The experience of students that are incarcerated is largely unknown. This qualitative phenomenological research study allowed four college students that are incarcerated to share their experiences. Research shows individuals who are incarcerated are less likely to reoffend this study upon release. This study will show how these individuals view their educational experience during incarceration. Interviews were conducted with each participant and data was coded and organized into themes. By utilizing a phenomenological stance, observations were made of events that led to the placement of participants in the prison system and how education has impacted their time spent incarcerated. We call for psychologists to expand their thinking on fair and just public safety by engaging with the “Abolition Democracy” framework that Du Bois (1935) articulated as the need to dissolve slavery while simultaneously taking affirmative steps to rid its toxic consequences from the body politic. Because the legacies of slavery continue to produce disparities in public safety in the U.S, both harming Black people and the institutions that could keep them safe, psychologists must take seriously questions of history and structure in addition to immediate situations. Extant criminological research examining research questions oriented on understanding the spatial distribution of violent crime instances, such as homicide, have often employed the theoretical foundations of both social disorganization theory and routine activities theory. Though there is much research using these theories independently and in conjunction with one another, few studies have integrated the theories in analyses of homicide at multiple levels of aggregation. การศึกษาเรื่อง ผู้ก่อการร้ายหญิง : ปัญหาและแนวทางการแก้ไข เป็นการวิจัยเชิงคุณภาพ มีวัตถุประสงค์เพื่อศึกษามูลเหตุ จูงใจ บทบาท และกระบวนการในการที่ผู้หญิงเข้าไปมีส่วนร่วมในการก่อการร้าย ตลอดจนแสวงหาแนวทางในการป้องกันและแก้ไขปัญหา ผลจากการวิจัยพบว่า มูลเหตุจูงใจในการก่อการร้ายของผู้หญิงสามารถแบ่งเป็นสองส่วนหลัก ได้แก่ ส่วนที่เป็นปัจจัยดึงดูด อันเป็นปัจจัยจากฝั่งกลุ่มก่อการร้าย ได้แก่ กระบวนการชักชวนและจัดหาที่มีประสิทธิภาพ ประกอบกับความมีบารมีและความดึงดูดของผู้นำกลุ่มก่อการร้ายและส่วนที่เป็นปัจจัยผลักดัน อันเป็นปัจจัยที่มาจากแรงกระตุ้นของฝั่งผู้หญิงเอง ได้แก่ อารมณ์ส่วนตัว ศาสนา และการเมือง จนนำไปสู่การเข้าสู่กระบวนการโดยสมัครใจเพื่อไปมีส่วนร่วมในการก่อการร้าย โดยในต่างประเทศผู้หญิงมีทั้งบทบาทหลักในการก่อเหตุ และบทบาทสนับสนุน อาทิ การทำหน้าที่เป็นแม่ ภรรยา และจัดหาสมาชิก เป็นต้น ซึ่งมักถูกชักจูงผ่านช่องทางออนไลน์เป็นหลัก ขณะที่บางส่วนที่ไม่สมัครใจก็จะตกเป็นเหยื่อเพื่อแสวงประโยชน์ของกลุ่มก่อการร้าย ในส่วนของประเทศไทยนั้น การก่อการร้ายถูกชี้นำไปในพื้นที่จังหวัดชายแดนภาคใต้ ซึ่งผู้หญิงจะมีบทบาทในการสนับสนุนกลุ่มก่อความไม่สงบ อาทิ การทำหน้าที่ปฐมพยาบาล และการหารายได้ เป็นต้น โดยถูกชักจูงจากคนในครอบครัวและคนใกล้ตัว