Armor Or Withdraw? Likely Litigation And Potential Adjudication Of Shoreland Conflicts Along Michigan's Shifting Great Lake Coasts, Richard K. Norton, Guy A. Meadows, Oday Salim, Matthew Piggins, Phillip Washburn, Lauren Ashley Week

Michigan Journal of Environmental & Administrative Law

Michigan enjoys along its inland seas, the Laurentian Great Lakes, one of the longest coastlines in the U.S. Much of that shoreline is privately owned. Because of a confluence of development pressures and irrepressible physical dynamics, growing numbers of Great Lakes shoreland properties, built on shifting sandy shores, are at heightened risk of loss from coastal storm surge, inundation, erosion, and shoreline recession. In response, property owners are installing extensive hardened shoreline armoring structures like seawalls and revetments to arrest those erosional processes. Those structures, however, will substantially impair, if not ultimately destroy, the state’s natural coastal beaches and other …

How Many More Brazilian Environmental Defenders Have To Perish Before We Act? President Lula's Challenge To Protect Environmental Quilombola Defenders, Sarah Dávila A. Apr 2023

How Many More Brazilian Environmental Defenders Have To Perish Before We Act? President Lula's Challenge To Protect Environmental Quilombola Defenders, Sarah Dávila A.

William & Mary Environmental Law and Policy Review

The Global South has been historically marginalized and continues to suffer from systemic oppression, impeding the realization of their human rights. Afro-descendants and other minority populations in the Global South live in disproportionately environmentally unsafe conditions and are disproportionately more vulnerable to climate change and environmental harm. One of those populations are Quilombolas. Quilombolas are Brazilian Afro-descendant communities who continue to fight to protect their community rights to ancestral lands, natural resources, and survival as a people. The Brazilian government under former Brazilian President Bolsonaro engaged in a persistent and systematic campaign to target, attack, and kill defenders, including Quilombola …

Exploring The Use Of Bidirectional Text Messaging Reminders To Increase Colorectal Cancer Screening Rates In Patients Prescribed Cologuard®, James Harris

Translational Projects (Open Access)

Meaningfully engaging with patients through technology is becoming increasingly important in healthcare. Mailed letters, phone calls, and even one-way text messaging or some combination of these have all been utilized to communicate with patients regarding preventative healthcare screening measures, with varying degrees of success. While many studies have examined the use of bidirectional text messaging (BTM) to engage patients regarding mammograms, cervical cancer screening, and other issues, very little literature exists on BTM concerning colorectal cancer (CRC).

Therefore, this project sought to examine the impact of BTM between two primary care clinics and their respective patients who were prescribed and …

Disability And Transnational Arbitration: Human Rights Linkages And Reasonable Accommodations, Ilias Bantekas Apr 2023

Disability And Transnational Arbitration: Human Rights Linkages And Reasonable Accommodations, Ilias Bantekas

William & Mary Business Law Review

Disability intersects with arbitration as regards the mental capacity of a party to enter into an arbitration agreement, the appointment of arbitrators with disability and grounds for removal thereof, accommodations during arbitral proceedings for arbitrators and counsel with disabilities, as well as the costs for all appropriate accommodations. This Article demonstrates that the right to a fair trial, which is universally recognized in arbitration, dictates that parties and arbitral institutions be free to select arbitrators of their choice, and no impediments may be imposed against arbitrators with disabilities other than that they are able to fulfill the functions of their …

Impediments To Renewed And Reinvigorated Antitrust Enforcement, Edward D. Cavanagh Apr 2023

Impediments To Renewed And Reinvigorated Antitrust Enforcement, Edward D. Cavanagh

William & Mary Business Law Review

Antitrust Division head Jonathan Kanter recently proclaimed that “the era of lax enforcement is over, and the new era of vigorous and effective antitrust law enforcement has begun.” Federal enforcers have indeed been active; the DOJ has sued Google in two separate actions, and the FTC has brought an action against Facebook.

While bringing these cases is an important first step to achieving a more robust antitrust enforcement regime, a significant obstacle to an antitrust renaissance remains—overcoming the strong gravitational pull of Chicago School theory that has dominated antitrust thought for the past half-century. Chicago School principles have not kept …

Cancer cell-intrinsic mechanisms affecting radiation immunomodulation could be exploited to optimize systemic effects of localized radiation. Radiation-induced DNA damage is sensed by cyclic GMP-AMP synthase (cGAS), which ultimately activates stimulator of interferon (IFN) genes (STING). Resultant expression of soluble mediators such as CCL5 and CXCL10 can facilitate recruitment of dendritic cells and immune effector cells into the tumor. The primary objectives of this study were to determine the baseline expression levels of cGAS and STING in OSA cells and evaluate the dependence of OSA cells on STING signaling for eliciting radiation-induced expression of CCL5 and CXCL10. cGAS and STING expression, …

