Andrew Hammond, Professor of Law and Harry T. Ice Faculty Fellow at Indiana University Maurer School of Law, has been appointed to the Advisory Committee on Circuit Rules for the U.S. Court of Appeals for the Seventh Circuit.
“I am honored to serve on the Seventh Circuit’s Advisory Committee on Circuit Rules,” Hammond said. “My first job out of law school was clerking for then-Chief Judge Wood of the Seventh Circuit, and my experience working for her and later Judge Dow in the Northern District of Illinois helped shape how I think about federal practice and procedure. Women In Law And The Draft, Thomas Helgerman, Benjamin David Pyle

Between 1964 and 1973, women’s representation in full-time law school programs rose fivefold, from 3.7% to 20.1%. This paper examines whether Vietnam War draft policy contributed to this increase. In 1968, men enrolled in law school lost eligibility for 2-S student deferments, threatening law schools’ tuition revenues and incentivizing schools to admit more women to stabilize enrollment. To test this mechanism, we construct a school-by-year dataset of enrollment counts split by women/men and full-time/part-time status. Using a uniform adoption difference-in-differences design, we find that women’s representation rises by 2 percentage points in full-time programs relative to part-time programs (which were …

Brief For Amici Curiae Immigration Law Scholars In Support Of Petitioner-Appellee, Supporting Affirmance, Lindsay Nash
Amicus Briefs
Amicus curiae brief filed by immigration law scholars, including Cardozo School of Law Professor Lindsay Nash, in Herrera Avila v. Bondi. The brief examines the scope of mandatory immigration detention under the Immigration and Nationality Act and argues that 8 U.S.C. § 1225(b)(2)(A) applies to noncitizens seeking admission at the border rather than individuals apprehended within the interior of the United States.

For decades, constitutional doctrine has recognized that children possess enforceable constitutional rights and that their developmental, physical, and social differences from adults are important considerations in constitutional analysis. Courts may not impute adult capacities, privileges, or political agency to children when determining whether their rights may be vindicated, leaving them no democratic mechanism to alleviate their injuries.
The district court’s dismissal of the youth plaintiffs’ claims rests on precisely that error. Although the court recognized that the children alleged concrete, severe, and escalating harms caused by the challenged executive actions, it concluded that relief must come from the political branches …

Using Westlaw And Lexis: The Many Ways In, Joshua Levine

Researching the law depends on finding connections between information. No case or statute exists in a vacuum. The primary advantage of using Westlaw and Lexis is that they point out, on a high level, the connections between individual resources. It is disappointing how often students use natural language search terms or basic AI queries to find all their answers. Within the limitations of class time, it is essential to teach our students as much as possible how pieces of information are connected on these platforms.

From the Argument
No one doubts the significant public interest in K-12 education. Brown v. Board of Education, 347 U.S. 483, 493 (1954) (“[E]ducation is perhaps the most important function of state and local governments.”). And, for centuries, the critical responsibility for educating young people has been borne in significant part by private schools. Indeed, for many decades, private schools were essentially the only source of childhood education in the United States. It is a role those schools served—and continue to serve—well. While in Utah, as elsewhere, public schools are …

Brief Of Amicus Curiae Gregory Klass In Support Of Respondents In Veolia Water Technologies, Inc. V. Antero Treatment Llc, No. 2025sc21 (Colo. Jan. 20, 2026)., Gregory Klass
Georgetown Law Faculty Publications and Other Works
In September, 2025, the Colorado Supreme Court granted certiorari in Veolia Water Tech. v. Antero Treatment to resolve the following question: “Whether the economic loss rule bars a fraud claim when the parties were in a contractual relationship, the fraud claim seeks the same relief as the plaintiff’s contract claim, and the fraud concerns the defendant’s performance under the contract.”
This scholar’s amicus brief addresses four questions under Colorado law: (1) Does an exploratory contract to determine whether a transaction is desirable prevent liability in tort for fraud in the inducement of the principal contract? (2) What is the significance …

Corporate law’s dynamism precludes bold predictions about its future. Instead, we set out to highlight principles relevant to its trajectory and frame looming, unresolved issues. In that vein, artificial intelligence and other digital technologies raise considerable new opportunities for directors to enhance their oversight and for shareholders to be better informed and make more meaningful use of their governance rights. At the same time, the potential for wide-scale automation of corporate activities via these technologies amplifies corporate power and resulting risks of harm, adding new urgency to past prescriptions for rethinking the relationship between corporate and other areas of law …

Adversarial Comparativism: The Role Of Emotion In United States–China Comparative Law Projects, Matthew S. Erie
Scholarly Articles in Law Reviews & Journals
Contemporary comparative law operates across a landscape riven by protectionism, nationalism, and securitization, all of which complicate comparative law projects. Nowhere is this more evident than in the U.S-China relationship, the most important bilateral relationship in the world. Despite economic “delinking,” the U.S. and Chinese legal systems are interacting more than ever; however, how this interaction works is poorly understood. This Article proposes “adversarial comparativism” to explain this dynamic. It is an approach to comparative law and politics that includes different modalities: competition, aggressiveness, transactionalism, misunderstanding, opportunism, and gaslighting. Many of these are underpinned by emotion. As such, while this …

