Many law school clinics presume a “social justice” mission—that is, representation of the indigent and under-represented about poverty law issues—as the only legitimate goal for clinic clients and matters. This article contends that social justice should not be presumed, but rather should be considered an option—among many—to include in a clinic’s pedagogy. If increased experiential learning opportunities for students are a real objective, and clinics are the pinnacle of those opportunities, then broadening the portfolio of clinical offerings to include those that are not focused on social justice should be a valid proposition. If the definition of eliminating of a health disparity were signified by the absence of any differences in incidence or mortality between a population’s experiences with a health problem, then the only health disparity that has ever been eliminated is smallpox because with zero cases of smallpox in the world, no health disparities exist because of smallpox. The eradication of smallpox is perhaps the only historical example where the elimination of a health disparity has been achieved. The Institute of Medicine identified access to healthcare and race-based discrimination as important barriers to quality healthcare that contributes to health disparities. This study (1) describes African-American veterans’ perceptions of healthcare services and perceived discrimination in healthcare and (2) investigates the relationship between perceived discrimination and patient perceptions of care, satisfaction with healthcare, and health status. A convenience sample of 141 African-American veterans in Boston completed surveys from May to June 2006.

Respondents reported an average of 16 lifetime experiences of discrimination and over half recalled a situation when they experienced discrimination in healthcare. Modest ratings of perceived quality of …

Context: Asthma is a chronic respiratory illness that is increasing in prevalence among children in the United States. A limited number of studies have examined the relationship between rurality and the prevalence of asthma in minority children, and those studies found mixed results. The aim of this study is to examine urban/rural locality and its impact on asthma episodes and preventable emergency department visits, and to provide quantitative evidence concerning the relationship between patient characteristics and geographic location. Latino Shelter Poverty In Massachusetts, Michael E. Stone

There were about 121,000 Latino-headed households in Massachusetts in 2000 – nearly 5% of all households, an increase from 3.5% in 1990. The median annual income for Latino-headed households was $27,400 in 2000. About one-third of Latino households had annual incomes of less than $15,000; one-third had between $15,000 and 40,000; and one-third had incomes of $40,000 or more. The median Latino household size was 3 persons. 78% of Latino-headed households rented housing, and only 22% were homeowners.

This research challenges William Julius Wilson's (1980) postulation that social class has superseded race in predicting economic outcomes among African Americans. Among the evidence Wilson used to support his claim was the strong position of black degree holders, particularly women. Shortly after the publication of The Declining Significance of Race, however, the United States experienced a severe recession and slow recovery, contributing to a marked growth in the black-white wage gap among women. Young black women were particularly hard hit. Over the 1980s, their cumulative work experience became increasingly correlated with educational attainment, leading to an absolute loss in experience …

With this update to the original groundbreaking study of Massachusetts Immigrants by the Numbers in 2009, we continue to focus on the economic and social contributions that immigrants have made in building the vibrant Massachusetts economy. It shows that, despite heightened public debate, the demographic characteristics and economic trends of the state’s immigrant population have remained largely unchanged. Immigrants continue to have a positive impact on the Commonwealth.

In this Article, we demonstrate, contrary to conventional wisdom, that all rights are relationally contingent. Our main thesis is that rights afford their holders meaningful protection only against challengers who face higher litigation costs than the rightholder. Contrariwise, challengers who can litigate more cheaply than a rightholder can force the rightholder to forfeit the right and thereby render the right ineffective. Consequently, in the real world, rights avail only against certain challengers but not others. This result is robust and pervasive. Furthermore, it obtains irrespectively of how rights and other legal entitlements are defined by the legislator or construed by …

Social hierarchies and inequality in a society are shaped by the modes of production that extract and transfer surplus among social groups. In China under socialism, the redistributive economy established a powerful tributary mode of production (TMP) that extracted surplus from rural areas to cities and from commoner producers to cadre-officials. This TMP created two fundamental hierarchies in socialist China: the urban-rural divide and the official-commoner divide, both of which were based on politically defined statuses. Participatory visual research, or "visual interventions" (Pink 2007) allow environmental anthropologists to respond to three different “crises of representation”: 1) the critique of ethnographic representation presented by postmodern, postcolonial, and feminist anthropologists, 2) the constructivist critique of nature and the environment, and 3) the “environmental justice” critique demanding representation for the environmental concerns of communities of color. Participatory visual research integrates community members in the process of staking out a research agenda, conducting fieldwork and interpreting data, and communicating and applying research findings. I propose to criticize two strands of argument - contractarian and utilitarian – that liberals have put forth in defense of economic coercion, based on the notion of justifiable paternalism. To illustrate my argument, I appeal to the example of forced labor migration, driven by the exigencies of market forces. In particular, I argue that the forced migration of a special subset of unemployed workers lacking other means of subsistence (economic refugees) cannot be redeemed paternalistically as freedom or welfare enhancing in the long run. I further argue that contractarian and utilitarian approaches are normatively incapable of appreciating this fact …

Race And Socioeconomic Status Differences In Study Abroad Participation: The Role Of Habitus, Social Networks, And Cultural Capital, Jennifer Renee Simon, James W. Ainsworth

This study examines how race and socioeconomic status contribute to disparities in study abroad participation. Our mixed methods approach provides a broad overview of the selection process into study abroad using national data. It also provides a nuanced understanding of the mechanisms that perpetuate inequality among Black and lower class students. Both quantitative and qualitative results show that students’ habits, social networks, and cultural capital shape their study abroad experiences. We find that students with a positive predisposition toward internationalization (having foreign-born parents and/or experiencing different cultures overseas) were more likely to study abroad.Whites and high socioeconomic status students were …
