This Article connects the failed, inequitable U.S. coronavirus pandemic response to conceptual and structural constraints that have held back U.S health reform for decades and calls for reconstruction. For more than a half-century, a cramped “iron triangle” ethos has constrained health reform conceptually. Reforms aimed to balance individual interests in cost, quality, and access to health care, while marginalizing equity, solidarity, and public health. In the iron triangle era, reforms unquestioningly accommodated four legally and logistically entrenched fixtures — individualism, fiscal fragmentation, privatization, and federalism — that distort and diffuse any reach toward social justice. การศึกษาเรื่อง การศึกษาการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย มีวัตถุประสงค์เพื่อศึกษารูปแบบการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ศึกษาการบังคับใช้กฎหมาย ปัญหาและอุปสรรคที่เกิดจากการบังคับใช้กฎหมาย ตลอดจนแสวงหาข้อเสนอแนะต่อการป้องกันและปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยโดยใช้วิธีการในการดำเนินการวิจัย คือ การวิจัยเชิงคุณภาพด้วยการศึกษาค้นคว้าจากเอกสาร และการสัมภาษณ์เชิงลึกผู้ให้ข้อมูลสำคัญ จำนวน 13 คน ประกอบด้วยพนักงานศุลกากร เจ้าพนักงานตำรวจ พนักงานสอบสวนคดีพิเศษ พนักงานอัยการ เจ้าหน้าที่กรมควบคุมมลพิษ ผู้แทนองค์กรพัฒนาเอกชนด้านสิ่งแวดล้อม และผู้เชี่ยวชาญด้านกฎหมายสิ่งแวดล้อม ผลการศึกษาพบว่า รูปแบบของการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทยที่พบมากที่สุด คือ การนำเข้าเศษพลาสติก ด้วยการขนส่งทางเรือโดยบรรจุของเสียในตู้สินค้า ซึ่งมีประเทศต้นทางที่สำคัญ คือ ประเทศสหรัฐอเมริกา โดยผู้กระทำผิดใช้วิธีการฉ้อฉลทางเอกสารเป็นหลัก และเป็นการกระทำโดยองค์กรอาชญากรรมข้ามชาติ ในขณะที่หน่วยงานบังคับใช้กฎหมายก็เผชิญกับปัญหาและอุปสรรคในการบังคับใช้กฎหมาย อาทิเช่น ปัญหาช่องว่างของกฎหมายในเรื่องหลักเกณฑ์การเปรียบเทียบงดการฟ้องร้องตามกฎหมายศุลกากร เป็นต้น อันนำมาสู่ข้อเสนอแนะเชิงนโยบายในการงดการเปรียบเทียบงดการฟ้องร้องเพื่อดำเนินคดีผู้กระทำผิดในชั้นศาล การนำพระราชบัญญัติป้องกันและปราบปรามการมีส่วนร่วมในองค์กรอาชญากรรมข้ามชาติ พ.ศ. 2556 มาใช้ในการปราบปรามการเคลื่อนย้ายของเสียข้ามแดนอย่างผิดกฎหมายในประเทศไทย ตลอดจนการจัดการกับของเสียที่เป็นของกลางและของตกค้างด้วยการส่งกลับต้นทาง เป็นต้น

