Unruly Boards: Abrogating The Separate Duty Of Obedience In Nonprofit Organizations, Andrew Faul And Dr. Muthusami Kumaran

Barry Law Review

This Article examines whether the duty of obedience should remain a separate fiduciary duty in nonprofit governance. While traditionally recognized alongside the duties of care and loyalty, the duty of obedience has become increasingly impractical and largely redundant in modern nonprofit law. The Article argues that obedience is better understood as a foundational principle underlying other fiduciary duties rather than an independent obligation. Ultimately, it advocates for eliminating the duty of obedience as a standalone duty while preserving its role in promoting accountable and mission-driven nonprofit governance.

In today’s sociopolitical climate, popular protest has become a powerful force shaping how organizations are judged and how people decide where to work. This qualitative study took place during a period of heightened sociopolitical activity and public unrest in the United States, when organizational responses to contested issues were especially visible and consequential. This non-experimental quantitative dissertation examined generational differences among non-management employees in the United States nonprofit sector, where multiple generational cohorts work side by side. The problem addressed is that nonprofit leaders’ limited understanding of how distinct generational experiences shape employees’ work-related attitudes and preferences can contribute to conflict, reduced engagement, and costly turnover in already resource-constrained organizations. Grounded in Mannheim’s generational theory and Becker’s human capital theory, the study conceptualized generational cohorts as groups whose shared formative experiences influence what they value in their work context and how those values translate into human capital that affects organizational outcomes.

This study investigates the impact of meritocracy on equal access to the public sector, focusing on public sector employment and services. While meritocratic principles promote impartiality and fairness in administrative processes, their effectiveness in improving equal accessibility remains understudied and contested. Drawing on the literature linking meritocracy to democratic stability, we argue that strong meritocratic systems enhance equal access to the public sector regardless of social groups and gender by fostering professional stewardship in the bureaucracy and strengthening checks and balances between bureaucrats and politicians. Education is an ever-evolving field, and accounting education is no different. Introductory financial accounting is a required business course at universities that is characterized by high failure rates (Kealey et al., 2005). Evidence suggests that active learning and constructivist approaches improve comprehension of introductory financial accounting concepts as measured by exam performance. All methods studied produced statistically significant positive results on comprehension learning outcomes. This study explores podcasting as a marketing and communication modality within the context of sorority recruitment, specifically examining its impact on Potential New Members’ (PNMs) preparedness, satisfaction, attitudes, and decision-making. Centered around Scrappy’s Sorority Scoop, a four-episode podcast created by the University of Tennessee at Chattanooga 2025-2026 Panhellenic Council, this research investigates how podcast engagement influences the recruitment experience. Using qualitative interviews with eight participants who both joined a Panhellenic chapter and listened to the full podcast series prior to recruitment, the study identifies key themes related to the podcast’s effectiveness. As organizational environments grow increasingly volatile and complex, leaders face a widening gap in the skills hardest to cultivate in adults: creative thinking, systems thinking, and human-centered design thinking. Yet leadership development has prioritized culture over climate, overlooking a more direct lever for change. In 10 years, private-equity firms' share of hospitals has grown from 2-3% to 8%.  Using data from two sources: the Hospital Consumer Assessment of Healthcare Providers and Systems (HCAHPS) patient surveys and the Private Equity Stakeholder Project (PESP), I demonstrate a causal effect of private-equity ownership on patient satisfaction using difference-in-difference methods.

This thesis reads Chase Manhattan's 1959 art program as a reconstitution of ornament. This study presents a discounted cash flow valuation of Ethiopian Airlines Group, a state-owned enterprise in sub-Saharan Africa's largest aviation market. No published academic study has applied rigorous quantitative valuation to the airline within an emerging market framework. This research addresses that gap by constructing a multi scenario DCF model using audited financial data from FY2019/20 through FY2023/24, with projections through FY2029/30. The model incorporates a country risk premium using Damodaran's methodology and accounts for ETB/USD depreciation following Ethiopia's 2024 exchange rate liberalization. Rapport can be defined as a positive relationship between people built through specific actions. Building rapport can benefit organizations by improving performance and increasing work satisfaction. Despite these benefits, research on rapport remains scarce. Curry et al. (2019) completed the most recent rapport study and found that rapport-building led to increased productivity and discretionary effort. The present study replicated and extended Curry et al. As AI has become a dominant theme in both financial markets and public discourse, understanding how investor attention affects behavior has become increasingly important. Herding behavior is measured using the Cross-Sectional Absolute Deviation (CSAD) methodology developed by Chang, Cheng, and Khorana (2000). In this case study, students apply managerial accounting concepts through a business simulation as two friends use a LEGO competition to jumpstart their business. The real-world setting and kinesthetic learning increase engagement in managerial accounting as students create a unique LEGO product, estimate revenue and costs, conduct financial analyses, and prepare a presentation to pitch their business to potential investors. The purpose of this study was to examine how specific programmatic factors influence levels of investment within mentoring relationships in a collegiate leadership mentoring program. Previous research has demonstrated the benefits of mentoring; however, much of this work has relied on self-reported data and has not directly linked program factors to clearly defined mentoring outcomes. This study addresses this gap by examining how relationship duration, meeting consistency, and training and learning predict mentoring investment using observational program data.
