Issues associated with information security are numerous and diverse. As a result, a plethora of graduate programs have been created, covering nearly every aspect of IS security. The authors review the current state of the IS industry presented in the literature, and identify a panel of IS experts in which to explore current job skill needs using a “Developing a Curriculum,” DACUM, process to support curriculum design for two …

Property Or Currency? The Tax Dilemma Behind Bitcoin, Scott A. Wiseman Jan 2016

Property Or Currency? The Tax Dilemma Behind Bitcoin, Scott A. Wiseman

Utah Law Review

At Bitcoin’s peak in November 2013, there were 93,000 global transactions made in a single day. These users purchased everyday items such as personal services, food, and real estate. This alone suggests that Bitcoin is not primarily used as a long-term investment tool, but rather is used as a currency and a vehicle for global transactions. Congress and the IRS should regulate it accordingly. Representative Stockman’s Virtual Currency Reform Act offered an attempt to negate the IRS decision and officially classify Bitcoin and other virtual currencies as currency instead of property. A tax reclassification would alleviate typical users’ many inconveniences …

Startups And Unmet Legal Needs, Alice Armitage, Evan Frondorf, Christopher Williams, Robin Feldman Jan 2016

Startups And Unmet Legal Needs, Alice Armitage, Evan Frondorf, Christopher Williams, Robin Feldman

Utah Law Review

Our survey results demonstrate that startup companies are exposed to a wide variety of legal needs from an early stage: when attorneys associated with the Startup Legal Garage were asked to handle a company’s most pressing legal needs, the average startup received assistance with over three distinct legal matters over the course of a thirteen-week academic semester. These issues often spanned multiple categories. Although matters frequently touched on a variety of topics within companies, strong similarities emerged in the types of issues faced by all startups in our sample. Almost 90% of the legal matters addressed by Startup Legal Garage …

Altering Rules, Cumulative Voting, And Venture Capital, John F. Coyle Jan 2016

Altering Rules, Cumulative Voting, And Venture Capital, John F. Coyle

Utah Law Review

Legal scholars have long debated the proper balance betweenmandatory and default rules in corporate law. One group — the contractarians — maintain that corporatelaw should function as an off-the-rack set of default rules that approximate, as much as possible, the rules that the transacting parties would have agreed to if bargaining were costless. The contractarians are generally skeptical of mandatory rules because they interfere with the ability of the parties to decide for themselves how to organize their economic relationships. Another group of scholars—the anti - contractarians — have argued that corporate law should seek to achieve certain regulatory objectives separate …

The Entrepreneurial Commons: Reframing The Relationship Between Intellectual Property And Entrepreneurship, Michael J. Burstein Jan 2016

The Entrepreneurial Commons: Reframing The Relationship Between Intellectual Property And Entrepreneurship, Michael J. Burstein

Utah Law Review

Reconceptualizing entrepreneurial activity as a knowledge commons leads us to ask a different set of questions than previous studies have, and to utilize a different set of methodological tools. As Part II described, existing approaches to understanding the relationship between IP and entrepreneurship focus on the firm and its reactions to various IP laws. By contrast, to the extent that the exemplar entrepreneurial activities described in Part III can be described as instances of commons governance, the analysis must necessarily be broader. The knowledge commons framework forces us to acknowledge that much of information production and dissemination depends on relationships …

The Interconnections Between Entrepreneurship, Science, And The Patent System, Amy Landers Jan 2016

The Interconnections Between Entrepreneurship, Science, And The Patent System, Amy Landers

Utah Law Review

This Article considers several related points about the recent changes to the patent system and the opportunities for entrepreneurship. The concern about the adverse effect of the recent changes to patent law on innovation may be overstated. As a practicalmatter, the concept that patents are a necessary input to innovation is built on a model that does not account for the complex relationship between this legal system, science, and innovation. Although it can be expected that there may be some adverse impacts from these decisions, this trend opens up the opportunity for entrepreneurship. By releasing more foundational information into the …

Inclusive Crowdfunding, Andrew A. Schwartz Jan 2016

Inclusive Crowdfunding, Andrew A. Schwartz

Utah Law Review

Retail crowdfunding under Title III of the JOBS Act has a fundamental advantage over accredited crowdfunding and intrastate crowdfunding: the value of inclusivity. What that is worth in a given instance may be difficult to calculate, but it is surely more than zero. This is one reason to expect that retail crowdfunding, once it commences, may prove more successful than many commentators anticipate.

Alice Was No Rabbit Hole: Why Software Inventors Should Be Neither Surprised, Nor Alarmed, Sherman Helenese Jan 2016

Alice Was No Rabbit Hole: Why Software Inventors Should Be Neither Surprised, Nor Alarmed, Sherman Helenese

Utah Law Review

Trade secrets offer an alternative to patent - ineligible innovations and to the problems and perils of protecting, defending and enforcing patents. Although there is currently limited trade secret legislation on the national level, nearly all states have adopted, with little substantive variation, the Uniform Trade Secrets Act. Unlike patent - eligibility requirements that precluded software in Gottschalk, Diehr, Alice, and Tenon from patent protection, no trade secret is automatically deemed out of scope. Trade secrets encompass anything of value, so long as it is not generally known and reasonable steps are taken, such as the use …

Strategy/Enterprise Discourse Bounds In Business Talk., Brendan O'Rourke Jan 2016

Strategy/Enterprise Discourse Bounds In Business Talk., Brendan O'Rourke

Articles

Corporate strategy emerged as large non-owner managed firms became economically important (Knights and Morgan, 1991). Strategy became the substitute for the earlier enterprise discourse, which depended on the dominance, in entrepreneurial capitalism, of owner-managed firms. The discourses of strategy and enterprise developed as separate academic areas and as logics of two very different economic domains. From the late 1970s however, large organizations (Kanter, 1983:27) and governments have been urged to be more entrepreneurial (Klein et al., 2010; Osborne and Gaebler, 1993). Meanwhile, small firms were encouraged to be more strategic (Carr, 2000). This article looks at evidence from small …

Young Consumers’ Brand Communications Literacy In A Social Networking Site Context, Margaret-Anne Lawlor, Aine Dunne, Jennifer Rowley

Articles

Purpose - Whilst substantial scholarly attention has been given to children’s understanding of advertising in the context of traditional advertising channels, there is a gap in the literature with regard to children’s commercial awareness in the context of online social networking sites (SNS). This paper seeks to explore the nature and extent of advertising literacy amongst young consumers in the context of their use of SNS, namely Facebook and Bebo.

