Tennessee Code Annotated (TCA) 50-3-2001- 2019, the Hazardous Chemical Right-To-Know Law, became a law in 1985. The stated purpose of the law was to "provide access to information regarding hazardous chemicals to enhance the ability of manufacturing and non-manufacturing workers to minimize hazardous exposure to such chemicals; to provide information to emergency personnel to protect the public health, safety and welfare; and to provide information to citizens to enable them to make informed decisions regarding their safety, health, and welfare." This Technical Bulletin goes over the main points of the law and its implications for cities.

Citizens, Development Interests, And Local Land-Use Regulation, Arnold Fleischmann, Carol A. Pierannunzi

Local governments confer significant benefits and costs on individuals and businesses through their power to regulate private land use. This article analyzes such regulation by using discriminant analysis to test a model of rezoning decision making. The results indicate that the best predictor of a local governing body's decision in a rezoning case is the recommendation of the appointed planning commission. This is contrary to both scholarly and popular expectations that pressure by developers or public protest is the major factor influencing elected officals in rezoning cases. This Technical Bulletin discusses FLSA administrative exemptions. One of the most difficult problems faced by local governments in complying with the Fair Labor Standards Act (FLSA) is in the area of administrative exemptions. Under section 213(a)(1) of the Act, administrative personnel may be exempted from the minimum wage and overtime provisions of the law. The problems exist with what constitutes an administrative exemption.

This Technical Bulletin focuses on specific sections of the Fair Labor Standards Act Amendment: Section 2. Minimum Wage Increase; Section 5. Tip Credit; Section 6. Training Wage; and Section 7. Maximum Hours Exemption for Employees Receiving Remedial Education. President Bush signed legislation (P.L. 101-157) amending the Fair Labor Standards Act (FlSA) and the minimum wage provisions provided by the Act. This represents the first increase in the minimum wage since 1981.

Under the Tennessee Tort Liability Act municipalities are liable for the negligence of their employees, with some exceptions. One of those exceptions is "discretionary functions" (Tennessee Code Annotated (TCA) 29-20-205). However, the act does not define that term. The Tennessee Supreme Court recently grappled with both a definition and application of the term in Gordon, et al. v. City of Henderson, 766 S.W.2d 784 (1988). Although that case involved the delivery of municipal fire services, it contains some language that should cause Tennessee municipalities to look closely at the way they deliver all public safety services.

Commonwealth's Choice: Results From The Massachusetts Public Opinion Survey, Barry Bluestone, Mary Ellen Colten, Thomas Ferguson

From November 11 through December 4, 1989, the Center for Survey Research of the University of Massachusetts at Boston conducted a random digit dial survey of adults aged 18 and over in Massachusetts. A total of 423 individuals were interviewed in a sampling procedure that yielded a 63 percent response rate. In contrast to most media polls, this survey was carried out over a period of four weeks permitting extensive efforts at locating and interviewing difficult-to-reach, reluctant, or less interested respondents. This survey is likely to be more representative of the true population of Massachusetts than most state polls.
