The Supreme Court has interpreted the Equal Protection Clause as a formal equality mandate. In response, legal scholars have advocated alternative conceptions of equality, such as antisubordination theory, that interpret equal protection in more substantive terms. Antisubordination theory would consider the social context in which race-based policies emerge and recognize material distinctions between policies intended to oppress racial minorities and those designed to ameliorate past and current racism. Antisubordination theory would also closely scrutinize facially neutral state action that systemically disadvantages vulnerable social groups. The Court has largely ignored these reform proposals. An apparent disconnect exists regarding how people of faith apply personal morals and theological perspectives when positioning themselves with regard to public policy and social justice issues. In this chapter, we first review the existing literature on cross-cultural studies on compassion. While cultural similarities exist, we demonstrate cultural differences in the conception, experience, and expression of compassion. Then we present our own work on the cultural shaping of compassion by introducing Affect Valuation Theory ( e.g., Tsai, Knutson, & Fung, 2006), our theoretical framework. We show how the desire to avoid feeling negative partly explains cultural differences in conceptualizations and expressions of compassion. การศึกษาเรื่องการกลับใจของผู้พ้นโทษในบ้านกึ่งวิถีแนวคริสต์ ศึกษากรณีบ้านกึ่งวิถีบ้านพระพร ของมูลนิธิพันธกิจเรือนจำคริสเตียน มีวัตถุประสงค์เพื่อศึกษาแนวคิดและรูปแบบการดำเนินกระบวนการของบ้านกึ่งวิถีบ้านพระพร กระบวนการกลับใจที่เกิดขึ้นกับผู้พ้นโทษที่สมัครใจเข้าร่วมในบ้านกึ่งวิถีบ้านพระพร และแนวทางในการพัฒนาบทบาทของภาคประชาสังคมในรูปแบบของบ้านกึ่งวิถี ที่นำเอาหลักคำสอนในพระคริสตธรรมคัมภีร์มาปรับใช้ช่วยเหลือผู้พ้นโทษที่มีความแตกต่างหลากหลายให้กลับสู่สังคม โดยใช้วิธีการวิจัยเชิงคุณภาพ เก็บรวบรวมข้อมูลด้วยการสัมภาษณ์เชิงลึก และนำข้อมูลที่ได้มาวิเคราะห์เพื่ออธิบายประสบการณ์การกลับใจของผู้พ้นโทษและการดำเนินการในบ้านกึ่งวิถีแนวคริสต์ ผลการวิจัยพบว่า (1) การดำเนินงานของบ้านพระพรมีการดูแลสมาชิกอย่างเป็นระบบ กิจกรรมต่างๆส่งเสริมระเบียบวินัยและความรับผิดชอบของสมาชิก ดูแลปัจจัยพื้นฐาน ฝึกอาชีพเสริม และมีชั้นเรียนเพื่อพัฒนาความรู้ทางพระคัมภีร์ นอกจากนี้ ยังมีกระบวนการจัดการกับอารมณ์และพฤติกรรมติดตัวของสมาชิกให้เป็นไปในทางที่ดีขึ้น มีคริสตจักรพระพรเป็นศูนย์กลางประสานงานกับผู้พ้นโทษและเป็นสถานที่ที่สมาชิกเก่าและใหม่สามารถกลับมารวมตัวกันได้ ซึ่งทำให้เกิดพันธะทางสังคมที่ต่อเนื่องช่วยในการสอดส่องดูแลพฤติกรรมอย่างไม่เป็นทางการเมื่อกลับสู่สังคม (2) กระบวนการกลับใจของสมาชิกในบ้านพระพร พบว่าสมาชิกมีการเปลี่ยนแปลงในจิตใจคือตัดสินใจที่จะละทิ้งการกระทำผิดและตั้งใจดำเนินชีวิตตามแบบอย่างของพระเยซูคริสต์เริ่มตั้งแต่ในเรือนจำ และมีสมาชิกบางคนเกิดการเปลี่ยนแปลงนี้เมื่อได้รับการฝึกฝนในบ้านพระพรแล้ว การเปลี่ยนแปลงเกิดทั้งด้านพฤติกรรม ด้านอัตมโนทัศน์ และด้านจิตวิญญาณส่งผลให้สมาชิกมีมุมมองใหม่ต่อตนเองและผู้อื่นในทางที่ดีขึ้น ช่วยให้พวกเขาดำเนินชีวิตในช่วงเปลี่ยนผ่าน (Transitional Period) จากเรือนจำไปสู่สังคมภายนอกได้อย่างเข้มแข็ง (3) ควรมีการขยายแนวคิดในการส่งต่อผู้พ้นโทษจากเรือนจำไปอยู่ในการดูแลของคริสตจักรหรือให้หน่วยงานภาคเอกชนอื่นๆ เข้ามาช่วยแก้ไขปัญหาแบบครบวงจรโดยอาจพ่วงมิติของศาสนาอันจะส่งผลให้เกิดการช่วยเหลือผู้พ้นโทษที่เป็นรูปธรรมมากขึ้น