The proposed Anthropocene Global Boundary Stratotype Section and Point (GSSP) candidate site of West Flower Garden Bank (27.8762°N, 93.8147°W) is an open ocean location in the Gulf of Mexico with a submerged coral reef and few direct human impacts. Corals contain highly accurate and precise (<±1 year) internal chronologies, similar to tree rings, and their exoskeletons are formed of aragonite and can be preserved in the rock record. Here we present results from a large Siderastrea siderea coral (core 05WFGB3; 1755–2005 CE) sampled with annual and monthly resolutions that show clear markers of global and regional human impacts. Atmospheric nuclear bomb testing by-products (14C, 239+240Pu) have clear increases in this coral starting in 1957 for 14C and the first increase in 1956 for 239+240Pu (potential bases for the Anthropocene GSSP). Coral δ13C declined especially after 1956 consistent with the Suess effect resulting from the burning of fossil fuels. Coral skeletal δ15N starts to increase in 1963 corresponding with the increase in agricultural fertilizers. Coral Hg concentrations (1933–1980) loosely track fluctuations in industrial pollution and coral Ba/Ca increases from 1965–1983 when offshore oil operations expand after 1947. Coral temperature proxies contain the 20th-century global warming trend whereas coral growth declines during this interval.

Corals are unique in the suite of proposed Anthropocene Global Boundary Stratotype Section and Point (GSSP) archives, as living organisms that produce aragonite exoskeletons preserved in the geological record that contain highly accurate and precise (<±1 year) internal chronologies. The GSSP candidate site North Flinders Reef in the Coral Sea (Australia) is an offshore oceanic reef, and therefore less vulnerable to local human influences than those closer to the coast. Here, we present geochemical records from two Porites sp. corals sampled at an annual to pluri-annual (i.e. 3–5 years) resolution that shows clear global and regional human impacts. Atmospheric nuclear bomb testing by-products (14C,239+240Pu) show a clear increase in the Flinders Reef corals coincident with well-dated nuclear testing operations. By contrast, the radionuclides 241Am and 137Cs are present at low or undetectable levels, as are spheroidal carbonaceous fly-ash particles. Coral δ13C shows centennial variability likely influenced by growth effects in the 18th century and with a progression to lower values starting in 1880 CE and accelerating post-1970 CE. The latter may be related to the Suess effect resulting from 13C-depleted fossil fuel burning. Coral δ15N decreased between 1710 and 1954 CE with a reversal post-1954 CE. Coral temperature proxies indicate prominent centennial variability with equally warm conditions in the 18th and end of 20th century. However, the exact mechanisms responsible for the mid-20th century changes in these parameters need to be scrutinised in further detail. Plain Language summary: This work proposes a candidate natural archive for the official marker of the Anthropocene that geologists will use to mark this important interval in time. Our candidate is a live coral from North Flinders Reef in the Coral Sea (Australia), located 150 km east of the Great Barrier Reef, a location that is remote from direct local human influences. Corals are a unique archive of tropical ocean change because they incorporate the geochemical signature from seawater into their limestone skeleton during their long life-spans. Here we investigated a number of geochemical markers in yearly growth layers of the corals to define several markers for the Anthropocene based on changes in temperature, water chemistry, chemicals from pollution and fertilisers, radioactive products from nuclear bomb testing, and by-products from burning fossil fuels. We have detected clear human influences in several of these markers.

Not Just Income: The Enabling Role Of Institutional Confidence And Social Capital In Household Energy Transitions In India, Anmol Soni, Anomitro Chatterjee Apr 2023

Not Just Income: The Enabling Role Of Institutional Confidence And Social Capital In Household Energy Transitions In India, Anmol Soni, Anomitro Chatterjee

Faculty Publications

Transitioning to cleaner forms of cooking energy is a key facet of sustainable development. Despite numerous programs, the transition in developing countries remains slow and sometimes non-existent. Even when cleaner sources of cooking energy are adopted, their use is often temporary, with households continuing to use traditional energy sources. While literature identifies the importance of affordability and access, factors such as trust in local institutions and social capital remain under-explored. We aim to fill this gap by using household-level panel data to estimate drivers of clean cooking technology adoption and sustained fuel use in India. We add to the current …

Rothman Institute Papers

Study design: Single-center retrospective cohort.

Purpose: To compare surgical outcomes of patients based on lumbar drain variables relating to output and duration.

Overview of literature: The use of drains following lumbar spine surgery, specifically with respect to hospital readmission, postoperative hematoma, postoperative anemia, and surgical site infections, has been controversial.