การวิจัยนี้ มีวัตถุประสงค์ในการนำเสนอขั้นตอนของกระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย กฎหมายที่เกี่ยวข้อง ตลอดจนปัญหาและอุปสรรค เพื่อนำไปสู่ข้อเสนอเชิงนโยบายในการปรับปรุงกฎหมายและพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐาน โดยเนื้อหาเกี่ยวกับลักษณะเฉพาะของพยานหลักฐานดิจิทัล กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัล ประเด็นปัญหาและอุปสรรคจากผู้ที่เกี่ยวข้อง ข้อเสนอเชิงนโยบายและเชิงปฏิบัติ โดยใช้วิธีการวิจัยเชิงคุณภาพจากเอกสาร การลงพื้นที่สัมภาษณ์เชิงลึกและกรณีศึกษา จากการศึกษาพบว่า กระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทย 4 ขั้นตอน มีปัญหาและอุปสรรค คือ 1) การรวบรวมพยานหลักฐาน มีปัญหาในการรวบรวมพยานหลักฐานให้สมบูรณ์ขณะเกิดเหตุโดยไม่ถูกเปลี่ยนแปลงแก้ไข 2) การเก็บรักษาพยานหลักฐาน ไม่เป็นไปตามมาตรฐานการจัดเก็บ และการจัดการพยานหลักฐานดิจิทัล 3) การวิเคราะห์พยานหลักฐานดิจิทัล บุคลากรบางส่วนขาดความเชี่ยวชาญที่จำเป็นเฉพาะด้าน 4) การนำเสนอผลพิสูจน์พยานหลักฐานดิจิทัล มีการโต้แย้ง หรือขาดน้ำหนักในการรับฟังในชั้นพิจารณาคดี ข้อเสนอแนะจากการศึกษาครั้งนี้ คือ ควรมีการปรับปรุงพัฒนากระบวนการตรวจพิสูจน์พยานหลักฐานดิจิทัลในประเทศไทยให้มีมาตรฐานการปฏิบัติที่ชัดเจนในทั้ง 4 ขั้นตอนให้สอดคล้องกับมาตรฐานสากล บุคลากรควรได้รับการอบรมเพิ่มเติมในประเด็นความเชี่ยวชาญเฉพาะด้าน เพื่อช่วยลดปัญหาและอุปสรรคในการปฏิบัติงาน มีการแก้ไขกฎหมายที่เกี่ยวข้อง รวมถึงสนับสนุนให้มีการจัดตั้งสภาวิชาชีพนิติวิทยาศาสตร์ และจัดตั้งหน่วยงานเฉพาะที่ทำหน้าที่ในการกำกับดูแล โดยเริ่มต้นจากการส่งเสริมบทบาทของศูนย์ดิจิทัลฟอเรนสิกส์ที่มีอยู่เดิม เพื่อให้การป้องกันปราบปรามอาชญากรรมคอมพิวเตอร์ในประเทศไทยมีประสิทธิภาพมากขึ้น การวิจัยนี้ ได้รับการสนับสนุนทุนการศึกษาจากทุนการศึกษาหลักสูตรดุษฎีบัณฑิต “100 ปี จุฬาลงกรณ์มหาวิทยาลัย” (The 100th Anniversary Chulalongkorn University Fund for Doctoral Scholarship) และทุน 90 ปี จุฬาลงกรณ์มหาวิทยาลัย กองทุนรัชดาภิเษกสมโภช [The 90th Anniversary of Chulalongkorn University Fund (Ratchadaphiseksomphot Endowment Fund)]

วิทยานิพนธ์เรื่องสายลับกับการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาถึงความเป็นมาและบทบาทของสายลับในการสืบสวนปราบปรามอาชญากรรมยาเสพติดในประเทศไทย พร้อมทั้งศึกษาความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับในการทำงานปราบปรามยาเสพติด เพื่อวิเคราะห์ผลกระทบที่เกิดขึ้นจากการนำสายลับมาใช้ในการสืบสวนปราบปรามอาชญากรรมยาเสพติด โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญ ประกอบด้วย เจ้าหน้าที่รัฐ สายลับ และบุคลากรในกระบวนการยุติธรรม จำนวนทั้งสิ้น 27 ท่าน ผลการศึกษาพบว่า สายลับเป็นกลวิธีในการหาข่าวที่ปรากฏหลักฐานมาตั้งแต่สมัยบรรพกาล ตราบจนกระทั่งสังคมมีพัฒนาการทางด้านกฎหมายและกระบวนการยุติธรรมทางอาญา วิธีการใช้สายลับจึงได้ถูกนำมาปรับใช้ในการทำงานสืบสวนของเจ้าหน้าที่ตำรวจซึ่งมีภารกิจรักษาความสงบเรียบร้อยภายในรัฐและการควบคุมอาชญากรรม บทบาทที่คาดหวังของสายลับคือ การกระทำใด ๆ ที่ตอบสนองต่อภารกิจการสืบสวนปราบปรามยาเสพติดตามที่เจ้าหน้าที่ต้องการ ซึ่งเป็นงานที่เจ้าหน้าที่ไม่อาจกระทำได้โดยฐานะของเจ้าหน้าที่เองหรืออาจต้องใช้ระยะเวลานาน บทบาทความสำคัญของสายลับส่วนหนึ่งขึ้นอยู่กับมุมมองของเจ้าหน้าที่แต่ละบุคคลซึ่งมีลักษณะเป็นอัตวิสัย รูปแบบของความสัมพันธ์ระหว่างเจ้าหน้าที่สืบสวนกับบุคคลที่เป็นสายลับจะแตกต่างกันไปในแต่ละคู่สัมพันธ์ การใช้สายลับได้ก่อให้เกิดผลกระทบในหลายด้าน เป็นต้นว่า สายลับต้องอยู่ในวัฏจักรของการกระทำความผิดและมีโอกาสกลับไปกระทำความผิดซ้ำ และด้วยลักษณะที่เป็นความลับทำให้การตรวจสอบความโปร่งใสของการทำงานเป็นได้ยากอันส่งผลกระทบต่อสังคมและกระบวนการยุติธรรมทางอาญาหลายประการ แนวทางพัฒนาการสืบสวนโดยวิธีใช้สายลับที่เหมาะสมกับบริบทของประเทศไทยจึงควรแก้ไขเพิ่มเติมกฎหมายวิธีพิจารณาคดียาเสพติด พ.ศ. 2550 หมวด 1 ว่าด้วยการสืบสวน โดยให้ระบุถึงการสืบสวนโดยวิธีใช้สายลับ พัฒนาระบบงานยุติธรรมทางอาญาให้ทุกฝ่ายยึดหลักการค้นหาความจริงในเนื้อหา และสร้างมาตรการกำกับดูแลให้ดียิ่งขึ้น

