By engaging in analyzing opposing viewpoints, students do more than just develop a broader understanding of other perspectives. Rather, students are forced to more clearly define and evaluate their own convictions. Moreover, by shifting the focus from a professor’s discussion of controversial opposing viewpoints to a student’s self-discovery, examining controversy remains an essential component of the classroom.

How Many Supreme Court Justices Can Stand On The Point Of A Needle? Originalist Scholarship, Political Neutrality, And Other Constitutional Nonsense, Stephen M. Feldman

In the 1935 article, "Transcendental Nonsense and the Functional Approach," Felix Cohen compared formalist legal reasoning, as practiced by traditional legal scholars and Lochner-era Supreme Court justices, to the philosophical musings of scholastic theologians. Unconnected to empirical reality, formalist legal reasoning was as nonsensical as a disquisition on “‘[h]ow many angels can stand on the point of a needle?’” Nowadays, originalist scholars are similarly engaged in nonsense. These scholars defend, refine, and practice originalist methods of constitutional interpretation as if the Supreme Court justices truly decided cases in accordance with the theory. Regardless, the justices—even the avowed originalists—do not consistently …

Harmless In Name Only: Prosecutorial Misconduct And The Right To A Fair Trial, Jennifer Brinkman

Prosecutorial misconduct during trial—particularly improper questioning of witnesses and improper argument—occurs in front of the jury and directly shapes its deliberations. Yet appellate courts routinely dismiss such misconduct as “harmless error,” allowing convictions to stand even when prosecutors violate defendants’ rights. This Article contends that the harmless error framework both underestimates the impact of misconduct on jurors and undermines the Constitutional guarantee of a fair trial. It proposes that certain instances of misconduct that occur during trial should be classified as structural error, requiring automatic reversal. This would protect defendants’ right to a fair trial and maintain the integrity of …

Anti-discrimination law assumes that discrimination can be detected and rectified, that the evidentiary burden of the plaintiff can in fact be met. But the evolutionary logic of AI training causes it to target vulnerable groups, lie about reasoning, and above all resist detection. Because of hidden core prompts in generative AI systems, and how those prompts interact with the nature of AI training and deployment, AI will often actively hide discrimination rather than surface and address it. Stopping this will be difficult. At present, neither humans or AI can detect this emergent dark-pattern behavior. Without legal intervention, the broad use …

Economic and legal literature has increasingly focused on how the American legal system fails workers. One way it does so is through employee noncompetition agreements (“NCA” or “noncompete”) that limit a worker’s ability to join another company, often for better compensation and/or more responsibility. Some states enforce NCAs if they are reasonable in scope, geography, and duration; others either prohibit their application to certain types of workers or (as in California) outright prohibit them in most circumstances. More narrowly, new empirical literature about the behavioral effects of unenforceable noncompete agreements raises new questions about the behavioral impact on workers.

In 2024 and 2025, Alabama executed eleven people. During this time and in the years leading up to it, the State botched multiple lethal injections. Seeking an ostensibly constitutional way to continue carrying out executions, Alabama introduced death by nitrogen gas suffocation. The problems with lethal injection are not unique to Alabama, but Alabama was the first to adopt and use the novel nitrogen gas method, despite concerns from medical professionals, the public, and inmates themselves. Alabama put little to no protocol in place for inmates to exercise their statutory right to elect this method, leading to confusion and harm. …

This Note examines geofence warrants and their ongoing threat to constitutionally protected rights such as privacy, speech, and assembly. Part I will provide background information on geofence warrants and examine the prominent justifications for the use of the warrants. Part II will examine how law enforcement’s use of geofence warrants threatens citizens’ constitutionally protected fundamental rights like privacy and reproductive rights. Claiming this duality—a civilized militancy—from their patron goddess Athena, an ancient Athenian citizenry could rationalize imperial conquest as democratic goodwill. Millennia later, the United States, seeking subtle proclamation of classical succession, crafted their national personification Columbia from the mold of Athena. From the Civil War until the First World War, Americans called on Columbia to symbolically sanction and spectacularize their own imperial ascent. Data integration represents a key area of research for analyzing the rapidly growing volume of high-dimensional biological data across sources, stages, and modalities. To model and understand these complex, often non-linear relationships, deep learning has become an increasingly powerful tool. Here, we present two novel deep learning frameworks that address distinct but complementary integration challenges. The first framework aligns single-cell omics data across temporal stages, and the second bridges imaging and omics modalities to generate patient-level molecular profiles.

