ในการลงทัณฑ์ในประวัติศาสตร์ไทยเป็นการใช้ความรุนแรงของรัฐกระทำต่อมนุษย์ผู้อยู่ในสังคม โดยสังคมย่อมยินยอมให้รัฐลงโทษมนุษย์ที่กระทำความผิด อย่างไรก็ตามการลงโทษทัณฑ์ของรัฐต้องอาศัยความสมเหตุสมผลซึ่งเป็นอำนาจของความรู้อย่างหนึ่งในการสร้างความชอบธรรมในการปกครอง วิทยานิพนธ์ฉบับนี้เป็นการชี้ให้เห็นถึงความสัมพันธ์ของโทษทัณฑ์ในฐานะวาทกรรมอย่างหนึ่งที่เปลี่ยนแปลงตามรูปแบบของรัฐไปพร้อมกับการเปลี่ยนแปลงการให้เหตุผลในการลงโทษในแต่ละสมัย โดยพิจารณาจากการเปลี่ยนผ่านรูปแบบการให้ความสมเหตุสมผลของภาครัฐ และความเห็นจากภาคสังคม ผ่านกรณีศึกษาการลงโทษประหารชีวิต และรูปแบบของเรือนจำ ด้วยวิธีวงศาวิทยาเชิงประวัติศาสตร์ จากปัจจุบันร่วมสมัยจนถึงรัฐสมัยโบราณ ซึ่งทำให้เห็นว่าในมิติทางประวัติศาสตร์การลงโทษเป็นเพียงวาทกรรมที่ปรากฏเด่นชัดในแต่ละยุคสมัย โดยเป็นอิทธิพลของการรับเอาวิธีคิดจากภายนอกเข้ามาปะทะกับความคิดภายในสังคมแบบเดิม และทำให้ความคิดที่เป็นวาทกรรมเกิดการซ้อนทับกันเป็นชั้น โดยต่างเป็นการจับวางในวาทกรรมทัณฑวิทยาทั้งรูปแบบดังต่อไปนี้ (1) การแก้แค้นทดแทนให้สาสม (2) การลงโทษเพื่อการยับยั้งป้องกัน และ (3) การลงโทษเพื่อการบำบัดฟื้นฟู ซึ่งเป็นวิธีการหนึ่งของรัฐไทยในการผดุงความชอบธรรมของความสมเหตุสมผลของการลงโทษในสังคมไว้แบบเดิม วิทยานิพนธ์ฉบับนี้นับเป็นคุณูปการในการพยามนำเสนอการใช้วิธีวงศาวิทยาในการศึกษาการลงทัณฑ์ในประวัติศาสตร์ไทย ตลอดจนเปิดมุมมองที่หลากหลายต่อความสมเหตุสมผลของกรอบคิดของการลงโทษแบบอื่นๆต่อไป

