital structure. Diversifying modalities or modes of program delivery inside prisons is necessary and important to increase access to programs; however, this also demands that learning is intended to occur in most places of a prison. In this paper I present the concept prison-less places, relational, temporary places where the prison is less noticeable and where learning becomes possible. บทความนี้วิเคราะห์ผลลัพธ์ของนโยบาย “Transforming Rehabilitation” ซึ่งเป็นการปฏิรูปโครงสร้างงานคุมประพฤติในสหราชอาณาจักรโดยให้ภาคเอกชนเข้ามามีส่วนร่วมในการดำเนินงาน ภายใต้ความประสงค์ในการลดอัตราการกระทำผิดซ้ำ เพิ่มประสิทธิภาพในการปฏิบัติงาน และเสริมสร้างนวัตกรรมในการบริหารจัดการผู้กระทำผิด การปฏิรูปนี้ได้มอบหมายหน้าที่โดยให้บริษัทเอกชนที่เป็นผู้รับผิดชอบในการดูแลผู้กระทำผิดที่มีความเสี่ยงต่ำถึงปานกลางผ่านวิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชน (Community Rehabilitation Companies) ในขณะที่หน่วยงานคุมประพฤติแห่งชาติ (National Probation Service) ยังคงรับผิดชอบผู้กระทำผิดที่มีความเสี่ยงสูง การประยุกต์ใช้เครื่องมือทางการเงิน เช่น “ค่าตอบแทนตามการให้บริการ” และ “การจ่ายเงินตามผลลัพธ์” ถูกนำมาใช้เพื่อดึงดูดการลงทุนจากภาคเอกชนและคาดหวังว่าจะเกิดนวัตกรรมด้านเทคโนโลยี จากการศึกษาพบว่าผลการดำเนินงานตามแผนปฏิรูปไม่เป็นไปตามเป้าหมายที่กำหนด ผู้ให้บริการเอกชนไม่สามารถจัดทำบริการเพื่อสนับสนุนการกลับคืนสู่สังคมได้อย่างเพียงพอ ส่งผลให้ผู้กระทำผิดที่ได้รับการแก้ไขฟื้นฟูไม่ได้รับความช่วยเหลือ การให้บริการงานคุมประพฤติขาดความคิดริเริ่มใหม่ และมาตรฐานงานและคุณภาพลดลง ซึ่งสาเหตุหลักเกิดจากการขาดการทดลองนำร่องที่เพียงพอก่อนการขยายผล รวมถึงข้อบกพร่องในกระบวนการประเมินความเสี่ยง ปัญหาทางการเงินทำให้วิสาหกิจเพื่อการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนหลายแห่งล้มละลาย ผลกระทบต่อเสถียรภาพของงานคุมประพฤติและความเชื่อมั่นของประชาชนที่ลดลง จนกลายเป็นปัจจัยให้แนวคิดการลงโทษได้รับความนิยม ขณะที่แนวทางการแก้ไขฟื้นฟูผู้กระทำผิดในชุมชนถูกลดบทบาทลง บทความเสนอแนวทางแก้ไขที่สำคัญ ได้แก่ การจำกัดบทบาทของภาคเอกชนให้เป็นเพียงผู้สนับสนุนงานคุมประพฤติ เสริมสร้างความแข็งแกร่งให้กับหน่วยงานคุมประพฤติแห่งชาติในฐานะผู้ให้บริการในการจัดทำงานคุมประพฤติ และการออกแบบเครื่องมือทางการเงินใหม่ที่สร้างแรงจูงใจและส่งเสริมการมีส่วนร่วมของภาคีเครือข่ายและภาคประชาชน นอกจากนี้ บทความยังเสนอแนะให้มีการนำร่องอย่างเป็นระบบเพื่อให้สามารถประเมินความเสี่ยงได้อย่างแม่นยำ และสร้างกลไกการกำกับดูแลที่มีประสิทธิภาพ เพื่อรักษาคุณภาพบริการและสร้างความเชื่อมั่นต่องานคุมประพฤติอย่างยั่งยืน