ประกอบกับการซึมซับข้อมูลและเรื่องเล่าต่าง ๆ ผ่านประสบการณ์จากการอาศัยอยู่ในพื้นที่เป็นเวลานาน และเนื่องจากผู้หญิงเข้าไปมีส่วนร่วมในการก่อการร้ายในบทบาทต่าง ๆ อันเป็นฟันเฟืองหนึ่งที่ขับเคลื่อนให้เกิดการก่อการร้ายในหลายพื้นที่ทั่วโลก ประชาคมระหว่างประเทศรวมทั้งประเทศไทยจึงได้มีการกำหนดนโยบายที่เกี่ยวข้องในการต่อต้านการก่อการร้ายทั้งในภาพรวมและในมิติของผู้หญิงในการก่อการร้ายเป็นการเฉพาะ อย่างไรก็ดี ยังพบว่าหลายประเทศทั่วโลกยังคงเผชิญกับภัยคุกคามจากการก่อการร้ายจวบจนปัจจุบัน เช่นเดียวกับประเทศไทยที่ปัญหาการก่อความไม่สงบในจังหวัดชายแดนภาคใต้ยังคงดำเนินต่อเนื่องเรื่อยมาหลายทศวรรษ ผู้วิจัยจึงได้เสนอแนะให้มีการปรับปรุงนโยบาย การเพิ่มมาตรการป้องกันในระดับปฏิบัติ ตลอดจนการนำทฤษฎีทางอาชญาวิทยาและแนวทางการป้องกันจากต่างประเทศที่ได้ศึกษาไว้ มาเป็นกรอบในการจัดทำแนวทางในการป้องกันและแก้ไขทั้งในระดับนโยบายและระดับปฏิบัติการที่สอดคล้องกับบริบทของไทย

การศึกษาเรื่องนี้มีวัตถุประสงค์เพื่อศึกษากระบวนการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต ศึกษาความสัมพันธ์ของการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต และศึกษาทัศนคติของประชาชนเกี่ยวกับการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต เป็นการวิจัยแบบผสมผสาน (Mixed method) การวิจัยเชิงปริมาณ เครื่องมือที่ใช้ในการวิจัยคือ แบบสอบถาม โดยวิธีการเก็บข้อมูลกับกลุ่มตัวอย่าง จำนวน 400 คน ในจังหวัดเชียงราย เชียงใหม่ กรุงเทพมหานคร สมุทรสาคร ตราด และสุราษฎร์ธานี และการวิจัยเชิงคุณภาพด้วยการวิจัยเชิงเอกสาร 10 ปีย้อนหลัง พ.ศ. 2556 - 2566 และใช้เทคนิคการสัมภาษณ์แบบเจาะลึก ผู้ให้ข้อมูลสำคัญ จำนวน 15 คน ในหน่วยงานที่เกี่ยวข้องกับคาร์บอนเครดิต นักวิชาการและผู้เชี่ยวชาญ องค์กรไม่แสวงหากำไร ผลการศึกษาพบว่า การซื้อขายคาร์บอนเครดิตสามารถบรรเทาปัญหาภาวะโลกร้อน ก่อให้เกิดโครงการเพื่อสิ่งแวดล้อม และนำไปสู่การลงทุนรูปแบบใหม่ที่เป็นมิตรต่อสิ่งแวดล้อม ทั้งนี้การซื้อขายคาร์บอนเครดิตไม่ได้เป็นอาชญากรรมในตัวเอง หากแต่มีการใช้เป็นเครื่องมือกระทำความผิดและนำไปสู่การฟอกเขียว การฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต ประกอบด้วย 6 องค์ประกอบ 1) ผู้กระทำ 2) กิจกรรมการฟอกเขียว 3) ฟอกเขียวด้วยกลไกคาร์บอน 4) เป้าหมาย 5) ผลกระทบ 6) กระทำด้วยเจตนา โดยผู้กระทำการฟอกเขียว ประกอบด้วย 1) บุคคลธรรมดา มีลักษณะอาชญากรคอปกขาว 2) นิติบุคคล มีลักษณะอาชญากรรมที่กระทำโดยบริษัทหรือธุรกิจองค์กร 3) รัฐ ที่เกี่ยวข้องกับอุบัติเหตุจากความประมาทจากการประกาศนโยบายของรัฐ หรือการดำเนินการผิดพลาดที่นำไปสู่การทุจริตคอร์รัปชัน การฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิตสามารถเกิดใน 3 รูปแบบ ได้แก่ การใช้ช่องโหว่ของกระบวนการซื้อขายคาร์บอนเครดิต การพึ่งพาการชดเชยมากเกินไป และการใช้กลไกการทำธุรกรรมของกลไกคาร์บอน ความสัมพันธ์ของการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิต จำแนกเป็น 2 ลักษณะคือ การซื้อขายคาร์บอนเครดิตช่วยบรรเทาปัญหาภาวะโลกร้อน และการซื้อขายคาร์บอนเครดิตนำไปสู่ปัญหาสังคม 2 ลักษณะ ได้แก่ เป็นเครื่องมือการฟอกเขียว และ ก่อให้เกิดอาชญากรรมรูปแบบใหม่ในลักษณะห่วงโซ่อาชญากรรม ได้แก่ การฉ้อโกงประชาชน อาชญากรรมสิ่งแวดล้อม อาชญากรรมคอปกขาว อาชญากรรมทางเศรษฐกิจ อาชญากรรมไซเบอร์ การฉ้อโกงภาษี และการฟอกเงิน จากการศึกษาทัศนคติของประชาชนเกี่ยวกับการฟอกเขียวด้วยการซื้อขายคาร์บอนเครดิตปรากฎว่า มีความสัมพันธ์กับการบรรเทาปัญหาภาวะโลกร้อน โครงการเพื่อสิ่งแวดล้อม และการลงทุนที่เป็นมิตรต่อสิ่งแวดล้อมในระดับน้อย มีความสัมพันธ์กับไม่ช่วยลดการปล่อยก๊าซเรือนกระจก …