การศึกษาการป้องกันการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์ครั้งนี้มีวัตถุประสงค์เพื่อ 1) ศึกษาสภาพปัญหาการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์ 2) ปัญหาและอุปสรรคในการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ และ 3) เสนอแนะแนวทางการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ เป็นการศึกษาวิจัยเชิงคุณภาพ โดยการสัมภาษณ์เชิงลึก (In-Depth Interview) กับกลุ่มตัวอย่างที่มีส่วนเกี่ยวข้องกับข้อมูลเชิงลึกในการศึกษาวิจัยครั้งนี้คือองค์กรภาครัฐ องค์กรภาคเอกชน อัยการ จำนวน 10 คน ผลการวิจัยพบว่า 1) สภาพปัญหาการตกเป็นเหยื่อคุกคามทางเพศในสื่อสังคมออนไลน์ปัจจุบันมีจำนวนมากขึ้น สาเหตุการคุกคามทางเพศในโลกออนไลน์ เกิดจากหลายสาเหตุทั้งจากตัวของเด็กที่เข้าถึงโซเชียลมีเดียได้ง่าย ครอบครัวของเด็กมีปัญหาในครอบครัวทำให้ต้องพึ่งพาสังคมออนไลน์ สภาพแวดล้อมที่เด็กอยู่ รวมไปถึงเพื่อนของเด็ก และตัวผู้กระทำความผิดมักจะเป็นผู้มีความชำนาญ รูปแบบการคุกคามทางเพศในโลกออนไลน์ มีดังนี้คือ การกลั่นแกล้งทางเพศ การข่มขู่ทางเพศ การลวนลามทางเทศ และ การอนาจารทางเพศ 2) ผลการศึกษาปัญหาและอุปสรรคในการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ พบว่า กฎหมาย บทลงโทษตลอดจนนโยบายของรัฐ เกี่ยวกับการป้องกันการถูกคุกคามทางเพศในโลกออนไลน์ มีความสอดคล้องเหมาะสม แต่การนำผู้ต้องหามาลงโทษมีความยากลำบาก เนื่องจากในโลกออนไลน์ไม่สามารถเก็บพยานหลักฐานได้ครบ ขาดการประสานงานร่วมกันระหว่างหน่วยงานภาครัฐ ภาครัฐกับภาคเอกชน และการได้รับการสนับสนุนจากภาคเอกชนยังไม่เพียงพอทั้งด้านงบประมาณ ด้านข้อมูล และบุคลากรยังไม่เพียงพอ 3) แนวทางการป้องกันการตกเป็นเหยื่อทางเพศของเด็กในโลกออนไลน์ ดังนี้ คือรัฐและหน่วยงานที่เกี่ยวข้อง ควรมีการดำเนินการเชิงรุก โดยใช้สื่อสังคมออนไลน์ เพื่อให้ความรู้ความเข้าใจแก่เด็กและเยาวชน ประชาชน ในการป้องกันการตกเป็นเหยื่อคุกคามทางเพศในโลกออนไลน์ องค์กรเอกชน หรือภาคเอกชน ร่วมเสริมสร้างความตระหนักรู้เกี่ยวกับการป้องกันการตกเป็นเหยื่อคุกคามทางเพศของเด็กในโลกออนไลน์ เพื่อลดความเสี่ยง ควรให้การสนับสนุนทรัพยากรต่าง ๆ ทั้งทางด้านงบประมาณ บุคลากร และข้อมูล เนื่องจากภาครัฐมีทรัพยากรดังกล่าวไม่เพียงพอและ ผู้ปกครองสร้างความรู้ความเข้าใจ เอาใจใส่ดูแลบุตรหลาน ทุกหน่วยงานต้องมีส่วนร่วมป้องกัน แก้ไขปัญหากันอย่างจริงจัง เจ้าหน้าที่รัฐไม่เผยแพร่ข้อมูลเหยื่อสู่สาธารณะ