Despite over 4,000 years of persecution, American Jews and antisemitism continue to be overlooked in university multicultural and social justice classroom discussions. This is due to many factors, such as the misconceptions that Jews are solely a religious group, are White and have completely assimilated into American culture, and are economically successful. Jews are a distinctive group in the United States who continue to experience racism and oppression. In order to validate the racism and discrimination of Jews in the United States, university multicultural and social justice programs must begin to discuss the issues pertaining to antisemitism.

การศึกษานี้มีวัตถุประสงค์เพื่อศึกษาปัญหาการบังคับใช้กฎหมายมาตรการสำหรับการเผยแพร่เพลงลิขสิทธิ์อย่างเหมาะสม และการลดปัญหาการเผยแพร่เพลงลิขสิทธิ์ในร้านอาหาร - ร้านกาแฟ โดยใช้วิธีวิจัยเชิงคุณภาพเก็บข้อมูลด้วยวิธีการสัมภาษณ์เชิงลึกจากกลุ่มตัวอย่าง 2 กลุ่ม ได้แก่ ผู้ประกอบการร้านอาหาร - ร้านกาแฟในกรุงเทพมหานคร จำนวน 9 คน และเจ้าหน้าที่ในกระบวนการยุติธรรม ประกอบด้วยเจ้าหน้าที่ตำรวจในกรุงเทพมหานคร จำนวน 3 คน และผู้พิพากษาศาลทรัพย์สินทางปัญญาและการค้าระหว่างประเทศกลาง จำนวน 1 คน การสุ่มตัวอย่างใช้แบบที่มีลักษณะเฉพาะเจาะจง (purposive sampling) และการสุ่มตัวอย่างแบบลูกโซ่ (snowball sampling) โดยใช้วิธีการพรรณนาข้อมูลร่วมกับการวิเคราะห์เนื้อหาข้อมูลที่ได้จากการสัมภาษณ์ ผลการศึกษาพบว่า 1) ปัญหาด้านการบังคับใช้กฎหมายที่สำคัญคือ การเลือกปฏิบัติในการตรวจสอบการเผยแพร่เพลง รวมไปถึงการแสวงหาผลประโยชน์แอบแฝงของผู้รับมอบอำนาจ ประกอบกับผู้ประกอบการส่วนใหญ่มีความรู้ในการเผยแพร่เพลงลิขสิทธิ์อยู่ในระดับน้อย 2) มาตรการที่เหมาะสมสำหรับการเผยแพร่เพลงลิขสิทธิ์คือ การกำหนดบทบาทการใช้อำนาจของผู้รับมอบอำนาจให้ชัดเจนเพื่อป้องกันการแสวงหาผลประโยชน์แอบแฝง และระบุรายละเอียดในข้อกฎหมายเกี่ยวกับข้อยกเว้นการละเมิดลิขสิทธิ์ให้ชัดเจน โดยยึดผลประโยชน์ของเจ้าของผลงาน และการปกป้องคุ้มครองผลงานลิขสิทธิ์ 3) แนวทางการลดปัญหาและข้อเสนอแนะจากการศึกษานี้คือ การให้ความรู้ความเข้าใจในเรื่องกฎหมายลิขสิทธิ์และการเผยแพร่เพลงลิขสิทธิ์แก่ประชาชน เพื่อพัฒนาความรู้ความเข้าใจและทัศนคติที่ดีต่อลิขสิทธิ์ในประเทศไทยต่อไป