Racial and ethnic differences in policing attitudes have generally been examined through the group position or other conflict perspectives. This perspective contains a limitation, especially when considering recent trends in racial and policing attitudes. Racial attitudes have been liberalizing for over a decade among White political liberals and moderates, while Republicans’ racial attitudes have been relatively stagnant. These divergent trends may have accelerated since the murder of George Floyd. While racial attitudes (including attitudes about the police) have been polarizing along political lines, the group position model suggests that racial attitudes and policy preferences among dominant group members, regardless of …

Over the last twenty years, the scholarly field of erroneous convictions has skyrocketed, with multiple articles and books exploring the failures that convict the innocent. However, there has been comparatively little attention to the other side of the coin, failed prosecutions, when the criminal justice system falls short in convicting the likely perpetrator. In this Article, we take up an analysis of failed prosecutions, simultaneously seeking to define its breadth and explain its relation to erroneous convictions. This study describes how judges in Maricopa County, Arizona responded to age and other mitigation evidence in imposing “life” versus “natural life” sentences for juvenile offenders convicted of homicide in pre-Miller cases. Maricopa County was selected for this case study because of its history of adhering to “restrictive interpretations” of various kinds of mitigation evidence and because of the characteristics of this county’s local court community. The study employed a mixed-methods design consisting of a content analysis of relevant case documents and a quantitative analysis of the findings from the qualitative analyses of legal case documents. Although there is extensive literature on youth and adolescent antisocial behavior, some correlates of youth antisociality are not known yet. As such, the present study is devoted to understanding the micro- and macro-level predictors of youth and adolescents’ antisociality in three contexts. Motor vehicle theft is a popular crime with hundreds of thousands of vehicles stolen each year. Two common MVT methods are auto thefts and carjackings. Auto thefts occur solely as property crimes, in which an offender steals an unoccupied vehicle. Carjackings are interpersonal crimes, in which the offender steals the vehicle from the driver by force or coercion. This study compares the motivation