วิทยานิพนธ์เล่มนี้เป็นการวิจัยเชิงคุณภาพ มีวัตถุประสงค์เพื่อ (1) ตีความเนื้อหาละครโทรทัศน์เกาหลีที่สามารถเปลี่ยนทัศนคติเกี่ยวกับความรุนแรงในทางย้อนแย้งของคู่รักวัยรุ่นไทย โดยศึกษาจากละครโทรทัศน์เกาหลี 3 เรื่อง ได้แก่ Princess Hours, You Who Came from the Stars และ Crash Landing on You และ (2) ศึกษาทัศนคติเกี่ยวกับความรุนแรงของคู่รักวัยรุ่นไทยหลังจากการดูละครโทรทัศน์เกาหลี โดยศึกษาจากการสัมภาษณ์เชิงลึกคู่รักวัยรุ่นชาวไทยเพศชายและเพศหญิงอายุ 18-25 ปีที่รับชมและชื่นชอบละครโทรทัศน์เกาหลี ซึ่งผลการศึกษาพบว่า ละครโทรทัศน์เกาหลีสามารถเปลี่ยนทัศนคติเกี่ยวกับความรุนแรงในทางย้อนแย้งของคู่รักวัยรุ่นไทยในด้านความคิด ความรู้สึก และพฤติกรรม ด้วยการนำเสนอภาพตัวละครนำชายที่มีลักษณะของความเป็นชายแบบใหม่และความเป็นสุภาพบุรุษ รวมถึงการไม่ใช้ความรุนแรงกับคนรัก ซึ่งย้อนแย้งกับความเป็นจริงของสังคมเกาหลีที่เป็นสังคมปิตาธิปไตยและเพศชายมีการใช้ความรุนแรงต่อคู่รักของตน ซึ่งงานวิจัยนี้อาจเป็นแนวทางและความรู้สำหรับหน่วยงานที่เกี่ยวข้องในการสร้างเนื้อหาละครโทรทัศน์ให้สามารถเปลี่ยนทัศนคติเกี่ยวกับความรุนแรงของคู่รักวัยรุ่นไทย เพื่อลดการเรียนรู้และลอกเลียนแบบความรุนแรงจากสื่อ

แนวทางการลงโทษประหารชีวิตในสังคมไทย: กรณีศึกษาอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางสหประชาชาติ, ตุลาการ ขยันขันเกตุ

การศึกษาวิจัย เรื่อง "แนวทางการลงโทษประหารชีวิตในสังคมไทย: ศึกษากรณีอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางสหประชาชาติ" มีวัตถุประสงค์เพื่อศึกษาข้อกำหนดและแนวทางของสหประชาชาติ รวมถึงความสอดคล้องของสภาพสังคมไทยกับการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุด และแนวทางที่เหมาะสมสำหรับสังคมไทยในการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดตามมาตรฐานสหประชาชาติ เป็นการศึกษาวิจัยเชิงคุณภาพ (Qualitative Research) โดยการวิจัยเอกสาร (Documentary Research) และการสัมภาษณ์เชิงลึก (In-depth Interview) จากกลุ่มผู้กำหนดนโยบาย ผู้นำนโยบายมาปฏิบัติ กลุ่มประชาสังคม และกลุ่มนักวิชาการ จำนวน 14 คน ผลการศึกษาพบว่า ข้อกำหนดและแนวทางการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดของสหประชาชาติเป็นมาตรฐานสากลที่พึงปฏิบัติ แม้ว่าในแต่ละประเทศจะมีบริบททางสังคมและวัฒนธรรมที่แตกต่างกัน หากประเทศไทยกำหนดนโยบายการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุดสอดคล้องต่อแนวทางของสหประชาชาติจะส่งผลให้สามารถลดความผิดพลาดในการดำเนินคดีอาญาด้วยการลงโทษผู้บริสุทธิ์ และลดผลกระทบต่อเหยื่อได้ แนวทางที่เหมาะสมในการใช้โทษประหารชีวิตในกรณีคดีอาชญากรรมอุกฉกรรจ์ที่สุดตามแนวทางของสหประชาชาติ คือ การใช้โทษประหารชีวิตเฉพาะในคดีเจตนาฆ่าทำให้ผู้อื่นเสียชีวิต และอาจพักการใช้โทษประหารชีวิตในทางปฏิบัติ อีกทั้งการนำมาตรการแทนการลงโทษประหารชีวิตในฐานความผิดที่มีอัตราโทษสูงถึงขั้นประหารชีวิตที่ไม่สอดคล้องต่อแนวทางของสหประชาชาติ คือ กำหนดโทษจำคุกเพิ่มเข้าไปในบางฐานความผิดที่มีบทลงโทษประหารชีวิตเพียงสถานเดียว, การใช้โทษจำคุกระยะยาวที่มีกำหนดระยะเวลาแน่นอนในการพ้นโทษ, การจำคุกตลอดชีวิตโดยไม่ได้รับการลดโทษ และการนำนักโทษประหารไปใช้ให้เกิดประโยชน์ในด้านต่าง ๆ อันเป็นประโยชน์ต่อสังคม เพื่อการเปลี่ยนแปลงแนวทางการลงโทษประหารชีวิตในคดีอาชญากรรมอุกฉกรรจ์ที่สุด (Most Serious Crime) ที่สอดคล้องกับแนวทางของสหประชาชาติและเหมาะสมกับสังคมไทยในปัจจุบันและอนาคตสืบไป

