How are some civil society organizations (CSOs) able to pivot and innovate in the face of political hostility and funding withdrawal, while others shrink or become inactive? It posits that it’s not just the external environment, funding, or degree of political pressure, but attributes intrinsic to each CSO that narrows the range of possible responses. It is based on sample of CSOs in Czechia, Hungary and Bulgaria that faced political pressures and funding withdrawal between 2010 and 2019. It seems natural to adopt a historical approach when it comes to property titles: When property titles have a clean history, they are to be respected as a matter of justice; when they do not have a clean history, for example, in cases of prior theft, they must be returned to the original owners or their descendants. Climate Justice Across Borders: Responding To Ecocide And Displacement, Camila Micheletti Flores

This policy paper examines how climate change accelerates cross-border displacement, especially in regions most vulnerable to ecocide and environmental degradation. Climate refugees remain unprotected under international law, as the 1951 Refugee Convention excludes environmental grounds for asylum, leaving populations exposed to human rights violations and securitized responses. It analyzes legal and institutional gaps, highlighting failures in global climate governance and the disproportionate risks faced by SIDS and other affected regions. The paper calls for COP30 to mandate a high-level UNFCCC forum on climate displacement and ecocide to build a just, cooperative, and rights-based international framework.

Despite global recognition of Indigenous people participation , existing frameworks under the UNFCCC and mechanisms often lack enforceable safeguards to protect Indigenous sovereignty. The Inaccessibility Of Nonprofit Organizations Data In Sub-Saharan Africa, Barnabas Suva, Robert Bhero

This article presents initial findings from a research study on nonprofit data across countries, focusing on the accessibility of nonprofit organizations in 49 countries in Sub-Saharan Africa, following thorough research of accessibility data from nonprofit organizations, regulatory bodies, and nonprofit websites. Only 12% of countries maintain a functional public nonprofit organization database, and even fewer provide detailed, searchable registries. While 94% of countries legally grant nonprofit organizations tax exemption, mandatory reporting obligations are often not paired with public access, thereby weakening accountability. This paper explores how transparency influences trust and strengthens partnerships within nonprofit and international development organizations. Drawing from a structured literature review of peer-reviewed articles, doctoral dissertations, and global initiatives such as the International Aid Transparency Initiative (IATI), this article highlights the critical role of transparent communication in building stakeholder confidence. The findings indicate that while many NGOs collect performance and financial data, few use it consistently to inform external reporting or internal learning. Trust is found to be highly context-specific, shaped not only by data sharing but also by leadership humility, community engagement, and ethical governance. The study …

งานวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาความรับผิดทางแพ่งของบริษัทแม่ต่อผู้เสียหายที่ได้รับผลกระทบจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก โดยเป็นการศึกษาวิจัยเอกสารจากบทบัญญัติกฎหมาย คำพิพากษาศาล หนังสือตำรา และบทความเชิงวิชาการที่เกี่ยวข้อง ทั้งในประเทศและต่างประเทศ ผลการศึกษาพบว่า ปัจจุบันพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. 2535 ยังไม่มีบทบัญญัติให้บริษัทแม่เข้ามารับผิดชอบในความเสียหายจากพื้นที่ปนเปื้อนสารอันตรายของบริษัทลูก หากบริษัทแม่มีส่วนร่วมในแหล่งกำเนิดมลพิษหรือกำกับดูแลบริษัทลูก แต่ขาดการยึดถือแหล่งกำเนิดมลพิษทางกายภาพหรือเจตนาเพื่อตนอย่างใดอย่างหนึ่งไป อันไม่ครบองค์ประกอบของการเป็นผู้ครอบครองที่ต้องรับผิดตามมาตรา 96 หากบริษัทแม่มีการกระทำที่ไม่คำนึงถึงความเป็นนิติบุคคลของบริษัทลูกที่ไม่ใช่การกระทำละเมิด หากแต่เป็นการใช้โครงสร้างความเป็นนิติบุคคลของบริษัทลูกในทางมิชอบ อันได้แก่ การใช้นิติบุคคลเป็นเครื่องมือเพื่อหลบเลี่ยงหรือรับหน้าที่หรือความรับผิด และการมีทรัพย์สินปะปนกัน ดังนั้น จึงสมควรกำหนดบทบัญญัติที่เกี่ยวกับความรับผิดของบริษัทแม่ภายใต้พระราชบัญญัติดังกล่าว เพื่อให้ผู้เสียหายในคดีมลพิษจะได้รับความเป็นธรรมในการเยียวยา