การศึกษาเรื่อง "ปัจจัยที่ส่งผลต่อการตกเป็นเหยื่ออาชญากรรมทางเศรษฐกิจ : ศึกษากรณีแชร์ลูกโซ่" มีวัตถุประสงค์เพื่อศึกษารูปแบบของแชร์ลูกโซ่ในประเทศไทย ปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อของแชร์ลูกโซ่ และแนวทางการแก้ไขปัญหาการตกเป็นเหยื่อแชร์ลูกโซ่ การศึกษาครั้งนี้เป็นการศึกษาวิจัยเชิงปริมาณควบคู่กับการศึกษาเชิงคุณภาพ ในการศึกษาวิจัยเชิงปริมาณใช้แบบสอบถามเป็นเครื่องมือ โดยการสุ่มตัวอย่างแบบเจาะจง (Purposive Sampling) จากกลุ่มผู้ที่ตกเป็นเหยื่อแชร์ลูกโซ่ จำนวน 396 คน ส่วนการศึกษาเชิงคุณภาพใช้การสัมภาษณ์เชิงลึก ประชากรที่ศึกษาจำนวน 4 คน คือ เจ้าหน้าที่ที่ปฏิบัติงานโดยตรงเกี่ยวกับแชร์ลูกโซ่ ผลการศึกษาพบว่า มีแชร์ลูกโซ่ในประเทศไทย 3 รูปแบบ คือ 1. รูปแบบของแชร์ลูกโซ่ที่ใช้วิธีการขายสินค้าและบริการ มีลักษณะชักชวนให้ร่วมเล่นแบบปากต่อปาก เช่น การขายสินค้า การลงทุนแบบต่างๆ 2. รูปแบบแชร์ลูกโซ่ที่ใช้วิธีการชักชวนให้มาเป็นสมาชิกจะมีลักษณะเหมือนยุคอดีต แต่เน้นการหาสมาชิกมากกว่าการขายสินค้า 3. รูปแบบแชร์ลูกโซ่ที่ใช้วิธีการให้ความรู้และการใช้สื่อสังคมออนไลน์ที่เน้นการใช้สื่อสังคมออนไลน์เป็นเครื่องมือหาสมาชิกเข้าร่วม และการทดสอบปัจจัยที่ส่งผลต่อพฤติกรรมการตกเป็นเหยื่อแชร์ลูกโซ่ จำนวน 11 ตัวแปร ประกอบด้วย 1) ลักษณะของเหยื่ออาชญากรรม 2) ความเชื่อ 3) การตกเป็นเหยื่ออาชญากรรมตามแนวพุทธ 4) แบบแผนการดำเนินชีวิต 5) กิจวัตรประจำวัน 6) โอกาส 7) การบังคับ 8) การสนับสนุน 9) ความสามารถ 10) ค่านิยม และ 11) เป้าหมาย/วัตถุประสงค์ ทั้งหมดส่งผลต่อพฤติกรรมการตกเป็นเหยื่อแชร์ลูกโซ่ มีแนวทางในการแก้ไขปัญหา คือ 1) การให้ความรู้แก่ประชาชนเกี่ยวกับรูปแบบของแชร์ลูกโซ่ที่หลากหลายและซับซ้อน 2) แจ้งต่อเจ้าหน้าที่ทันทีเมื่อประชาชนตกเป็นเหยื่อแชร์ลูกโซ่ เพื่อดำเนินการให้ความช่วยเหลือโดยเร็วที่สุด 3) ควรมีการบูรณาการหน่วยงานที่เกี่ยวข้องเพื่อให้เกิดความร่วมมือในการปราบปราม ป้องกัน และแก้ไขปัญหาการตกเป็นเหยื่อแชร์ลูกโซ่ให้เกิดเป็นรูปธรรม และ 4) ควรแก้ไขบทลงโทษในความผิดเกี่ยวกับแชร์ลูกโซ่ให้รุนแรงขึ้น เพื่อให้ผู้กระทำผิดเกิดความเกรงกลัว ไม่กล้ากระทำความผิด