ปัญญาประดิษฐ์เข้ามามีบทบาทต่อการดำเนินชีวิตของบุคคลอย่างมาก ทำให้เกิดปัญหาความรับผิดจากความบกพร่องของปัญญาประดิษฐ์ จากคุณสมบัติเฉพาะที่มีความซับซ้อนและความเป็นอิสระจากการควบคุมของมนุษย์ ทำให้การใช้ทฤษฎีความผิดที่มุ่งหาตัวผู้กระทำผิดมารับผิดชอบต่อความบกพร่องของปัญญาประดิษฐ์นั้นไม่เหมาะสมอีกต่อไป เนื่องจากทฤษฎีความผิดมุ่งหาผู้กระทำความผิดโดยเจตนาหรือประมาท โดยมุ่งเน้นที่ตัวบุคคลผู้กระทำผิด ทำให้ผู้เสียหายไม่ได้รับความเป็นธรรม ต้องพิสูจน์ต่อศาลว่ามีการกระทำผิดโดยเจตนาหรือประมาทเกิดขึ้น ทั้งที่โดยคุณสมบัติของปัญญาประดิษฐ์นั้นมีความซับซ้อนทางเทคโนโลยี ผู้เสียหายไม่อาจพิสูจน์ความผิดหรือความเกี่ยวข้องระหว่างเหตุและผลของการกระทำและการตัดสินใจของปัญญาประดิษฐ์ได้โดยง่าย ด้วยเหตุนี้จึงจำเป็นต้องนำทฤษฎีความรับผิดขององค์กรมาใช้ เพื่อให้ผู้ผลิตปัญญาประดิษฐ์รับผิดต่อความบกพร่องของปัญญาประดิษฐ์แม้ไม่มีความผิดเกิดขึ้นก็ตาม โดยเป็นการรับผิดในความบกพร่องชำรุดของปัญญาประดิษฐ์โดยตรง ทั้งนี้ผู้เสียหายจะมีภาระการพิสูจน์เพียงว่าปัญญาประดิษฐ์นั้นมีความชำรุดบกพร่องและก่อให้เกิดความเสียหายต่อผู้เสียหายเท่านั้น ซึ่งหลักทฤษฎีความรับผิดขององค์กรมุ่งเน้นที่การกระจายความเสี่ยงและการคิดต้นทุนการผลิตภายในองค์กร หลักการนี้จะทำให้ผู้ผลิตสามารถคำนวณต้นทุนความเสียหายได้ล่วงหน้าและสามารถกระจายความเสี่ยงไปยังผู้มีส่วนได้เสียหรือผู้บริโภคในตลาด ไม่จำต้องแบกรับภาระของต้นทุนสินค้าและความเสียหายแต่เพียงผู้เดียว ความรับผิดขององค์กรจึงเป็นความรับผิดเด็ดขาดของผู้ผลิต ซึ่งมีความเหมาะสมกับปัญญาประดิษฐ์มากกว่าการใช้ทฤษฎีความผิดแบบดั้งเดิม

เสรีภาพในการบันทึกทัศนียภาพ (freedom of panorama) เป็นหลักการที่ถูกพัฒนาขึ้นในลักษณะของการเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ เพื่อทำให้บุคคลสามารถบันทึกภาพอาคารสิ่งปลูกสร้าง ประติมากรรม หรืองานศิลปกรรมอันมีลิขสิทธิ์ที่ตั้งอยู่ถาวรในที่สาธารณะได้โดยไม่ต้องขออนุญาตจากเจ้าของลิขสิทธิ์ หลักการนี้มุ่งที่จะสร้างสมดุลระหว่างสิทธิของเจ้าของผลงานที่ตั้งอยู่ในที่สาธารณะกับประโยชน์ของสาธารณชนและคุณค่าทางศิลปะในทัศนียภาพ แม้เสรีภาพในการบันทึกทัศนียภาพจะได้รับการยอมรับและบัญญัติเป็นข้อยกเว้นการละเมิดลิขสิทธิ์ในกฎหมายหลายประเทศทั่วโลก แต่กลับไม่มีนิยามและขอบเขตที่แน่ชัดและเป็นหนึ่งเดียวกัน ทั้งนี้การกำหนดขอบเขตของเสรีภาพในการบันทึกทัศนียภาพให้กว้างย่อมเป็นการจำกัดสิทธิของเจ้าของลิขสิทธิ์ แต่การให้ขอบเขตของเสรีภาพในการบันทึกทัศนียภาพที่แคบเกินไปก็จะเป็นการจำกัดเสรีภาพของปัจเจกชนและกระทบต่อประโยชน์สาธารณะ บทความวิจัยนี้นำเสนอที่มา หลักการและแนวคิดที่เกี่ยวข้องกับเสรีภาพในการบันทึกทัศนียภาพ โดยศึกษาวิเคราะห์บทบัญญัติข้อยกเว้นการละเมิดลิขสิทธิ์ที่เกี่ยวกับเสรีภาพในการบันทึกทัศนียภาพตามกฎหมายในต่างประเทศจำนวน 20 ประเทศและบทบัญญัติของประเทศไทย บทความวิจัยนี้เสนอบทวิเคราะห์ในประเด็นการกำหนดขอบเขต การปรับใช้และการตีความบทบัญญัติเพื่อให้สอดคล้องกับหลักคิดพื้นฐานของเสรีภาพในการบันทึกทัศนียภาพและหลักการกำหนดข้อยกเว้นการละเมิดลิขสิทธิ์ โดยคำนึงถึงการถ่วงดุลอย่างเหมาะสมระหว่างสิทธิของเจ้าของลิขสิทธิ์กับคุณค่าของเสรีภาพในการบันทึกทัศนียภาพในประเด็นสำคัญ 5 ประการ ได้แก่ การกำหนดประเภทของงานอันมีลิขสิทธิ์ที่อยู่ภายใต้ข้อยกเว้นการละเมิดลิขสิทธิ์ ลักษณะการตั้งอยู่ของงานนั้น ลักษณะการกระทำที่อนุญาตให้กระทำต่องานเหล่านั้น ขอบเขตการนำงานไปใช้ในทางพาณิชย์ และการกำหนดเงื่อนไขอื่นเพิ่มเติม

