Rules operate as a tool of governance by making generalizations, thereby cutting down on government officials’ need to make individual determinations. But because they are generalizations, rules can result in inefficient or perverse outcomes due to their over- and under-inclusiveness. With the aid of advances in machine-learning algorithms, however, it is becoming increasingly possible to imagine governments shifting away from a predominant reliance on general rules and instead moving toward increased reliance on precise individual determinations—or on “personalized law,” to use the term Omri Ben-Shahar and Ariel Porat use in the title of their 2021 book. The transformation from the Kyoto Protocol to the Paris Agreement has been analyzed by international relations scholars, international law, and transnational governance theory. The international relations literature looks at the climate regime from a perspective of power distribution, state interests, institutions, and multilateral negotiations. International law theory focuses on legal analysis and design of international climate agreements. The transnational governance literature examines the participation of transnational actors at different levels of governance. However, each of these theories overlooks a bilateral trend of cooperation in a multilateral setting that arises as part of the construction or reconstruction of the international regime. …

This study, completed in early February 2022, included focus groups and interviews with 18 government employees and service providers, interviews with 19 people experiencing unsheltered homelessness, a review of research literature and news articles on the topic, and previous surveys and research from Portland State University to better understand gaps and opportunities in providing hygiene, storage and waste management to people living unsheltered.

In the face of market uncertainty, illicit actors on the darkweb mitigate risk by displacing their operations across digital marketplaces. In this study, we reconstruct market networks created by vendor displacement to examine how digital marketplaces are connected on the darkweb and identify the properties that drive vendor flows before and after a law enforcement disruption. Findings show that vendors’ movement across digital marketplaces creates a highly connected ecosystem; nearly all markets are directly or indirectly connected. These network characteristics remain stable following a law enforcement operation; prior vendor flows predict vendor movement before and after the interdiction. The findings …

Local administration in Egypt faces several challenges that hinder fulfilling its responsibilities towards citizens sufficiently. The main challenges are the lack of financial resources due to over-regulation as well as the non-enforcement of laws and regulations that allow the local administration to collect its own tax share, the local administration staff’s lack of skills to manage and develop revenue sources, and lack of accountability mechanisms. This case study brings new attention to a critical but under-appreciated dimension of so-called “smart” cities: how smart city governance builds and relies on institutionalized sharing of data, information, and other forms of knowledge across all sectors of public administration. Those smart city practices are referred to here as knowledge commons and systematized using the Governing Knowledge Commons (GKC) research framework. That framework extends and modifies Ostrom’s research tradition as to community-based resource governance. As with other GKC-focused research, this work relies on a qualitative case study. Criminal capital theory suggests more experienced offenders receive higher returns from crime. Offenders who accrue skills over their criminal career are better able to minimize detection, increase profits, and navigate illegal markets. Yet shifts in the offending landscape to technologically-dependent crimes have led some to suggest that the skills necessary to be successful in conventional crimes no longer apply, meaning ‘traditional’ criminals may be left behind. The recent turn of drug vendors to online markets provides an opportunity to investigate whether ‘street smarts’ translate to success in technologically-dependent crimes. Critics raise alarm bells about governmental use of digital algorithms, charging that they are too complex, inscrutable, and prone to bias. A realistic assessment of digital algorithms, though, must acknowledge that government is already driven by algorithms of arguably greater complexity and potential for abuse: the algorithms implicit in human decision-making. The human brain operates algorithmically through complex neural networks. And when humans make collective decisions, they operate via algorithms too—those reflected in legislative, judicial, and administrative processes. This article explores the links between internet radicalization, access to weapons, and the current threat from terrorists who have been radicalized online. The prevalence of domestic terrorism, domestic hate groups, and online incitement and radicalization have led to considerable focus on the tension between counterterror efforts and the First Amendment. Many scholars recommend rethinking the extent of First Amendment protection, as well as Fourth, Fifth, and Sixth Amendment protections, and some judges appear to be listening. Artificial intelligence, or “AI,” is raising alarm bells. Advocates and scholars propose policies to constrain or even prohibit certain AI uses by governmental entities. These efforts to establish a negative right to be free from AI stem from an understandable motivation to protect the public from arbitrary, biased, or unjust applications of algorithms. This movement to enshrine protective rights follows a familiar pattern of suspicion that has accompanied the introduction of other technologies into governmental processes. The SST Navigator Service was established in 2019 for tribunal users without a professional representative. New advances in digital technology have created new opportunities for subtle and evasive forms of anticompetitive behavior by private firms. But some of these same technological advances could also help antitrust regulators improve their performance in detecting and responding to unlawful private conduct. We foresee that the growing digital complexity of the marketplace will necessitate that antitrust authorities increasingly rely on machine-learning algorithms to oversee market behavior. The purpose of this qualitative participatory action research was to explore how complexity is engaged and experienced in complex regulatory systems, and to understand how cannabis might be regulated in ways that lead to socially equitable conditions. This was accomplished by studying the lived experiences of governmental leaders charged with the responsibility of establishing regulatory frameworks for legalized cannabis where none previously existed. Using the learning history methodology, the study deeply explores the ways that complex systems coexist by capturing the lived experiences of research participants and enhance theoretical understanding of complex regulatory systems. Singapore's juvenile recidivism rate has climbed by around 5% since 2013, putting the country at risk of increased youth crime. With several mandatory rehabilitative programmes classified into two categories, Community-Based Rehabilitation (CBR) and Institutional-Based Rehabilitation (IBR), it is unclear whether the mandatory individual rehabilitative programmes for offenders were actually effective in achieving their corrective goals. This proposal would undertake a regression analysis to compare the effectiveness of CBR and IBR programmes utilizing secondary data gathered by the Ministry of Social and Family Development (MSF) and primary data from a survey. This dissertation is an analysis of the governance structures and functioning of performing arts centers (PACs) in the United States. PACs provide important public services to local communities by exposing the public to arts and culture. There are two research objectives in the analysis. The first objective is to delineate the forms of PAC governance structures. The second objective is to assess how these governance structures affect PACs’ functioning. The dissertation contributes to understanding of management of PACs. Overall, the study identified 187 PACs in the country, with at least one PAC in every state.

Child care is expensive and difficult to find, especially for infants and toddlers. Compared to their higher-income peers, children from lower-income families are less likely to attend out-of-home early childhood care – which tend to be more expensive but provides more stability and is higher quality than home-based care. This contributes to disparities in school readiness and later life outcomes. This brief summarizes findings from a recently published paper examining administrative data from the Commonwealth of Virginia. U.S. policing has long been captured within a master narrative of colorblind consensus; however, distinct lived experiences between community groups depict grave disparities in law enforcement experiences and perceptions. Orthodox conceptions of law enforcement ultimately silence marginalized voices disproportionately affected by negative contacts with law enforcement. Centering data in critical theory, this study will present thematic results from semi-interviews gathered in Ferguson, M.O., during a critical ethnographic research project. Themes reveal experiences and perceptions of racialized and violent policing, the unique position of Black officers, and regard for the impact police have on children.