Tax justice and principles underpinning the international tax regime are in vogue. The idea that companies and individuals need to pay their "fair share", not just in the domestic sense but also the international sense, is now a mainstream position. This paper explores the problems relating to what might constitute a "fair share" by setting out what is meant when this expression is used. A reasonable assumption is to consider taxation as the means by which the state funds public services and in some jurisdictions, contributes to greater equality within society. Critical race feminists call attention to the ways in which multiple and overlapping forms of privilege and discrimination shape individual experiences and perspectives. In this article, we argue that judiciaries cannot be fully inclusive if their composition does not reflect a society’s intersecting sources of disadvantage. We consider intersectional inclusion on high courts from a compar-ative perspective. Most existing practices of representation on high courts promote the inclusion of groups as if they are internally homogenous. We explore the attempts at and successes of promoting intersectional inclusion in the context of the high courts of Canada and South Africa. Although …

The objective of this study was to assess the awareness of rural women on breast cancer and its screening methods in Southwest Nigeria. Descriptive cross-sectional survey design with the aid of a semi-structured questionnaire was used to generate data among 422 rural women in selected communities in Egbeda local government area of Ibadan. The qualitative data was generated through in-depth interviews among rural women and key informant interviews among health workers in the communities. The study revealed that only 63.7% were aware of breast cancer screening methods compared to 31.6% who were not aware of it. The commonly known screening …

Libertarians(like me) generally disagree with orthodox Rawlsians (like Samuel Freeman) about whether Rawlsian principles of distributive justice are compatible with libertarianism.¹In this essay, I set out to explain why. In section 1, I describe the problem, which is essentially that libertarians think the Rawlsian framework does not rule out anti-statist, capitalist, and broadly libertarian approaches to distributive justice and orthodox Rawlsians think that it does. I propose that this problem arises because the Rawlsian framework is underspecified in two ways. Researchers used state-level data on youth justice policies and practices to explore the association between state policy environments and recent changes in the use of residential placements for adjudicated youth (i.e., confinement). The study assigned a score to each of the 50 states based on the extent to which their youth justice policy environments could be considered "progressive" as opposed to punitive or regressive. Using data from the National Center for Juvenile Justice's compendium of justice system characteristics, "Juvenile Justice, Geography, Policy, Practice & Statistics" (JJGPS), the research team created an index that accounts for 16 policies that are more …

Lawyers do not reflect the racial diversity in the United States. The legal profession continues to struggle with ways to achieve and maintain racial diversity. Law schools play a critical role in the path to practice, and therefore an examination of the barriers to the profession they created is warranted. This essay critiques the over-reliance on standardized testing in law school admissions and advocates for an open admissions process that prioritizes racial and academic diversity. It suggests that the benefits of minimizing the role of standardized tests far outweigh any perceived costs in legal education. This essay concludes that the …

The current study adds some of the first light into the initial impacts of the largest global health crisis in a generation on family and domestic violence, the long-term repercussions of which may take decades to unpack. Statewide trends in juvenile arrests for domestic violence (DV)-related offending are examined, taking into account school closures for in-person learning in March 2020 and the subsequent mandate for an in-person learning option in Florida in August 2020. Additionally, trends by sex, race/ethnicity, and severity of the offense are examined. Contrasting with growing studies demonstrating an increase in DV-related arrests among adults, we find …
