Corporate Social Responsibility Versus Shareholder Value Maximization: Through The Lens Of Hard And Soft Law, Min Yan
Northwestern Journal of International Law & Business
Even with a significant increase in the number of firms around the world engaging in corporate social responsibility (“CSR”), many people still perceive CSR as a voluntary commitment and shareholder value maximization (“SVM”) as a mandatory requirement. This paper borrows the concept of hard law and soft law in terms of coerciveness and overturns the stereotype that SVM is a hard-law constraint and CSR a soft-law constraint. The paper first demonstrates that directors of the board are not obliged to maximize shareholder value even in the Anglo-American jurisdictions where shareholder primacy culture is more dominant. For the Western world, the challenges of the 21st Century are numerous, from climate change’s effects on food production and coastal cities to underfunded social safety nets to automation’s impact on the middle class. To handle such costly problems, government intervention will be required. Government intervention, however, always comes at a cost to either individuals or corporations. To determine who should bear these costs, scholars and experts should turn to notions of fiscal citizenship – the social contract between the state and private parties through taxation and the provision of goods and services. Perceptions Of Female Veteran Military Sexual Trauma: A Phenomenological Study, Lindsey Fairweather

Military sexual trauma (MST) occurs at devastating rates to service members, by service members, and is widely misunderstood, qualitatively understudied, and reporting may be procedurally biased. The purpose of this study was to phenomenologically explore the lived experiences of female veteran MST survivors with their leadership (chain of command/supervisors) and understand how military culture effects these individuals. A feminist-theory conceptual framework was applied to contextualize hegemonic hypermasculine military culture and the divide and damage it may cause to female service members before MST, when surviving an MST event, and when surviving post-MST fallout.

Vanessa Mayoraz, who relocated from Geneva to Johnson City, Tennessee, spoke with Seed Space's Rachel Bubis about coming to Appalachia with fresh eyes, experimenting with technology and vegetation, and working outside of a major cultural hub in a Question & Answer session for Burnaway.
Mayoraz's work includes site-specific installations to public participatory projects, themes of memory, fragility and the body to unite her work. She defines her practice, the diverse needs of artists, as well as her experience living and working in a small Tennessee city.

Congratulations to BFA Printmaking Alum and former department adjunct faculty member Laken Bridges on her new job as Director of Adult Education at William King Museum of Art. She received her MFA in printmaking from Clemson University and holds a BA in French and a BFA in studio art from ETSU. Though she is trained as a printmaker, Bridges engages in a cross-disciplinary studio practice involving print, drawing, sculpture, books, and writing.

In her thesis Maiden states, "The visual and performing arts are inherently bonded to the art of literature; all additionally lend themselves to the narratives of women and their specific hardships. In response to the Fintech trend, an ongoing debate in the banking industry is how to design the new-generation interbank retail payment and settlement system. We propose a two-stage analytical model that takes into account the value-risk tradeoff in the new payment system design, as well as banks’ participation incentives and adoption timing decisions. We find that, as the system base value increases, banks tend to synchronize their investment and adoption decisions. When the system base value is low and banks are heterogeneous, bank association ownership maximizes social welfare. When both the system base value and bank heterogeneity are moderate, …

This paper explores the history, legality and ethical perspectives of the International Olympic Committee Rule #40 that was put into effect starting with the 2016 Olympic Games. Rule 40 was established to protect official Olympic sponsors from marketing campaign dilution and ambush marketing attempts from non-official brand sponsors. It was designed to prevent over-commercialization of the Olympic brand and to protect official Olympic sponsors’ substantial investment for exclusive marketing rights during the Games. Revisiting Textbook Adoption Decisions: Are Students Finally Ready For E-Books?, Cheryl B. Ward, Diane R. Edmondson

This study re-examines students’ attitudes and preferences to the four primary textbook types (hardback, paperback, loose leaf, and E-book). One hundred eighty-three students currently taking Principles of Marketing from a large public university in the southeastern United States completed the survey. Unlike the 2014 study, where students overwhelming preferred paperback textbooks, even when this textbook is at a higher price than other alternatives, the 2018 study found that the textbook choice depended on if an access code to publisher’s online course materials was required. Abstract
This paper seeks to understand the impact of customer engagement, brand attitude, and brand experience on branded apps recommendation and re-use intentions. Using structural equation modeling we test a causal model to establish the direct and mediated paths between constructs under study. The article examines the dimension of housing deficit in Nigeria, assess government intervention in tackling the problem of house shortages and proffer solutions that can help reduce the deficit considerably. Basic conceptual issues relevant to housing deficit in Nigeria is first discussed. These issues include: housing, housing deficit, urbanisation, and housing policy. This is followed by an examination of the current level of housing deficit in Nigeria which put existing housing stock at 23 per 1000 inhabitant; housing deficit as at December 2018 at 20 million units (15.0 per cent increase); N21 trillion required to finance the deficit.