Methods: Patients aged ≥18 years who underwent lumbar fusion with a postoperative drain between 2017 and 2020 were included and grouped based on hospital readmission status, last 8-hour drain output (<40 mL cutoff), or drain duration (2 days cutoff). Total output of all drains, total output of the primary drain, drain duration in days, drain output per day, last 8-hour output, penultimate 8-hour output, and last 8-hour delta (last 8-hour output subtracted by penultimate 8-hour output) were collected. Continuous and categorical data were compared between groups. Multivariate logistic regression analysis and receiver operating characteristic (ROC) analysis were performed to determine whether drain variables can predict hospital readmission, postoperative blood transfusions, and postoperative anemia. Alpha was 0.05.

Results: Our cohort consisted of 1,166 patients with 111 (9.5%) hospital readmissions. Results of regression analysis did not identify …

Discrepancies In The Estimation Of Vaping Rates Among College Students, Cameron J. Klug Apr 2023

Discrepancies In The Estimation Of Vaping Rates Among College Students, Cameron J. Klug

Honors Thesis

The use of nicotine inhalation products among college students is an imminent public health issue, with young-adult populations being particularly likely to take up nicotine use during their college years (American College Health Association, 2021). Even with elevated levels of nicotine vapor product use in college populations, existing surveys may still underestimate the prevalence of nicotine use among this population. This study aimed to address this issue by conducting a survey of college students at the University of South Dakota, using a peer-to-peer approach to reduce social desirability bias. The study’s survey directly stated it was being issued and analyzed …

Oral Health In Relation To The Covid-19 Pandemic, Anika L. Gram Apr 2023

Oral Health In Relation To The Covid-19 Pandemic, Anika L. Gram

Honors Thesis

Oral health has seen significant changes through the Covid-19 pandemic. Many people experienced the lifestyle alteration of wearing a mask for a major portion of their day-to-day life, and some went to the dentist significantly less than they did pre-pandemic. The literature review explores dental practices during the Covid-19 pandemic. It also examines mask-wearing behaviors both before and during the pandemic and the research that has been conducted previously regarding the potential effects of mask-wearing. Despite the decrease in use of masks post-pandemic, many healthcare professionals continue to wear masks daily. Additionally, in the event of future disease outbreak, it …

Horizontal Transmission Of Salmonella Typhimurium Among German Cockroaches And Possible Mechanisms, Madison Anne Mond Apr 2023

Horizontal Transmission Of Salmonella Typhimurium Among German Cockroaches And Possible Mechanisms, Madison Anne Mond

Honors Thesis

Cockroaches, including the German cockroach (Blattella germanica), are common urban pests that have been linked epidemiologically and experimentally to the transmission of bacteria that cause enteric disease in humans and animals, such as the widespread pathogen Salmonella enterica serovar Typhimurium. While recent strides have been made in understanding the mechanisms and dynamics of Salmonella infection of the cockroach gut, much about this vector-pathogen relationship remains unknown. A particular knowledge gap is understanding the ecology of how S. Typhimurium is acquired, maintained, and spread by cockroaches. The behavioral ecology of German cockroaches is unique among insect vectors. They closely share shelter …

Validation Of A Brief Measure For Complicated Grief Specific To Reproductive Loss, Cara Buskmiller, Kathryn R Grauerholz, Jennifer Bute, Maria Brann, Michaelene Fredenburg, Jerrie S Refuerzo

Faculty, Staff and Student Publications

Objective

Complicated grief reactions follow some pregnancy outcomes, like miscarriage, stillbirth, neonatal death, infant death, selective reduction, or termination of pregnancy. Stigma can delay treatment and worsen outcomes. Screening tools such as the Edinburgh Postnatal Depression Scale detect complicated grief poorly, and specific tools for prolonged or complicated grief after a reproductive loss are cumbersome. In this study, a five-item questionnaire to detect complicated grief after reproductive loss of any type was designed and preliminary validated.

Methods

A questionnaire patterned after the extensively validated Brief Grief Questionnaire (BGQ) was created by a group of physicians and lay advocates to employ …

Analysis Of Small Lake Water Level Fluctuations By Remote Sensing In Twin Lake, Michigan., Eric Carballido

Masters Theses

Accurate analysis of lake level fluctuations is critical for water resources management. However, it remains a challenge to estimate lake level fluctuations in ungauged small lakes such as East Twin Lake. Located in Twin Lake, Michigan, East Twin Lake has experienced a drastic reduction in water surface area since 2020. To understand the nature of water level fluctuations in East Twin Lake, this study utilized a combination of Landsat and National Agriculture Imagery Program (NAIP) data to make surface water area estimations of East Twin Lake for the period of 1993-2022. In total, 27 years of water surface area estimations …