Ethics Of Artificial Intelligence For Lawyers: I’M Sorry Dave, I’M Afraid I Can’T Do That: Competence, Confidentiality, And Communication, Cliff Mckinney
Arkansas Law Notes
In Stanley Kubrick’s 2001: A Space Odyssey, the spaceship’s onboard computer, HAL, calmly refuses to follow the astronaut’s command with the chilling words, “I’m sorry, Dave, I’m afraid I can’t do that.” HAL’s response has become a cultural shorthand for what happens when human expectations collide with machine limitations. The line endures because it captures the chilling reality that machines may appear capable, but they cannot always be trusted to act in ways humans expect or need.
This installment explores three pillars of Formal Opinion 512: competence, confidentiality, and communication. These pillars focus on what lawyers need to understand about …

Law Schools Should Teach How To Integrate Ai Tools Into Practice, Robert A. Mackenzie, David J. Reiss
Cornell Law Faculty Publications
Now that artificial intelligence tools for lawyers are widely available, we decided to integrate them for a semester in our Entrepreneurship Clinic. We have some important takeaways for legal education in general and the transactional practice of law in particular.
First, employers and educators need to account for law students who already are using AI tools in their legal work and guide new lawyers about how to use such tools appropriately.
Second, different AI products lead to wildly different results. Just demonstrating this to law students is very valuable, as it dispels the notion that AI responses can replace their …

On Monday night, as the Indiana University football team takes the field with a national championship on the line, Stephen Harper ’11 will be where tens of thousands of IU alumni wish they could—on the sidelines of Miami’s Hard Rock Stadium.
For Harper, Indiana’s chief operating officer for athletics, the moment is the culmination of a journey that began far from packed stadiums and playoff spotlights. Before contract negotiations, NIL policy, and Big Ten championship trophies, Harper was a high school English teacher and basketball coach at Bloomington North High School.

Officers On Patrol: Perspectives Of An Arrest On Past And Present Law Enforcement Officers, Shanee N. Ellington
Doctoral Dissertations and Projects
While attempting to apprehend suspects, police officers must contend with complex obstacles arising from the arrest's legal, ethical, and sociopolitical context. Officers had to follow their department’s guidelines while also developing legal procedures when carrying out an arrest. The study focused on how an officer’s perception of arrest decisions and procedures encapsulated challenges and ethical dilemmas. Through a semi-structured interview with twenty respondents, this research explored the implications of arresting behaviors on officers’ professional identity formation and development. The data analysis followed the grounded theory approach, which focused on identifying differences and similarities between former and current officers over time. …

People around the world seek climate risk information to guide their decisions. For instance, projections about future flood risk inform where households choose to live, how lenders manage credit risks, and which communities receive federal funding. Yet data limitations and fundamental validation challenges raise important concerns about the reliability of such projections. The principles of transparency and reusability help address these concerns by enabling scrutiny of assumptions and methods, development of foundational data and tools, and consistent application of evaluation standards. While there is ongoing debate about how much transparency commercial climate risk services should provide, many expect noncommercial actors …

Vigilante Violence, The Rise Of The New Right, And The Persistence Of The Texas Farmworkers, 1975–1980, Brent M. S. Campney, Tim Bowman
History Faculty Publications
This study charts the ineffective vigilante violence perpetrated by growers in the Rio Grande Valley of Texas to suppress farmworker activism from the mid-to-late 1970s and their abrupt shift in tactics with a 1980 strike in Hereford, Texas, toward the adoption of strictly nonviolent and tediously legalistic new methods associated with the neoconservative backlash. It does so in two major sections. In the first, grower violence is chronicled in detail that underscores both its rage and ineffectiveness. The second section shows how the New Right usurped the longstanding usage of physical violence against ethnic Mexicans in Texas, prompting conservatives to …

The National Jurist has named Indiana University Maurer School of Law alumna Kellye Y. Testy ’91 the most influential person in legal education, placing her at the top of its annual list of the 25 most influential leaders in the field.
The ranking is based on a survey of law school deans nationwide. In explaining the methodology, The National Jurist noted that respondents were asked to identify individuals who “sparked new ideas, introduced reforms, inspired their peers, or pushed them to see their work differently.” The resulting list, the publication said, highlights leaders who are “moving the field forward and …

President Donald Trump’s decision to invade Venezuela and oust its president puts a spotlight on a USSupreme Court case that famously blocked President Harry Truman’s seizure of American steel mills. Thecase highlights the tension among presidential aggrandizement, Congress’s war powers, and the (oftensecret) legal opinions undergirding a president’s ambitions