การศึกษานี้ มีวัตถุประสงค์เพื่อศึกษา ปัญหาการซื้อขายผลิตภัณฑ์ด้านความงามผ่านระบบพาณิชย์อิเล็กทรอนิกส์ในสังคมไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อและการกระทำผิด รวมถึงผลลัพธ์ของการตกเป็นเหยื่อ และแนวทางการป้องกันการตกเป็นเหยื่อ โดยใช้การวิจัยเชิงคุณภาพ (Qualitative Research) ด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มผู้ให้ข้อมูลสำคัญ 4 กลุ่ม จำนวน 19 คน ประกอบด้วย ผู้เสียหาย ผู้กระทำความผิด เจ้าหน้าที่ที่เกี่ยวข้องกับการดำเนินคดีและกำกับดูแล และผู้ทรงคุณวุฒิที่เกี่ยวข้องกับการโฆษณาผลิตภัณฑ์ด้านความงามบนสื่อออนไลน์ และการวิจัยเชิงปริมาณ (Quantitative Research) โดยเก็บข้อมูลจากผู้เสียหายด้วยแบบสอบถามออนไลน์ จำนวน 27 คน ผลการศึกษาพบว่า ปัญหาที่พบ ได้แก่ ด้านกฎหมาย การบังคับใช้กฎหมาย การชดเชยเยียวยา การควบคุมและกำกับดูแลร้านค้าออนไลน์ การควบคุมความปลอดภัยของสินค้ และการโฆษณาบนสื่อออนไลน์ โดยปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อ ได้แก่ ค่านิยมการให้คุณค่าความงาม โอกาสในการตกเป็นเหยื่อ การมีส่วนร่วมของเหยื่อ การพึ่งพาเทคโนโลยีสมัยใหม่และพฤติกรรมของเหยื่อ ทั้งนี้ การพัฒนาแนวทางการป้องกันการตกเป็นเหยื่อในเรื่องนี้ ประกอบด้วย การปรับปรุงอัตราโทษทางกฎหมายเกี่ยวกับเครื่องสำอางให้สอดคล้องกับสถานการณ์ปัจจุบัน การกำกับดูแลเพื่อควบคุมคุณภาพและความปลอดภัยของผลิตภัณฑ์ การบูรณาการความร่วมมือกับหน่วยงานของต่างประเทศในการสืบสวนสอบสวน เป็นต้น