งานวิจัยนี้มีวัตถุประสงค์เพื่อ (1) ศึกษาความเป็นมา แนวคิด และทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการของประเทศไทย โดยเปรียบเทียบกับหลักการในอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 (อนุสัญญานิวยอร์ก) กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ (2) ศึกษาและเปรียบเทียบกระบวนการอนุญาโตตุลาการของประเทศไทยกับแนวปฏิบัติสากล (3) วิเคราะห์ปัญหาในการบังคับใช้พระราชบัญญัติอนุญาโตตุลาการ พ.ศ. 2545 ที่เป็นอุปสรรคต่อประสิทธิภาพและความน่าเชื่อถือของกระบวนการอนุญาโตตุลาการในประเทศไทย และ (4) เสนอแนะแนวทางปรับปรุงกฎหมายให้เหมาะสมและทันสมัยยิ่งขึ้น งานวิจัยนี้เป็นการวิจัยเชิงคุณภาพ โดยใช้วิธีการศึกษาค้นคว้าเอกสารจากอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ กฎหมายว่าด้วยการอนุญาโตตุลาการของสหราชอาณาจักร และกฎหมายว่าด้วยการอนุญาโตตุลาการของสาธารณรัฐสิงคโปร์ ตลอดจนตำรา บทความวิชาการ คำพิพากษา งานวิจัย และวิทยานิพนธ์ทั้งภาษาไทยและต่างประเทศ โดยมุ่งวิเคราะห์เปรียบเทียบประเด็นสำคัญเพื่อเสนอข้อเสนอแนะในการพัฒนากฎหมายไทย ผลการวิจัยพบว่า (1) แนวคิดและทฤษฎีที่เกี่ยวข้องกับกระบวนการอนุญาโตตุลาการ เช่น ทฤษฎีอำนาจรัฐ ทฤษฎีสัญญา และทฤษฎีความเป็นเอกเทศ รวมถึงหลักความเป็นอิสระของคู่กรณีและหลักพันธกรณีตามสัญญา ยังไม่ถูกประยุกต์ใช้อย่างเหมาะสมในประเทศไทย ทำให้กระบวนการอนุญาโตตุลาการขาดความยืดหยุ่น (2) ข้อพิพาทที่ไม่อาจเข้าสู่กระบวนการอนุญาโตตุลาการตามมาตรา 40 วรรคสอง (2) (ก) ยังไม่มีการบัญญัติให้ชัดเจน ส่งผลให้เกิดความไม่แน่นอนในการตีความ (3) หลักเกณฑ์การเพิกถอนคำชี้ขาดที่ขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชนตามมาตรา 40 วรรคสอง (2) (ข) ยังขาดแนวทางการตีความที่แน่นอน และเปิดช่องให้ใช้ดุลพินิจเกินจำเป็น (4) มาตรการคุ้มครองชั่วคราวตามมาตรา 16 ยังไม่มีประสิทธิภาพเพียงพอ เนื่องจากต้องอาศัยข้อตกลงของคู่กรณีและขาดกลไกรองรับจากศาล และ (5) เมื่อเปรียบเทียบกับกฎหมายของประเทศที่มีกระบวนการอนุญาโตตุลาการที่พัฒนาแล้ว เช่น สหราชอาณาจักร สาธารณรัฐสิงคโปร์ รวมถึงอนุสัญญาว่าด้วยการยอมรับและการบังคับตามคำชี้ขาดของอนุญาโตตุลาการต่างประเทศ ค.ศ. 1958 กฎหมายแม่แบบว่าด้วยการอนุญาโตตุลาการพาณิชย์ระหว่างประเทศของคณะกรรมาธิการกฎหมายการค้าระหว่างประเทศแห่งสหประชาชาติ พบว่า ประเทศเหล่านี้มีแนวทางที่ส่งเสริมกระบวนการอย่างมีประสิทธิภาพ ทั้งในด้านบทบาทของศาล การตีความนโยบายสาธารณะ และการบังคับใช้มาตรการคุ้มครองชั่วคราว ซึ่งประเทศไทยควรนำมาเป็นแนวทาง โดยเฉพาะการกำหนดข้อยกเว้นของข้อพิพาทให้ชัดเจน การจำกัดขอบเขตของความสงบเรียบร้อยตามหลักนิติธรรม และการส่งเสริมบทบาทของศาลในการสนับสนุนมาตรการคุ้มครองชั่วคราว เพื่อยกระดับกระบวนการอนุญาโตตุลาการของไทยให้สอดคล้องกับมาตรฐานสากล

