Criminal law can serve a variety of utilitarian purposes including deterrence, incapacitation, and rehabilitation.  Nevertheless, there is broad agreement among criminal justice scholars that the pursuit of these purposes should be constrained by a requirement that punishment not be disproportionately severe relative to the offense charged.  The proportionality constraint is likely to be especially important when considering the less heinous predatory crimes such as nonviolent thefts.  Recent years have seen experiments by progressive prosecutors who deemphasize theft offenses as well as statutory schemes that treat many thefts as misdemeanors.  With some empirical support, critics charge that these experiments have increased …

The presumption against extraterritoriality is a fundamental principle of U.S. law, yet its application to copyright law remains unsettled.  In recent years, the Supreme Court has formalized a two-step methodology for assessing the extraterritorial scope of federal statutes, culminating in RJR Nabisco, Inc. v. European Community.  Despite this doctrinal shift, lower courts have inconsistently applied this framework to copyright infringement cases.  In an age of digital streaming and generative AI using training data globally, this state of affairs is unsatisfactory.  This Article examines the evolving state of copyright extraterritoriality in light of the Supreme Court’s recent jurisprudence.  It explores …

Does the Constitution allow waiver of Fourth Amendment rights through passive choice? What about through the choice of others? Based on current Supreme Court precedent, the answer is frustratingly unclear. For example, a copious amount of information is constantly disclosed to phone companies. The Supreme Court has recognized that having a cell phone is an inescapable choice today and that disclosing one’s location information to the cell phone company is automatic in nature. This Casenote examines the implications of the Supreme Court’s recent decision in Amalgamated Bank to dismiss Facebook’s writ of certiorari as improvidently granted, thereby allowing the shareholders’ securities fraud class action lawsuit to proceed in the lower courts.  Specifically, it focuses on whether Facebook shareholders adequately alleged securities fraud under Section 10(b) and Rule 10b-5 as to challenged risk factor disclosures in Facebook’s 2016 Form 10-K under the PSLRA’s heightened pleading standard.  Part II of this Casenote provides background on the Cambridge Analytica data breach, which Facebook allegedly failed to disclose in its 2016 Form 10-K risk factor disclosures.  Part …

This Note examines the Ninth Circuit’s decision in Al Otro Lado and its implications on evolving federal immigration policies.  Part II analyzes the history of metering in the United States, including prior judicial treatment of the practice and its unlawfulness as determined by the district court’s prior holding.  Part III summarizes the Ninth Circuit’s majority opinion in Al Otro Lado, while setting forth the case’s legal implications within the larger federal landscape, including the broadened scope of government obligation to asylum seekers.  Part IV proposes next steps that could be taken by the legislature in response to practical constraints …

Researchers have long studied how organizational budgets relate to performance, but how do employees themselves experience the effects of budgetary decisions? Given widespread attention to political dysfunction in US federal budgeting, conventional wisdom holds that employees are negatively affected by budgetary uncertainty (volatility, delays, and stop-gap measures). We test how budget size and uncertainty are associated with US federal employee attitudes using survey and archival data from 2005 to 2020. Results provide some evidence that employee job satisfaction improves with enhanced funds, but there is little to no support for the notion that budgetary uncertainty influences federal employees' job satisfaction.

Leadership And Context For Comprehensive Internationalization: Senior International Officer Perspectives, Elenora Haag

Journal of Comparative & International Higher Education

Increasing attention has been paid in recent years to the nature and importance of the role of the senior international officer (SIO) in higher education institutions. With reference to Knight’s (1994) internationalization cycle and Tierney’s (1988) framework of organizational culture, this basic qualitative study examines the intersection of leadership and institutional context as mediators of the internationalization process, a perspective which is lacking in the existing literature. Semi-structured interviews were conducted with 11 SIOs from institutions that have received a national award for internationalization, with strategic planning documents serving as a secondary data source. Creating Healthy Work Environments (CHWE)

Evidence supports interprofessional bedside rounding as a method to improve communication and patient outcomes in inpatient healthcare settings (Blakeney et al., 2021). Intensive care unit (ICU) nurses have an integral role to play in these rounds, as they influence patient care, safety, and satisfaction and often maintain the most current information about patient status and concerns. Surgical Trauma ICU nurses in a large level one trauma center attend daily physician-led multidisciplinary teaching rounds, but their role as a passive participant led to dissatisfaction and concerns that suboptimal interprofessional communication might negatively impact patient outcomes.

Context: Acquired brain injury (ABI) can result in executive impairments that can detrimentally impact an individual’s level of insight into the changes in functioning caused by their ABI. This, along with the difficulty professionals have in identifying executive impairments and relating these to functional changes, can lead to wrongful assumptions of functional abilities among those affected. Objective: This study aimed to explore the experience of individuals with ABI who demonstrate an impairment of insight with a view to documenting specific examples of impaired insight. Differentiation and detection of live and dead cells are critical for assessing cell viability in biomedical research, evaluating drug efficacy, and monitoring cytotoxicity in therapeutic applications. We present a microfluidic sensor that consists of two successive resistive pulse sensing channels. An excitation signal composed of a low-frequency AC (75 kHz) component and a DC bias was used to measure four key parameters. Through the AC measurement, differences in cell impedance causes variations in phase angle and voltage peak. From the DC measurement, cell size can be inferred from the resistive pulse magnitude, and the cell’s zeta potential is represented by …
