Reconsideration Of Forced Arbitration In Data Privacy Legislation, Andy (Chen Di) Xu Oct 2022

Reconsideration Of Forced Arbitration In Data Privacy Legislation, Andy (Chen Di) Xu

Cardozo Journal of Conflict Resolution (CJCR) Blog

Pre-dispute arbitration principles were established in 1925 by Congress through the Federal Arbitration Act (FAA) and were meant to “create an efficient way for businesses with comparable bargaining power to negotiate and agree upon an alternative means of conflict resolution.” However, the driving legal maxims behind the FAA failed to address cases with a large power imbalance between the parties. Arbitration in such cases usually see a company “likely be[ing] represented in arbitration by lawyers who are well-versed in the process and the issue involved, while the wronged customer must find an attorney willing to represent them for what is …

Mass customization has been used in various clothing products including T-shirts, dress shirts, jeans, sports shoes, accessories, etc. However, even though the concept of mass customization has been accepted among scholars and business practitioners, and the application of mass customization has been practiced in the fashion industry for more than two decades, the acceptance among ultimate consumers and the market of MC in the apparel industry has not taken off yet. To this end, this study intends to fill the identified gap through a content mining exploratory qualitative study using customer value theory to evaluate individual consumers' actual customization experiences. …

Hospital Value-Based Payment Programs And Disparity In The United States: A Review Of Current Evidence And Future Perspectives, Hyunmin Kim, Asos Mahmood, Noah E. Hammarlund, Cyril F. Chang

Faculty Publications

Beginning in the early 2010s, an array of Value-Based Purchasing (VBP) programs has been developed in the United States (U.S.) to contain costs and improve health care quality. Despite documented successes in these efforts in some instances, there have been growing concerns about the programs' unintended consequences for health care disparities due to their built-in biases against health care organizations that serve a disproportionate share of disadvantaged patient populations. We explore the effects of three Medicare hospital VBP programs on health and health care disparities in the U.S. by reviewing their designs, implementation history, and evidence on health care disparities. …

Size-Dependent Tensile Failure Of Epitaxial Tin/Cu/Tin Sandwich Pillar Structures: A Combined Experimentation – Atomistic Simulation Study, Xiaoman Zhang, Reza Namakian, Andrew C. Meng, Dorel Moldovan, W. J. Meng

Faculty Publications

A combined experimentation - molecular dynamics simulation study was conducted to understand tensile failure of TiN/Cu/TiN interfacial regions. Tensile loading was conducted on micro-pillar specimens fabricated from TiN/Cu/TiN thin film sandwich structures. The Cu layer and the TiN layer underneath were grown epitaxially on MgO(001) substrates, with Cu[110]//TiN[001] in the growth direction and Cu//TiN and Cu//TiN within the growth plane. The Cu layer contains numerous nanotwins with the {111} twin plane parallel to the growth direction, with 2–10 nm wide twin bands rotated in-plane by 90° in different yet symmetry-equivalent epitaxial domains. Tensile loading in-situ a scanning electron microscope measured …

Where We Stand Today With The Public Charge Rule, Rachell Henriquez Oct 2022

Where We Stand Today With The Public Charge Rule, Rachell Henriquez

Cardozo Journal of Equal Rights and Social Justice (ERSJ) Blog

The Statue of Liberty has become known as the “Mother of Exiles, greeting millions of immigrants and embodying hope and opportunity for those seeking a better life in America [,]” not only to Americans but to all people around the world. Yet, despite being designated as the land of dreams and opportunities, the United States has a long history of denying such dreams and opportunities to marginalized communities. The “public charge” rule refers to inadmissibility and deportability grounds in U.S. immigration law that have constantly barred poor noncitizens and noncitizens of color from obtaining legal status. The public charge rule …

Contra-Thermodynamic Halolactonization Of Lactam-Tethered 5-Aryl-4(E)-Pentenoic Acids For The Flexible And Stereocontrolled Synthesis Of Fused Lactam-Halolactones, Timothy K. Beng, Claire Borg, Morgan J. Rodriguez Oct 2022