วิทยานิพนธ์เรื่องอาชญากรรมสิ่งแวดล้อม: กรณีศึกษาผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย มีวัตถุประสงค์เพื่อศึกษาสภาพปัญหาและผลกระทบของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทย ศึกษาปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยและเสนอแนะแนวทางและมาตรการในการป้องกันและแก้ไขการลักลอบนําเข้าขยะอิเล็กทรอนิกส์ในประเทศไทยให้สอดคล้องกับอนุสัญญาบาเซล (Basel Convention) โดยเป็นการศึกษาเชิงคุณภาพด้วยการวิจัยเชิงเอกสารและการสัมภาษณ์เชิงลึกจากผู้ให้ข้อมูลสำคัญในหน่วยงานภาครัฐบาลและภาคประชาสังคม จำนวน 10 ราย ผลการศึกษาพบว่า สภาพปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์เริ่มมาจากการที่ประเทศจีนมีประกาศห้ามนำเข้าขยะรีไซเคิลอย่างเด็ดขาดในปี พ.ศ. 2560 และปัญหาการกำจัดขยะอิเล็กทรอนิกส์ที่มีอยู่เดิมของประเทศไทย ทำให้ปริมาณขยะอิเล็กทรอนิกส์ในประเทศไทยมีจำนวนสูงมากขึ้น พบการลักลอบโดยการสำแดงเท็จ การดำเนินการส่วนใหญ่มักยุติที่ชั้นศุลกากรโดยไม่เข้าสู่กระบวนการทางอาญาแม้จะมีกฎหมายระบุไว้ การลักลอบนำเข้าขยะอิเล็กทรอนิกส์จะส่งผลกระทบต่อสิ่งแวดล้อม ระบบนิเวศ สุขภาพ สังคม ชุมชน และเศรษฐกิจของประเทศ สำหรับปัจจัยของการลักลอบนำเข้าขยะอิเล็กทรอนิกส์นั้น มีทั้งหมด 4 ด้าน ได้แก่ ปัจจัยด้านพื้นที่ ปัจจัยด้านการปฏิบัติงานของเจ้าหน้าที่ผู้บังคับใช้กฎหมาย ปัจจัยด้านการบังคับใช้กฎหมาย และปัจจัยด้านความคุ้มค่า ผลการศึกษาแนวทางในการป้องกัน และแก้ไขปัญหาการลักลอบนำเข้าขยะอิเล็กทรอนิกส์มีทั้งหมด 3 ด้าน ได้แก่ ด้านการปฏิบัติงาน และการบูรณาการร่วมกันของหน่วยงานที่เกี่ยวข้อง การปรับปรุงแก้ไขกฎหมาย/นโยบาย/มาตรการ และการบังคับใช้อย่างเคร่งครัด และการสร้างจิตสำนึก และการตระหนักถึงปัญหาสิ่งแวดล้อมให้มากยิ่งขึ้น

การวิจัยเรื่อง การนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้ในศาลเยาวชนและครอบครัว : ศึกษาการพัฒนามาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี มีวัตถุประสงค์เพื่อศึกษาการนำกระบวนการยุติธรรมเชิงสมานฉันท์มาใช้ในกระบวนการยุติธรรมทางอาญาสำหรับเด็กและเยาวชนโดยศาลเยาวชนและครอบครัวผ่านการดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี ที่ได้นำแนวทางการศึกษาการนำนโยบายไปปฏิบัติมาใช้เป็นแนววิเคราะห์ปัญหาและอุปสรรคผ่านปัจจัยที่มีผลต่อความสำเร็จหรือความล้มเหลวจากขั้นตอนการนำไปปฏิบัติ และศึกษาเปรียบเทียบกับกระบวนการของต่างประเทศ นำไปสู่ข้อเสนอแนะแนวทางการพัฒนาการดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี เพื่อให้เกิดการพัฒนาและสามารถแก้ไขปัญหาอุปสรรคที่เกิดขึ้นจากการนำไปปฏิบัติโดยศาลเยาวชนและครอบครัวได้ โดยใช้วิธีการวิจัยเชิงคุณภาพ ด้วยการวิจัยเอกสารที่เกี่ยวข้อง การสังเกต การอภิปรายกลุ่ม และการสัมภาษณ์แบบเจาะลึกจากผู้ให้ข้อมูลสำคัญ ให้ได้ข้อมูลเพื่อนำมาวิเคราะห์แบบอุปนัย สร้างข้อสรุปเพื่อตอบคำถามการวิจัย ผลการวิจัยพบว่า การดำเนินการตามมาตรการพิเศษแทนการดำเนินคดีอาญาชั้นหลังฟ้องคดี เป็นทางเลือกหนึ่งแทนกระบวนการทางตุลาการปกติ ซึ่งประยุกต์มาจากงานยุติธรรมเชิงสมานฉันท์ ที่ผู้กระทำสำนึกผิดเข้าสู่กระบวนการของการมีส่วนร่วมจากทุกฝ่ายผ่านการพูดคุย ให้ได้ผลเชิงสมานฉันท์ที่ผู้เสียหายได้รับการชดเชยเยียวยา และผู้กระทำผิดได้แก้ไขบำบัดฟื้นฟูเพื่อกลับคืนสู่สังคมด้วยดี ซึ่งพบปัญหาและอุปสรรคในการปฏิบัติโดยศาลเยาวชนและครอบครัว 5 ประการ คือ ด้านกฎหมาย ด้านคุณภาพและความพอเพียงของทรัพยากร ด้านลักษณะหน่วยงานผู้ปฏิบัติ ด้านการสื่อสารและควบคุมดูแล และด้านสภาพแวดล้อมหรือบริบท โดยสมควรปรับปรุงกฎหมาย จัดสรรทรัพยากร เพิ่มเติมหน่วยงานในองค์กรของผู้นำนโยบายไปปฏิบัติ และติดตามควบคุมดูแล เพื่อแก้ไขบำบัดฟื้นฟูเยาวชนอย่างสมดุลกับการชดเชยเยียวยาความเสียหายที่เกิดจากอาชญากรรมอย่างเหมาะสมกับบริบทของสังคม