This paper advances a biologically grounded philosophy of leadership through the lens of Natural Horsemanship. It reframes leadership as an embodied, sentient process rather than a purely cognitive or behavioral construct. Drawing from neuroscience, affective biology, sociology, and human resource development (HRD), it proposes that the horse–human relationship provides a living model for relational intelligence. The horse’s exquisite attunement to human emotion— mediated through limbic regulation and bio-behavioral synchrony—reveals that influence arises not from authority but from coherence. Leadership, like horsemanship, is a reciprocal act of co-regulation in which trust, safety, and communication are revealed through physiology before language. By …

This research addresses the “door problem” in FPS games, where poorly designed transitions cause player hesitation and camping, disrupting game pacing. By reframing this issue as a challenge of transition design, this study explores how movement into gameplay spaces determines player commitment and flow. Through a Fallout 4 artifact, this project implements best practices focused on clarifying objectives, balancing risk and reward, optimizing information and flow, and integrating diverse challenges. Playtest results from twelve participants show that transitions built on these practices did not produce widespread camping or stalling at combat entries, while two encounter-internal areas remained as friction points …

This dissertation consists of essays on how family resource allocation and cultural values shape innovation, inequality, and long-run economic development. Across the chapters, I combine quantitative modeling and empirical analysis to understand the determinants of inequality and long-run growth.

Chapter 1 studies how parental fertility and bequest decisions affect children’s potential to become entrepreneurs when financial barriers exist. Motivated by evidence that high-income parents tend to have fewer children and leave larger bequests and allocate more resources per child, I develop an overlapping-generations model with endogenous fertility, bequests, and occupational choice, calibrated to U.S. data. A collection of unmanned aerial systems (UAS) can be networked as a cooperative wireless sensor array to geolocate an unknown-location RF emitter using time-based measurements. In operation, however, environmental multipath and hardware errors in sensor positioning and timing can degrade emitter localization accuracy and limit the practicality of single-snapshot solutions. This dissertation evaluates time-of-arrival and time-difference-of-arrival (TOA/TDOA) geolocation for cooperative UAS arrays under realistic error sources and develops geometry-control strategies that actively reduce localization uncertainty through iterative UAS repositioning.

This research investigates how mid area design in Tactical Team-based First-Person Shooter maps shapes gameplay flow, team strategy, and overall map balance. Focusing on mid control as a central factor in information gathering, rotation flexibility, and positional dominance, the study analyses how layout, connectivity, and sightline structure influence fair contest between teams. The artifact was tested with 20 participants across two playtest sessions. Results suggest that the mid-area was perceived as strategically important, and experienced players showed a stronger recognition of mid-area control as impactful on round outcomes. This thesis investigates spatial reuse in single-player level design through the lens of Self-Determination Theory (SDT), addressing two core challenges: excessive repetition and player disorientation. To resolve these challenges, five best practices are proposed: mixing new and reused content at a macro level, establishing clear spatial identities, varying gameplay upon revisits, altering flow within reused spaces, and leaving visible signs of player impact. These practices were applied in a custom-built quest level for Starfield and evaluated through playtesting combining behavioural observation and surveys. I here critically discuss “the Selection Problem”, a vexing problem for metaphysicians who are realists about fictional entities and who further claim that such entities are identified with nonactualia. The Selection Problem arises due to the fact that the nonactualist is forced to defend the view that ficta are somehow discovered, or selected, by authors who then present them to us so we may entertain their exploits. The title of this collection, Totality: An Eclipse, and the titles of each of its three sections (“First Contact,” “Second Contact,” and “Third Contact”) combine to help illustrate my experience with grief as a solar eclipse: totality is the maximum phase of a total solar eclipse; first contact is when the sun just begins to disappear in the sky; second contact is when there is complete darkness in the sky; and third contact is when daylight finally returns. Women At Work: Women In Economic Crises In German Film, Anthony J. Capone

The films Joyless Street (1925), The Marriage of Maria Braun (1979), and The Drifter (2010) depict the influence of economic crises in restricting women’s flexibility and the shaping of their social roles. Through the themes of survival, resistance, and agency, the female protagonists navigate the economic hardships such as scarcity, poverty, and unemployment by using labor, sexuality, and personal relationships. Spanning the eras of post-World War 1, the Wirtschaftswunder, and the late 2000s, these women emerge as individuals, who are not weak, but rather constrained by the economic structures of their society.

A Palatable Identity: Turkish-German Integration Through Cuisine, Film And Hip-Hop, Thomas Goldsborough

This paper explores how Turkish-German identity is constructed and negotiated through cultural production in contemporary Germany. It argues that belonging is shaped less by formal political inclusion than by processes of visibility, commodification, and marketability. Through case studies of döner kebab culture, Turkish-German cinema, and hip-hop, the paper shows how minority identity is made legible to the mainstream by being aestheticized and adapted to familiar forms. While these processes enable recognition and creative expression, they also reveal how acceptance is often contingent on profitability and cultural “palatability” rather than genuine social integration.

Seasonal snow is an integral component of global hydrological systems, global energy budget and Earth's climate. As an important part of many Earth systems, seasonal snow is also an essential source of water for many human populations and ecosystems around the world.