Contra-Thermodynamic Halolactonization Of Lactam-Tethered 5-Aryl-4(E)-Pentenoic Acids For The Flexible And Stereocontrolled Synthesis Of Fused Lactam-Halolactones, Timothy K. Beng, Claire Borg, Morgan J. Rodriguez

All Faculty Scholarship for the College of the Sciences

Halolactonization of alkenoic acids enables the construction of oxygen-heterocycles via intramolecular halonium-induced nucleophilic addition. Although the literature is currently inundated with halolactonizations of 5-aryl-4(E)-pentenoic acids that predictably afford the 6-endo cyclization adducts, methods that reliably alter the innate regioselectivity bias to instead deliver the thermodynamically less favored 5-exo cyclization products are relatively rare. Here, we attempt to bridge this gap and have found mild conditions for contra-thermodynamic halolactonization of lactam-tethered 5-aryl-4(E)-pentenoic acids that lead to the formation of trans-fused lactam-γ-lactones. The natural proclivity for these 5-aryl-4(E)-pentenoic acids to undergo 6-endo cyclization is overridden and 5-exo-trig cyclization predominates. The success of …

Faculty, Staff and Student Publications

BACKGROUND: Tunneling nanotubes (TNTs) are cellular structures connecting cell membranes and mediating intercellular communication. TNTs are manually identified and counted by a trained investigator; however, this process is time-intensive. We therefore sought to develop an automated approach for quantitative analysis of TNTs.

METHODS: We used a convolutional neural network (U-Net) deep learning model to segment phase contrast microscopy images of both cancer and non-cancer cells. Our method was composed of preprocessing and model development. We developed a new preprocessing method to label TNTs on a pixel-wise basis. Two sequential models were employed to detect TNTs. First, we identified the regions …

Vitamin D deficiency and insufficiency are highly prevalent among several populations across the globe. Numerous studies have shown a significant correlation between body-mass-index (BMI) and Vitamin D status, however, some results differed according to ethnicity. Despite the abundance of sunshine throughout the year, vitamin D deficiency is prominent in the United Arab Emirates (UAE). In this study, we analyzed the UAE Healthy Future Study (UAEHFS) pilot data to investigate the association between serum 25-hydroxyvitamin D (25(OH)D) and % body fat (BF) composition as well as BMI. Data from a total of 399 Emirati men and women aged ≥ 18 years …

Android and Windows are the predominant operating systems used in mobile environment and personal computers and it is expected that their use will rise during the next decade. Malware is one of the main threats faced by these platforms as well as Internet of Things (IoT) environment and the web. With time, these threats are becoming more and more sophisticated and detecting them using traditional machine learning techniques is a hard task. Several research studies have shown that deep learning methods achieve better accuracy comparatively and can learn to efficiently detect and classify new malware samples. In this paper, we …

Critique Beyond Judgment: Exploring Testimony And Truth In The Classroom, Sean Sidky

Genocide Studies and Prevention: An International Journal

This essay offers a set of strategies for utilizing the words of survivors and of witnesses to genocide in the classroom. Including the voices of survivors and victims in our classroom conversations about genocide, its impact, representation, and the possibilities for its prevention is crucial to an ethical and wholistic pedagogy of genocide. Discussion of these events in the classroom often finds us confronting questions from students about truth, historical accuracy, authenticity, and authority. Addressing such questions requires careful framing that takes into account student assumptions and cultural discourses about memory and witnessing, as we work with students to develop …

Armenian Resistance To The Hamidian Massacres, Deborah Mayersen Oct 2022

Armenian Resistance To The Hamidian Massacres, Deborah Mayersen

Genocide Studies and Prevention: An International Journal

Between 1894 and 1896, the Hamidian massacres claimed the lives of more than 100,000 Armenians in Ottoman Turkey. This article presents an exploratory analysis of Armenian resistance to the massacres. It examines the context and contours of resistance, including the strategies employed, scope and organization of resistance efforts. Evidence indicates that resistance was widespread, and Armenians adopted a diverse range of strategies in attempting self-protection. The relative powerlessness of the Armenian minority, however, meant that most attempts at resistance were overwhelmed. Additionally, resisters were often targeted for especially violent retribution. The lack of success of resistance efforts can also be …