This study aims to shed light on the reality of government investment spending in Iraq by analyzing its indicators and estimating the government investment spending index and its impact on economic growth for the period 2004-2024, based on theoretical and applied frameworks. The study concluded that the contribution of investment spending to GDP was determined to be between (5.7%) and (69.6%), with an average rate of (17.75%), indicating government involvement in socio-economic fields. There is no financial approach worldwide that reduces the scope of public spending in favor of investment spending in a way that leads to increased economic growth.

Multi-modal transportation systems are the logistics networks for global economy. Transportation systems are fraught with uncertainties that hinder the traditional deterministic models reaching the optimal performance. สิทธิและเสรีภาพของพระภิกษุในระบบกฎหมายไทยถูกจำกัดหลายประการด้วยกัน ในรัฐธรรมนูญแห่งราชอาณาจักรไทยทุกฉบับที่ผ่านมามีบทบัญญัติว่าพระภิกษุเป็นผู้ไม่มีสิทธิเลือกตั้งมาโดยตลอด ทำให้พระภิกษุไม่มีสิทธิประเภทอื่น ๆ ตามมา เช่น สิทธิในการลงประชามติ สิทธิในการเข้าชื่อเสนอร่างกฎหมายหรือแก้กฎหมาย ไม่เพียงเท่านี้ ยังมีพระราชบัญญัติคณะสงฆ์ พ.ศ. 2505 มาตรา 29 กำหนดให้เจ้าหน้าที่ราชอาณาจักร คือ พนักงานสอบสวนมีอำนาจสละสมณเพศพระภิกษุผู้ถูกกล่าวหาในคดีอาญาได้ และกำหนด ให้องค์กรคณะสงฆ์ คือ “มหาเถรสมาคม” ออกกฎ คำสั่ง มติ ระเบียบต่าง ๆ มาบังคับใช้กับพระภิกษุ ทำให้เกิดการจำกัดสิทธิภายในคณะสงฆ์มากขึ้นเรื่อย ๆ ปรากฏว่ากฎหมายเหล่านั้นบางฉบับไม่สอดคล้องกับหลักสากลว่าด้วยสิทธิมนุษยชน บางฉบับไม่สอดคล้องกับหลักการการจำกัดสิทธิและเสรีภาพตามรัฐธรรมนูญ และบางฉบับไม่สอดคล้องกับหลักพระธรรมวินัยของสงฆ์ บทความนี้จึงมุ่งพิจารณาว่ากฎหมายที่ตราขึ้นมาเพื่อจำกัดสิทธิและเสรีภาพนั้นเป็นไปสอดคล้องตามหลักสิทธิมนุษยชน รัฐธรรมนูญ กฎหมายบ้านเมือง และหลักพระธรรมวินัย มีผลสัมพันธ์กันหรือไม่ และได้ศึกษาเปรียบเทียบกับพระภิกษุในประเทศพม่า และประเทศศรีลังกา ซึ่งเป็นพุทธศาสนาเถรวาทเช่นเดียวกับพระภิกษุในประเทศไทย เพื่อแก้ไขกฎหมายให้เหมาะสมกับพระภิกษุในสังคมไทยต่อไป

This environmental history of the North Portland Peninsula is a critical case study of a landscape in transition, where new "natures" have been constructed through shifting projects of reclamation and restoration. The Port of Portland, who controlled the Peninsula, transformed the marshy bottomlands near the confluence of the Columbia and Willamette Rivers to accommodate greater networks of industrial infrastructure and expand their capacity for global trade.
