Wysokości opłat za dostęp do infrastruktury kolejowej ma bardzo istotne znaczenie dla rozwoju konkurencji na rynku przewozów kolejowych, w szczególności na rynku przewozu rzeczy. Obowiązujące przepisy przewidują ograniczenia dla zarządców infrastruktury kolejowej przy ustalaniu ich wysokości. Określają one kategorie kosztów, które mogą zostać uwzględnione przy ustalaniu wysokości opłat. Ponadto wprowadzenie zmienionej wysokości opłat uzależnione jest od ich wcześniejszego zatwierdzenia przez Prezesa UTK. Rozstrzygnięcia w tym zakresie podlegają kontroli sądowej. Z najnowszego orzecznictwa TSUE wynika, że z żądaniem przeprowadzenia kontroli sądowej, poza zarządcą infrastruktury kolejowej, mogą wystąpić również przewoźnicy kolejowi. Z dniem 7 czerwca 2023 r. wejdą w życie przepisy przekształconej wersji rozporządzenia 1371/2007 dotyczącego praw i obowiązków pasażerów w ruchu kolejowym. Pierwsza nowelizacja tego podstawowego aktu prawnego w codziennej praktyce pasażerskich przewoźników kolejowych, zarządców infrastruktury, sprzedawców biletów oraz Prezesa UTK wprowadza istotne zmiany w wielu obszarach. Modyfikacji poddane zostały zasady odpowiedzialności przedsiębiorstw kolejowych w przypadku opóźnienia, odwołania lub utraty połączenia. Wprowadzono nowe zasady sprzedaży i odpowiedzialności przedsiębiorstw kolejowych podczas podróży objętych wspólnymi biletami. Wzmocniono uprawnienia osób z niepełnosprawnością oraz o ograniczonej możliwości poruszania się. Niniejszy artykuł przybliża planowane zmiany w systemie technicznych specyfikacji interoperacyjności (TSI), przedstawiając charakterystykę systemu aktualnych norm w tym zakresie, a także priorytety europejskich władz regulacyjnych towarzyszące planowanym zmianom. Nowe TSI adresują potrzebę wprowadzenia innowacyjnych rozwiązań w systemie kolei, w szczególności z wykorzystaniem urządzeń informatycznych, takich jak systemy zapobiegania wykolejeniom w transporcie towarowym. Zmiany uwzględniają również zakładane upowszechnienie transportu intermodalnego oraz systemów Europejskiego System Sterowania Pociągiem i Europejskiego System Zarządzania Ruchem Kolejowym.

El articulo resume las aproximaciones bibliograficas que se han generado dentro y fuera de la academia en torno a la relacion de Borges, la ciencia ficcion, y la idea de utopia y distopia. Refectando esas visiones entre ellas, se propone una relectura de “Tlön, Uqbar, Orbis Tertius” que vaya mas alla de una mera vision "distopica" o critica con movimientos ideologicos "totalitarios", para entatizar los elementos formales, genealogicos y de proyeccion hacia el tuturo que convierten el texto en una critica a la expansion del capitalismo en la Argentina de los años 40.

Adnan Syed, was released from prison on September 19, after being behind bars for 23 years. Syed was convicted in 1999 for the murder of his high school girlfriend, Hae Min Lee, despite steadfastly defending his innocence. After a mistrial in 1999, Syed was found guilty of murder in 2000 and sentenced to life in prison. After 14 years of his sentence had passed, Syed’s case gained widespread attention after it was featured on the Serial podcast. On the episode, host Sarah Koenig, questioned the credibility of the evidence used to incriminate Syed and the inconsistencies among the prosecution's witnesses. …

Unique Thermal Sensitivity Imposes A Cold-Water Energetic Barrier For Vertical Migrators, Brad Seibel, Matthew A. Birk

Alterations of marine species’ ranges with climate change are often attributed to oxygen limitation in warming oceans. Here we report unique metabolic temperature sensitivities for the myriad of vertically migrating oceanic species that daily cross depth-related gradients in temperature and oxygen. In these taxa, selection favours high metabolic activity for predator–prey interactions in warm shallow water and hypoxia tolerance in the cold at depth. These diverging selective pressures result in thermal insensitivity of oxygen supply capacity and enhanced thermal sensitivity of active metabolic rate.