วิธีการทางกฎหมายอันเหมาะสมและบทบัญญัติของกฎหมายที่เพียงพอต่อการลงโทษนิติบุคลคลซึ่งละเลยหน้าที่อันต้องกระทำการหลังการขุดเหมืองแร่นั้นถือเป็นประเด็นในทางกฎหมายที่หลายประเทศทั่วโลกไม่ได้ให้ความสนใจเท่าไรนัก นอกจากการละเว้นหน้าที่ดังกล่าวโดยประมาทจะส่งผลร้ายทั้งทางตรงและทางอ้อมต่อสิ่งแวดล้อมและชุมชน บริเวณรอบพื้นที่แล้ว การกระทำดังกล่าวยังส่งผลเสียต่อตัวนิติบุคคลด้วย ในอินโดนีเซียมีผู้เห็นว่าการบังคับใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวก็สามารถป้องปรามการกระทำดังกล่าวได้อย่างเพียงพอ แต่อย่างไรก็ตาม เมื่อได้ศึกษาเปรียบเทียบกฎหมายของอินโดนีเซียกับประเทศไทยและแอฟริกาใต้แล้ว พบว่ามีการใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครอง ดังนั้น กรณีดังกล่าวจึงนำมาสู่ปัญหาของงานวิจัยฉบับนี้ว่า การบังคับใช้มาตรการทางอาญาควบคู่ไปกับมาตรการบังคับทางปกครองต่อความผิดฐานละเลยหน้าที่ที่พึงต้องกระทำหลังการขุดเหมืองแร่โดยประมาทจะมีผลสัมฤทธิ์มากกว่าการใช้มาตรการบังคับทางปกครองเพียงอย่างเดียวหรือไม่ และการใช้โทษทางอาญาในความผิดฐานดังกล่าวนั้นขัดต่อหลักความได้สัดส่วนและหลักการกำหนดความผิดในทางอาญาหรือไม่ บทความวิจัยนี้จึงมุ่งศึกษาปัญหาดังกล่าวโดยเน้นการวิเคราะห์หลักเกณฑ์ทางทฤษฎีที่เกี่ยวข้อง และเปรียบเทียบกฎหมายของประเทศไทยและแอฟริกาใต้

บทความวิจัยนี้ศึกษาพัฒนาการของการตีความมาตรา XXI(b) ขององค์การการค้าโลก (WTO) เกี่ยวกับข้อยกเว้นด้านความมั่นคง ตั้งแต่ยุค GATT จนถึงปัจจุบัน โดยวิเคราะห์แนวปฏิบัติและคำวินิจฉัยในการยกอ้างข้อยกเว้นนี้ ผลการศึกษาพบว่า ในยุค GATT และ WTO ตอนต้น การตีความมาตรา XXI ยังขาดความชัดเจน โดยมีการอ้างอิงข้อยกเว้นนี้น้อยมาก และในกรณีที่มีการอ้างอิง ส่วนใหญ่มักยุติด้วยการเจรจา ตกลงกันโดยไม่ผ่านกระบวนการวินิจฉัยที่จะก่อให้เกิดบรรทัดฐานหรือแนวปฏิบัติ อย่างไรก็ตาม นับตั้งแต่ยุคสงครามการค้า การอ้างอิงข้อยกเว้นนี้ตามมาตรา XXI(b) ได้แพร่หลายมากขึ้น และคณะกรรมการวินิจฉัยข้อพิพาทแห่ง WTO ได้แสดงแนวโน้มที่ชัดเจนยิ่งขึ้นในหลายประเด็น เช่น การให้รัฐใช้ดุลพินิจในส่วนของบทนำและเป็นอำนาจพิจารณาของคณะกรรมการวินิจฉัยข้อพิพาทในบทเฉพาะ การแบ่งองค์ประกอบของบทบัญญัติและการตีความ “ผลประโยชน์สำคัญในด้านความมั่นคง” แต่ยังคงมีประเด็นที่ไม่ชัดเจน โดยเฉพาะในเรื่องการตีความ “สถานการณ์ฉุกเฉินในความสัมพันธ์ระหว่างประเทศ” และขอบเขตการใช้ดุลพินิจของรัฐที่จะถูกตรวจสอบโดยคณะกรรมการวินิจฉัยข้อพิพาท

การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาแนวทางการกำกับดูแลบริษัทโฮลดิ้งภายใต้พระราชบัญญัติการแข่งขันทางการค้า พ.ศ. 2560 โดยเปรียบเทียบกับกฎหมายและแนวปฏิบัติของต่างประเทศ เพื่อเสนอแนะแนวทางการปรับปรุงกฎหมายที่เหมาะสมสำหรับประเทศไทย การวิจัยใช้วิธีการศึกษาเชิงเอกสาร โดยวิเคราะห์เปรียบเทียบบทบัญญัติของกฎหมาย แนวปฏิบัติ และคำพิพากษาที่เกี่ยวข้องกับการกำกับดูแลบริษัทโฮลดิ้งตามกฎหมายการแข่งขันทางการค้าของสหรัฐอเมริกา สหภาพยุโรป และสาธารณรัฐเกาหลี ผลการศึกษาพบว่า กฎหมายการแข่งขันทางการค้าของไทยมีข้อจำกัดสำคัญในการกำกับดูแลบริษัทโฮลดิ้ง เนื่องจากนิยาม “ผู้ประกอบธุรกิจ” มีขอบเขตจำกัดเฉพาะผู้ที่ประกอบธุรกิจโดยตรง ทำให้ไม่ครอบคลุมถึงบริษัทโฮลดิ้งที่แม้จะมีอำนาจควบคุมบริษัทในเครือแต่มิได้ประกอบธุรกิจด้วยตนเอง ในขณะที่กฎหมายต่างประเทศมีการตีความอย่างกว้างให้ครอบคลุมถึงบริษัทที่มีอิทธิพลต่อการดำเนินธุรกิจของบริษัทอื่น หรือมีบทบัญญัติเฉพาะในการกำกับดูแลบริษัทโฮลดิ้ง การวิจัยนี้จึงเสนอให้แก้ไขนิยาม “ผู้ประกอบธุรกิจ” ให้ครอบคลุมถึงบริษัทที่มีอำนาจควบคุมหรือมีอิทธิพลอย่างมีนัยสำคัญต่อผู้ประกอบธุรกิจอื่น ปรับปรุงประกาศเกี่ยวกับหลักเกณฑ์การพิจารณาความสัมพันธ์ทางนโยบายหรืออำนาจสั่งการ และออกแนวปฏิบัติที่ชัดเจนในการพิจารณาอำนาจควบคุมและความรับผิดของบริษัทโฮลดิ้ง เพื่อให้การกำกับดูแลมีประสิทธิภาพและสอดคล้องกับมาตรฐานสากล

การควบคุมมิให้กฎหมายขัดรัฐธรรมนูญ ศึกษากรณี กฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย (Constitutional Review: Study Of Conflict Of Laws Rules), Mookkrachang Charani, Awnrumpa Waiyamuk