Anti-Black racism is an interruption of contact that often takes place out of awareness, and is continuously enacted through innumerable fixed gestalts at every level of human experience. Gestalt therapy as a movement does not leverage its great potential for undoing fixed gestalts of anti-Black racism, or supporting fluid gestalts of racial liberation; this article explores GT theories and practices that do so. Significant racial and gender differences in school performance have been a great concern in the past decades, and especially the significant differences in education performance between both Black youth and other racial groups and between Black males and Black females. This intersectional project seeks to understand the complex labor, social lives, and community building of online sex workers. Building on the work of foundational sex work researchers, this project utilizes in-depth interviews, a survey, social media posts, and published writing and research from online sex workers to understand how marginalization and identity impacts participation and success in online sex work. This dissertation examines the experiences of five civil rights-era rabbis (William Silverman, Randall Falk, Alfred Goodman, Irving Bloom, and Burton Padoll) to highlight their contributions, leadership approaches, struggles, and achievements with a particular emphasis on social justice. As each of the rabbis drew from their understanding of the richness of the Jewish textual canon, the study includes a survey of Biblical, Talmudic, and contemporary Jewish sources that laid the groundwork for their rabbinic activism and which compel rabbis today. Using Critical Race Theory's storytelling method, this chapter weaves a tale set in a school library setting told through the eyes of Jamal, a 17 year old Black male Harvard -bound scholar athlete. Using artifacts to build the plot, the story shines light on places where diversity and inclusion initiatives fail, where unchecked privilege and whiteness do harm to everyone touched by them, where inequality ruins lives and where libraries might be spaces of hope and possibility.

In Canada, we often speak of caring for others as more than a social obligation; it is part of how we conceptualize ourselves and our humanity. Family/friend relationships can become strained, however, when providing care and support for people with complex and unpredictable chronic episodic illnesses, here termed episodic care. Relational impacts may be understood as influences and impacts directly related to the relationship between the carer and family member/friend. Child welfare workers are faced with suffering on a daily basis. Workers report experiencing empathetic distress (also known as compassion fatigue) and many feel discouraged from showing self-compassion or compassion toward others. However, the literature on compassion suggests that self-compassion and compassion for others builds resiliency, improves job satisfaction and increases engagement. Workers who support themselves with self-compassion may be less likely to experience burnout and more willing to create inclusive and compassionate environments. This research report is the result of collecting and evaluating data on cases of homicides and attempted homicides in the German sex trade from 1920-2017. The findings show violence against prostituted women and the attitudes of the sex buyers who commit most of the violent acts against the women. The report discusses the media coverage of murder cases, complication of cases, and a critique of methods of criminal evaluation by the police. From 1920 to 2017, 272 victims of murder and attempted murder were identified. Liberalization of prostitution occurred in 2002. From then until 2017, there is a decrease in …

India has the highest number of acid attacks globally every year, and despite the actions taken by the Indian Government and the Supreme Court of India, the crime is on the rise. This increase can be attributed to the patriarchal ideology that is prevalent in India and to India’s inadequate legal system, which does not deliver efficient remedies to the victims. This article will discuss the prevalence of acid attacks in India, motives behind the attacks, consequences on victims, and shortcomings in measures adopted to prevent the crime and provide justice to victims.

This autobiographical inquiry will explore my own experiences with physical abuse, sexual abuse, and neglect. Using the method of currere as a lead theory. The four-step process – regressive, progressive, analytical, synthetic – helped me work towards understanding the parts of myself affected by these traumas. Investigation of my own family’s generations of abuse as well as reflecting on these experiences helped me deconstruct my own story as I search for my own meaning and purpose.
