Climate change disproportionately affects Indigenous Peoples because of strong connections between environmental, cultural, and spiritual well-being. While much of the global discourse surrounding climate change is founded in Western science, the holistic, place-based knowledge of Indigenous Peoples offers a complementary way of understanding and mitigating climate change impacts. The goal of this research was to elevate Anishinaabe concerns, observations, and perspectives about climate change impacts and future research needs. We organized a workshop called “Connecting Guardians in a Changing World” where participants shared concerns about animal and plant life cycles, water cycles and water quality, and impacts to ways of …

This brief addresses the law of unjust enrichment and its relationship to restitution has failed to state a valid cause of action for restitution relief. Defendant incorrectly insists that plaintiff must plead a tort to seek restitution remedies as well as Both arguments belie the basic tenets of unjust enrichment law. Simply, plaintiff may seek restitution remedies based either a separate tort nor an allegation of the lack of bona fide purchaser status is required to survive these challenges.

Getting Blunt About Civil Commitment: How Nj’S Institutionalized Cannabis-Users Are Systematically Denied Civil Liberties, Peri Feldstein

Some of New Jersey’s state-institutionalized psychiatric patients, held by the state in civil confinement at state psychiatric hospitals, use cannabis in violation of hospital rules. When they do so, they are punished in an unconstitutional manner: the judge responsible for their commitment will seek retribution by wrongfully continuing their commitment out of paternalistic fears.

During the filming of the movie Rust in October 2021, actor Alec Baldwin “was holding an antique Colt .45 . . . when the prop gun discharged a live bullet.” The bullet struck cinematographer Halyna Hutchins and director Joel Souza, resulting in the death of Hutchins. While many individuals postulated that other crew members were at fault, on February 15, 2022, the Hutchins family named Baldwin in a wrongful death lawsuit alleging “fail[ure] to perform industry standard safety checks and follow basic gun safety rules while using real guns.” The complaint also argues that but for Baldwin’s reckless behavior, “Hutchins …

This is the most recent of three court of appeals’ decisions regarding whether section 230(c)(1) immunizes an interactive computer service when it makes targeted recommendations of information provided by such another party. The entertainment industry is driven by contractual agreements between actors, film studios, and countless behind-the-scenes players. When disputes inevitably arise, it is often within the parties’ best interests to resolve the issues quickly and privately, without garnering media attention. Arbitration provides disputants this avenue and it is why binding arbitration clauses are so prevalent within the industry. Arbitration clauses within a contract state that, should an issue arise between the parties, the parties will submit the dispute to arbitration. Arbitration allows for the parties to select an arbitrator, with a facilitator overseeing the negotiation, resulting in a legally binding outcome. …

In Red Cloud, Nebraska, in 1887, Anna “Annie” Sadilek (later Pavelka) pressed bastardy charges against the “son of a prominent family,” even though she could have, according to her pretrial testimony, pressed charges for rape. To the literary world, Sadilek is better known as Ántonia Shimerda, the powerful protagonist in Willa Cather’s 1918 novel, My Ántonia. However, it is Sadilek’s real-life experience that allows us to better understand life on the Nebraska Plains, specifically through an examination of the state’s rape laws and the ways these laws were subsequently interpreted by the courts. Master of Social Work Student Policy Advocacy Briefs
The unique needs and experiences of women with children are not reflected in Minnesota’s state reentry approach or federal reentry approach. The number of women in the correctional system has been steadily rising, which means more women, many of them mothers, are returning to their families and communities without the programming and supports needed to successfully resume their roles as parent and provider. Minnesota must invest in a gender-responsive reentry approach tailored specifically to the needs of women with children.

This paper highlights case studies about other states' efforts to require or incentivize the use of TEDs [terrapin excluder devices] and recommends policies for Virginia to adopt that have proven successful elsewhere. First, it outlines the threats to terrapins at large, as well as the threat posed by commercial and recreational crabbing, specifically. Next, it details the efforts that other East Coast states have made to combat the problem, including policies that require or incentivize the use of TEDs on crab pots, and discusses the regulatory framework currently in place in Virginia. There is a growing body of research and scholarship on medical-legal partnerships, social work-legal services partnerships, and other models for multi-disciplinary legal problem resolution. The goal of this selected annotated bibliography is to gather in one place examples of some of these models, and the research questions that are being explored in this area. This document is not intended to be exhaustive. In some jurisdictions, multi-disciplinary models that facilitate legal problem resolution have been part of the legal landscape for several decades; in other jurisdictions they are newer, growing in number in recent years. Texas will need to adapt to a drier climate and reduced water supplyin the 21st centuiyas the negative hydological effects ofclimnate change continue. Rising temperatures will accelerate evaporation of surface water resources, which in turn both increases rehance on depletable groundwater resources and decreases the amount of surface water available for aquifer rechaige. As a result, Texans who rely on either groundwater or suiface water to meet their domestic water needs-particularlyt hose in rurala id regions-mays uffer as both quantities decrease in the coming decades.