Design/methodology/approach - A three-stage study was conducted with 12-14 year old girls, using focus group discussions, participant observation and in-depth interviews.

Findings - The study illustrates that the increasingly blurred …

Interactive Learning: Developing An Esimulation Portal Framework, Ayman Tobail, John Crowe, Amr Arisha

Articles

The emerging eLearning paradigm is becoming increasingly used in many academic disciplines. The concept acknowledges learning processes that no longer deploy only traditional teaching methods. It can be argued that today’s third level education students are part of a new virtual era where the blackboard has been replaced by the interactive whiteboard, so more interactive and virtually orientated teaching aids are required to assist in the transition from traditional learning to eLearning. The key objective of this paper is to propose a simulation-based learning framework that integrates web-based simulation and a web content management hierarchy model. Using the highly complex …

Legitimising Expertise: Analysing The Legitimation Strategies Used By Economics Experts In Broadcast Interviews, Joseph K. Fitzgerald, Brendan O'Rourke

Articles

Few would doubt that economists have taken a prominent role as experts on policy issues [Maesse, J. 2015. Economic experts: A discursive political economy of economics. Journal of Multicultural Discourses 10, no.3: 279–305] and some contend that no other social science discipline has gained such prominence [Fourcade, M., E. Ollion, and Y. Algan. 2015. The superiority of economists. Journal of Economic Perspectives 29, no.1: 89–114]. This prominent societal role has long been evident and leans on their perceived objectivity with regard to the economy and policy advice. Yet, the Great Recession of 2008 put past understandings of the economy, and …

The Glass Cage: The Gender Pay Gap And Self-Employment In The United States, Leanna Lawter, Tuvana Rua, Jeanine K. Andreassi Ph.D. Jan 2016

The Glass Cage: The Gender Pay Gap And Self-Employment In The United States, Leanna Lawter, Tuvana Rua, Jeanine K. Andreassi Ph.D.

New England Journal of Entrepreneurship

Self-employment is often viewed as a more desirable work arrangement than working as an employee for a firm. Women are pushed into self-employment due to organizational factors, such as a shrinking workforce or limited job opportunities, while being attracted to self-employment by the many psychological and social benefits (e.g., independence, flexibility, work-life balance, job satisfaction). Despite more women moving into self-employment, this type of employment still has different financial consequences for men and women. This article investigates whether a pay gap exists for self-employed women after controlling for industry, occupation, and hours worked and seeks to quantify the gender wage …

New England Journal of Entrepreneurship

Academic inquiry into entrepreneurial phenomena has had a rich history over several decades and continues to evolve. This editorial draws attention to the classics: seminal articles that make profound contributions to the development of an academic field in entrepreneurship studies. We focus on the formative years of entrepreneurship research, specifically the 1970s and 1980s, to identify classics using a key informant approach that surveys members of the journal editorial board. Each nominated classic is introduced and discussed by an editorial board member, with particular focus on research opportunities that may be pursued going forward. Analyzing classics allows for the recognition …

The Impact Of Increased Cigarette Prices On Cigarette Consumption, Bohyun Yoo Jan 2016

The Impact Of Increased Cigarette Prices On Cigarette Consumption, Bohyun Yoo

MPA/MPP/MPFM Capstone Projects

The objective of this study examines whether the way to raise cigarette prices drastically and discontinuously is effective in reducing cigarette consumption. We use monthly data for cigarette consumption to measure the price elasticity of cigarettes’ demand and adopt real cigarette prices, real individual income, education level, and unemployment rate as independent variables. We consider how consumers adjust their consumption practices in response to the increased prices. After examining the result of regression, we conclude that cigarette real price has a significant association with the reduction in cigarette consumption. If we divide the last twelve years into periods when prices …

Sport Consumer Behavior Research: Improving Our Game, Daniel Funk, Daniel Lock, Adam Karg, Mark Pritchard Jan 2016

Sport Consumer Behavior Research: Improving Our Game, Daniel Funk, Daniel Lock, Adam Karg, Mark Pritchard

All Faculty Scholarship for the College of the Sciences

Sport consumer behavior (SCB) research continues to grow in both popularity and sophistication. A guiding principle in much of this research is that sport consumers seek out sport-related experiences, and the benefits they yield, in order to satisfy needs and wants. This approach has provided new knowledge and insight into sport consumers. One outcome of this focus is that the vast majority of research on sport consumers has centered on psychological characteristics of these sport experiences related to evaluative and affective components. In addition, this research has predominately relied on cross-sectional studies and attitudinal surveys to collect information with less …

Fiscal rules are a tool for disciplining fiscal policy and ensuring the balance in public finances. The article is devoted to the fiscal rules in force in Poland. Fiscal rules may take either the form of numerical rules or procedural rules (also called procedures). Numerical fiscal rules, which are expressed as numerical constraints imposed on chosen fiscal policy aggregates, exerting a long term disciplining impact, are the most widely described and evaluated in the subject literature.