งานวิจัยเรื่องทายาทความรุนแรง: แนวคิดการประกอบสร้างทางสังคมต่อการจัดการประสบการณ์ความรุนแรง เป็นการวิจัยเชิงคุณภาพ (qualitative research) โดยใช้วิธีการสัมภาษณ์เชิงลึก (in-depth interview) เป็นเครื่องมือหลักในการรวบรวมข้อมูล ศึกษาวิจัยผ่านเรื่องเล่า (narrative) ของผู้หญิงอายุระหว่าง 20 - 60 ปี จำนวน 5 คน ซึ่งเป็นผู้ที่มาจากพื้นฐานครอบครัวตั้งต้นที่รุนแรงหรือมีประสบการณ์ความรุนแรงที่เกิดขึ้นช่วงก่อนอายุ 20 ปีบริบูรณ์ จากการศึกษาวิจัย มีข้อค้นพบดังต่อไปนี้ 1) กรอบแนวคิดทายาทความรุนแรง อธิบายปัจเจกบุคคลที่มีประสบการณ์ความรุนแรงในครอบครัวซึ่งเป็นผู้ที่ได้รับ "พิษ" "ความรุนแรง" หรือ "ผลกระทบในเชิงลบ"อันเนื่องมาจากประสบการณ์ดังกล่าว ซึ่งอาจสะท้อนผ่านทัศนคติที่รุนแรง อารมณ์ที่รุนแรง จนอาจนำไปสู่พฤติกรรมที่รุนแรงต่าง ๆ ต่อไปได้ 2) แนวคิดการประกอบสร้างทางสังคมเป็นการอธิบายกลไกทางสังคม 4 ระดับ ประกอบด้วย ความรุนแรงที่แฝงอยู่ในระดับความคิดความเชื่อหรือวัฒนธรรมที่รุนแรง (Toxic Root) สภาพแวดล้อมทางสังคมที่รุนแรง (Toxic Environment) ความสัมพันธ์ที่รุนแรง (Toxic Relationships) และปัจเจกบุคคลในฐานะทายาทความรุนแรง (Toxic Fruits) ซึ่งทั้งหมดถือเป็นปัจจัยที่มีส่วนสำคัญทำให้ความรุนแรงในฐานะโครงสร้างทางสังคมสามารถถูกสืบทอดและถ่ายทอดมาอย่างยาวนานรุ่นแล้วรุ่นเล่า 3) ทายาทความรุนแรงสามารถเลือกจัดการกับประสบการณ์ความรุนแรงได้ 2 แนวทาง ได้แก่ การจัดการด้วยวิถีทางที่รุนแรงและการจัดการด้วยวิถีทางที่ไม่รุนแรง (4) ปัจเจกบุคคลที่เติบโตมาจากพื้นฐานครอบครัวตั้งต้นที่รุนแรงมีแนวโน้มที่จะสืบทอดหรือผลิตซ้ำความรุนแรงต่อไป แต่อย่างไรก็ตาม บุคคลนั้นก็สามารถเสริมสร้างพลังแห่งตนและเรียนรู้ที่จะจัดการประสบการณ์ความรุนแรงเหล่านั้นด้วยวิถีทางที่ไม่รุนแรงได้เช่นกัน 5) ในการยุติวงจรความรุนแรงในครอบครัว จำเป็นต้องอาศัย 2 พลังสำคัญ ทั้งพลังภายในของปัจเจกบุคคลเองและพลังภายนอกจากสังคมทุกภาคส่วนที่จะเข้ามามีส่วนในการแก้ปัญหาความรุนแรงในครอบครัวร่วมกัน เพราะฉะนั้นการเสริมสร้างพลังแห่งตนจึงต้องพัฒนาควบคู่ไปกับการเสริมสร้างพลังทางสังคมเพื่อยุติโครงสร้างความรุนแรง โดยสรุป เนื่องจากมนุษย์ไม่ใช่เป็นเพียงแค่ผลผลิตจากการประกอบสร้างทางสังคมเท่านั้น แต่มนุษย์เสมือนผลผลิตทางสังคมซึ่งมาพร้อมกับเมล็ดพันธุ์ที่ทรงพลัง ซึ่งมีศักยภาพในการเปลี่ยนแปลงตนเองและมีความสามารถในการสร้างสรรค์สังคมไปในวิถีทางที่ดีขึ้นต่อไปได้

Objective
As incumbent House members increasingly recruit campaign contributions from individuals who reside outside of their districts, this raises the question of whether a dependency on outside money affects members’ responsiveness and ideological proximity to district constituents.

Method
Using data from the Cooperative Congressional Election Studies of 2006, 2008, and 2010 as well as individual contribution data corresponding to those years from the U.S. Federal Election Commission, I examine this relationship using responsiveness and proximity models of representation.

Results
I find a dependency on outside contributions decreases members’ responsiveness to their districts and increases the members’ ideological extremity. Moreover, within‐district …

Therefore, this study specifically describes the Men Care program implemented by Yayasan PULIH in Jakarta. This research uses descriptive method with qualitative approach. This thesis is about Frank Johnson Sr. and the circumstances that led to his downfall as a farmer and father of six, to his tragic death in the isolation of a racially segregated mental institution 18 miles away from his home. Using his life and incarceration at the South Carolina State Park mental health facility, I argue that racial injustice contributed to his tragic death and the woefully inadequate treatment thousands of African Americans in South Carolina received during Jim Crow. Entrepreneurship basically is not an easy matter. Despite of the challenges, organizations of both government and non-governmental organizations have developed entrepreneurial development activities. As a non-governmental organization, profit-oriented PT “X” also plays a role in the process of entrepreneurship development by undertaking financing activities to micro enterprises. This article describes the efforts of PT “X” as a Non-Bank Company that implements the implementation of credit loan and return in UMKM.
