This Essay consists of an invitation to participate in conversations about the future of legal education in ways that integrate rather than distinguish several threads of concern and revision that have emerged over the last decade. Conversations about the future of legal education necessarily include conversations about the future of law practice, legal services, and law itself. Some of those start with the somewhat stale questions: What are US law professors doing, what should they be doing, and why? Environmental Justice defines the environment as the spaces where we live, work, and play. The Environmental Justice (EJ) Movement has traditionally used this definition to organize against toxics in communities. However, within EJ work, prisons or policing have often not been centralized or discussed. This means that the approximately 2.2 million people in prison are excluded from the conversation and movement. Additionally, communities and activists are identifying police and prisons as toxics in their communities, but an analysis of policing and prisons is largely missing in EJ scholarship. Surface vegetation at archaeological sites is a resource overlooked in cultural resource management. Drawing upon comparative documentary surveys of site forms and human surveys of 161 archaeologists in 12 U.S. states, this thesis explores why surface vegetation offers archaeological data potential; how archaeological documentation is an artifact of archaeologists, shaped by various subjectivities; and how improvements can be made for vegetal description in cultural inventory site forms. This dissertation project seeks to address the sociological processes, dynamics, and mechanisms inflecting how and why U.S. society reproduces a sexually dimorphic, binary gender structure. The project builds upon the work of sociologists of gender on the doing gender framework, intersectional feminist approaches to identity formation, and hegemonic masculinity and relational theories of gender. In a 2012 article in Social Science and Medicine presenting contemporary concepts in gender theory to the health-oriented readers of the journal, R. W. Connell argues that much public policy on gender and health relies on categorical understandings of gender that are now inadequate. Connell contends …

The value of sharing scientific research data is widely appreciated, but factors that hinder or prompt the reuse of data remain poorly understood. Using the Theory of Reasoned Action, we test the relationship between the beliefs and attitudes of scientists towards data reuse, and their self-reported data reuse behaviour. To do so, we used existing responses to selected questions from a worldwide survey of scientists developed and administered by the DataONE Usability and Assessment Working Group (thus practicing data reuse ourselves). Results show that the perceived efficacy and efficiency of data reuse are strong predictors of reuse behaviour, and that …

Over the last several decades, scholars and commentators from a variety of different fields, expertise, and ideological positions have written on automation technologies and their potential to cause technological unemployment. As a sociological analysis and critical examination of how experts ideologically frame these issues, this thesis demonstrates that ideology plays a crucial role in the revived debate over automation and technological displacement. Weberian ideal types are developed to demonstrate how three major ideological positions—liberal, conservative, and radical—approach and frame the link between automation, technological displacement, and the potential for technological unemployment. Timothy Williamson offers the ordinary practice, the lottery and the Moorean argument for the ‘knowledge account’ that assertion is the only speech-act that is governed by the single ‘knowledge rule’ or norm, that one must know its content. I show that the emptiness of the knowledge account renders mysterious why breaking the knowledge rule should be a source of criticism. I then argue that focussing exclusively on the sincerity of the speech-act of letting one know engenders a category mistake about the nature of constraints on assertion. For Williamson and those in his tradition, assertion alls under purely epistemic norms. …

American Progressivism inaugurated the beginning of the end of American scientific racism. Its critics have been vocal, however. Progressives have been charged with promotion of eugenics, and thus with mainstreaming practices such as compulsory housing segregation, sterilization of those deemed unfit, and exclusion of immigrants on racial grounds. But if the Progressives were such racists, why is it that since the 1930s Afro-Americans and other people of color have consistently supported self-proclaimed progressive political candidates, and typically by very wide margins?

The purpose of this study was to evaluate the benefit of transforming expectancy-based determinants of injunctive and descriptive norms with a value-laden construct across a case series of health behaviors. This case series draws upon three cases (sugar-sweetened beverages, physical activity, and sleep), each evaluating generalized injunctive (ΣIN) and descriptive norms (ΣDN), with corresponding value-expectancy based determinants: injunctive normative belief strength (inbi) and motivation to comply (mtci), and descriptive normative belief strength (dnbi) and identification with referents (iwri). The social production of hegemonic knowledge has historically been legitimized in relation to the sanctioned status of the ‘Human’.[1] Beginning with the American Prison Industrial Complex and what sociologist Beth E. Richie conceptualizes as the “prison nation,” I will show the ‘human’ as a contingent and composite status appearing along a spectrum of Flesh, Body, and ‘Human’ (Flesh-Body-‘Human’) statuses and subjectivity.

With walking as ontological shifter I pursue an alternative to the dominant modernist episteme that offers either/or onto-epistemologies of opposition and their reifying engagements. I propose this type of walking is an intentional turning towards a set of radical positions that, as integrative aesthetic and therapeutic practice, brings multiplicity and synchronicity to experience and being in an expanded sociality. Disrupting, dismantling, and ultimately defeating al-Qaeda based and inspired terrorism is a declared policy of the U.S. Government. Three key strategic objectives have been identified for accomplishing this: attacking al-Qaeda’s terror network, undermining radicalization and recruitment, and hardening homeland defense. The present monograph proposes a distinct "jihad-realist" approach for undermining radicalization and recruitment to al-Qaeda. First, a brief discussion of six means for ending terrorist organizations is provided. Second, the premises of a jihad-realist approach are described. This Letort Paper proposes that actions, policies, and deeds—those of the U.S. Government and al-Qaeda—be leveraged as a means of delegitimizing al-Qaeda terrorist propaganda. Two chief fronts—changing deeds and challenging deeds—is proposed. Changing deeds requires that the United States carefully and systematically examine its own foreign and military policies and their specific consequences for the Arab and Muslim world. A specific branch of Islamic jurisprudence (fiqh al-jihad) regulates the waging of the jihad of the sword (jihad bis saif). In this article, a detailed exposition is presented of the Egyptian Islamic Group’s (IG; Al-Gama’a Al-Islamiyya) use of fiqh al jihad against Al-Qaeda. The present author’s ‘jihad-realist’ approach is first briefly described; the IG’s critique of AQ systematically outlined; and in conclusion, implications are derived for counter-radicalisation strategies.