of the two offender groups. Utilizing 28 in-depth semi-structured interviews with active offenders, this study explores why they chose to commit crimes, why they chose vehicle-related crimes, and why they chose their preferred method. Researchers can analyze statistics of recidivism rates and decipher that they are at an alarming rate—specifically regarding women convicts. The population of women in prison has drastically increased, and with that, so have their recidivism rates. Analyzing statistical data of incarceration and recidivism can show us the numbers, but what is the reason? Why do some women struggle to stay out of prison? I argued that one reason is because women who are released from prison are severely underprepared to reintegrate back into society and, are therefore, set up for failure. In this dissertation, I develop a convict epistemology that interweaves two elements: 1) a deep engagement with the works of particular philosophers and scholars investigating questions of punishment, violence, biopolitics and political philosophy 2) with some specific, publicly-reported incidents within California prisons in the late 20th and 21st centuries and my own detailed narration of events and the structural and quotidian dynamics of the prison yard as I experienced them as inmate #K73299 from 1997 to 2005. การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษาถึงสภาพปัญหาของการกระทำผิดซ้ำที่เกิดขึ้นโดย ผู้ป่วยนิติจิตเวช อันได้แก่ สาเหตุและปัจจัยที่ก่อให้เกิดพฤติกรรมการกระทำผิดซ้ำ ตลอดจนปัญหา และอุปสรรคของการป้องกันไม่ให้ผู้ป่วยนิติจิตเวชกลับมากระทำผิดซ้ำ โดยผู้วิจัยได้ทำการวิจัยเชิง คุณภาพจากทางเอกสารและมีการสัมภาษณ์เชิงลึกในกลุ่มตัวอย่างแบบเฉพาะเจาะจง โดยแบ่งเป็น 2 กลุ่ม คือ บุคลากรวิชาชีพทางสายสุขภาพจิตสังกัดกรมสุขภาพจิต และบุคลากรวิชาชีพทางสาย สุขภาพจิตสังกัดกรมราชทัณฑ์รวมทั้งสิ้น 7 คน ผลการวิจัยพบว่า สภาพปัญหาของการกระทำผิดซ้ำในผู้ป่วยจิตเวชมีสาเหตุหลักมาจาก 1) ความเครียด ความกดดัน และความขับข้องใจที่เกิดขึ้นในชีวิตประจำวันของผู้ป่วย2) การขาดยา เพราะขาดคนช่วยดูแล ตลอดจนคนรอบข้างอย่างครอบครัวหรือชุมชนขาดความรู้ในการดูแลผู้ป่วย จิตเวช 3) การตีตราของผู้คนในชุมชน ส่งผลให้ผู้ป่วยขาดที่พึ่งและถูกกีดกันออกจากสังคมขณะที่ อุปสรรคในการป้องกันอยู่ด้วยกันดังนี้1) ปัญหาด้านยาเสพติด เนื่องจากปัญหาการแพร่ระบาดของ ยาเสพติดที่มีราคาถูกและหาง่าย 2) ปัญหาด้านความรู้ความเข้าใจในเรื่องสุขภาพจิตของประชาชน และ 3) ปัญหาเชิงระบบและโครงสร้าง เพราะการขาดกำลังคนและรอยต่อของระบบการส่งต่อ ระหว่างสถานพยาบาลกับเรือนจำ สำหรับข้อเสนอแนะ ได้แก่ 1) การพัฒนาสถานพยาบาลที่มีความเฉพาะด้าน เพื่อให้เอื้ออำนวยต่อการบำบัดรักษาและครอบคลุมไปถึงการลงโทษตามแนวทางทฤษฎีการลงโทษเพื่อแก้ไขฟื้นฟูตลอดจนเป็นการลดรอยต่อของระบบการส่งต่อผู้ป่วยนิติจิตเวช สถานพยาบาลกับทางเรือนจำ 2) การพัฒนากำลังคน เพื่อช่วยลดภาระงานบางส่วน โดยเฉพาะเมื่อผู้ป่วยหรือผู้เคยต้องขังที่เคยกระทำความผิดต้องกลับสู่ชุมชน ควรมีการส่งเสริมและพัฒนาองค์ความรู้เฉพาะด้านนี้ให้กับบุคคลที่เกี่ยวข้อง