การวิจัยนี้เป็นงานวิจัยเอกสารซึ่งมีวัตถุประสงค์เพื่อศึกษาประเด็นหลักดังต่อไปนี้ 1) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายสามารถเป็นวัตถุแห่งการควบคุมความชอบด้วยรัฐธรรมนูญของไทยได้หรือไม่ 2) บทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมายซึ่งกำหนดให้ใช้สัญชาติของสามีเป็นจุดเกาะเกี่ยวในความสัมพันธ์ระหว่างคู่สมรสและให้ใช้สัญชาติของบิดาในความสัมพันธ์ระหว่างบิดามารดาและบุตรขัดหรือแย้งกับหลักความเสมอภาคระหว่างเพศตามรัฐธรรมนูญของไทยหรือไม่ จากการศึกษาพบว่า พระราชบัญญัติว่าด้วยการขัดกันแห่งกฎหมาย พุทธศักราช 2481 ไม่ควรอยู่นอกขอบเขตของการควบคุมความชอบด้วยรัฐธรรมนูญ เนื่องจากการเลือกกำหนดจุดเกาะเกี่ยวของแต่ละลักษณะข้อกฎหมายล้วนได้รับอิทธิพลจากข้อความคิดที่ปรากฏอยู่ในกฎหมายแพ่งและระบบคุณค่าของสังคมในขณะที่ตรากฎหมาย นอกจากนี้ ยังไม่เคยปรากฏในคำวินิจฉัยของศาลรัฐธรรมนูญไทยที่เกี่ยวกับหลักความเสมอภาคระหว่างเพศว่า ศาลอาศัยเหตุผลที่ว่าระบบคุณค่าที่อยู่เบื้องหลังบทบัญญัติของกฎหมายขัดต่อหลักความเสมอภาคระหว่างเพศเพื่อวินิจฉัยว่าบทบัญญัติกฎหมายใดขัดต่อหลักการดังกล่าว แต่จะต้องเป็นกรณีซึ่งกฎหมายบัญญัติให้ปฏิบัติแตกต่างกันและส่งผลให้บุคคลเสียไปซึ่งสิทธิบางประการอย่างเป็นรูปธรรมด้วยเหตุแห่งเพศ ดังนั้น ผู้วิจัยเห็นว่าการวินิจฉัยความชอบด้วยรัฐธรรมนูญของบทบัญญัติกฎเกณฑ์ว่าด้วยการขัดกันแห่งกฎหมาย ควรนำระบบคุณค่าที่อยู่เบื้องหลังการบัญญัติกฎหมายมาพิจารณาประกอบด้วย นอกจากนี้ ควรแก้ไขจุดเกาะเกี่ยวในกฎหมายขัดกันของไทยให้เป็นกลางทางเพศโดยให้สามารถรองรับการก่อตั้งครอบครัวในบริบทของความหลากหลายทางเพศ

Objective: Despite growing research on the potential mental health benefits of psychedelics, there has been limited study of these drugs in populations with obsessive-compulsive disorder (OCD) and with Hispanic and Latin American (H/L) ancestry.

Methods: Demographic and clinical assessments were conducted as part of the Latin American Trans-ancestry Initiative for OCD genomics (LATINO) Study in H/L participants with OCD living throughout the Americas. Self-reported data on the prevalence of naturalistic psychedelic use and associated outcomes on OCD symptoms were collected in a subsample of 2,639 adults. Mutual protection societies proliferated in the American Southwest during a period of rapid social change, 1870-1930, coincident with significant changes in the region’s political economy and increased competition for land and water resources. To resist encroachment and protect their natural resources, hispano communities in Colorado and New Mexico organized mutual benefit and protective associations known as mutualistas, with a large number concentrated in the San Luis Valley of Colorado as well as in many rural counties of northcentral New Mexico. The COVID-19 pandemic prompted widespread public health messaging encouraging behaviors such as vaccination, mask-wearing, and staying home when sick. However, persistent exposure to these messages has sometimes produced unintended effects, including message fatigue and psychological reactance. Drawing on psychological reactance theory (PRT) and the integrative model of behavioral prediction (IMBP), this study examines the relationships between message fatigue, psychological reactance, and behavioral intentions toward three COVID-19 preventive behaviors: vaccination, masking, and staying home when sick. A survey of 348 U.S. adults assessed participants' levels of message fatigue, psychological reactance, attitudes, perceived norms, self-efficacy, response efficacy, collective efficacy, and behavioral intentions. …

Background: Electromyographic (EMG) normalization is essential for accurately measuring muscle activity across different populations and tasks. Various methods, including Maxi-mum Voluntary Isometric Contraction (MVIC) and Recurrence Quantification Analysis (RQA), have been employed to improve measurement reliability. However, discrepancies in results across studies necessitate a comprehensive review of normalization techniques.
