In Our Glory: A Memory Exhibition, Dayquan Moeller May 2023

In Our Glory: A Memory Exhibition, Dayquan Moeller

Whittier Scholars Program

When Susan Sontag wrote in 1977, “to collect photographs is to collect the world,” she could not have predicted how ubiquitous photography would become (Sontag 1977). Not only are we exposed to thousands of photographs each day, but we likely take dozens of them ourselves. In our photo-saturated world it is easy to take these candid images for granted, yet within them lies deep truths.

In Our Glory is an audio-visual installation that seeks to unravel these truths. It is based on interviews with individuals asked to describe a photograph of themselves, with one caveat: they are not allowed to …

Pandemic Review: South Los Angeles, Madeline Carmella Acosta May 2023

Pandemic Review: South Los Angeles, Madeline Carmella Acosta

Whittier Scholars Program

IMPORTANCE The COVID-19 pandemic has deepened the discussion on social inequality and vulnerabilities of the Black, Indigenous, and People of Color (BIPOC) community. The understanding is that inequality is a multifaceted issue that stems from the historical mistreatment of BIPOC individuals—their sociodemographic and economic backgrounds are at the most risk in population studies. Many predictors of contracting COVID-19 included employment status (ability to work from home), education level, income (wealth), and housing conditions (environment) (Rozenfeld et al., 2020). Contracting COVID-19 in South Los Angeles was more likely to happen among those from racial and ethnic minorities and those living in …

Outside Inside, Frank I. Michelman May 2023

Outside Inside, Frank I. Michelman

Texas A&M Law Review

“Outsider scholarship,” we hear, “is characterized by a commitment to the interests of people of color and/or women, by rejection of abstraction and dispassionate ‘objectivity,’ and by a preference for narrative and other engaged forms of discourse.” Off the bat, we think: “Delgado!”, “Rodrigo!” Rightly, we raise our hats and cheer.

Delgado Replies, Richard Delgado

Texas A&M Law Review

In Outside Inside, Frank Michelman gives me a pat on the back for two articles setting out the case for a rotten social background (“RSB”) defense. Ultimately, however, my efforts, in his eyes, at best amount to the proverbial good old college try. Because of a host of “establishment concerns,” mainstream judges will shy away from it, even in the most compelling cases. Unless criminal defendants qualify for an accepted defense such as insanity or diminished capacity, judges will see a severely deficient childhood as bearing only on the morality of punishment, not its legality.

Simplicity And Complexity In Law And In Markets, Saul Levmore May 2023

Simplicity And Complexity In Law And In Markets, Saul Levmore

Texas A&M Law Review

Richard Epstein’s Simple Rules for a Complex World is true to its title and to the author’s demonstrated genius over a long career. It is a libertarian-oriented enterprise in that it requires the reader to share in the belief that government programs are often wasteful and subject to unattractive interest group pressures and corrupt bureaucracies. More generally, Simple Rules is framed against a background in which the reader must share the libertarian view that individuals can and should be trusted to look after themselves and to make their own choices. Epstein likes “simple” rules; these include strict liability, a flat …

Levmore On Simple Rules, Richard A. Epstein

Texas A&M Law Review

In 1995, the Harvard University Press published my book Simple Rules for a Complex World, which set out my world view on a wide range of substantive issues related to, on the private side, the law of property, contract, tort, and restitution; and on the public side, the law of eminent domain and taxation. The framework that I developed in that book relies on key private law baselines to assess, among other things, the efficiency and desirability of various forms of legislation that play off these common law rules dealing with environmental law, land use regulation, and labor law. …

Knowledge Institutions And Democratic Erosion: The Invaluable Contributions Of Tom Ginsburg, Vicki C. Jackson May 2023

Knowledge Institutions And Democratic Erosion: The Invaluable Contributions Of Tom Ginsburg, Vicki C. Jackson

Texas A&M Law Review

The work of Tom Ginsburg, a leading scholar of comparative constitutional studies, is influential around the world and spans a very wide range of topics. He has played an absolutely essential role in establishing a database of constitutional provisions, both around the world and over time, that has fueled his own research, including his co-authored book on the endurance of national constitutions, and the research of other comparative constitutional scholars. He has contributed important insights about many different areas of comparative constitutional study. In much of his work he has been concerned with the relationship between political forces and political …

Universities As Knowledge Institutions: A Reply To Professor Jackson, Tom Ginsburg

Texas A&M Law Review

I am grateful for Professor Vicki Jackson’s engagement with my scholarly work, and I want to take this opportunity to react to some of hers in one of the areas in which our concerns overlap. As Professor Jackson describes, in recent years she has been working on the important topic of what she calls “knowledge institutions in constitutional democracy.” This focus is appropriate as it addresses a very central source of the current malaise plaguing many constitutional democracies around the world. The crisis of democracy in the 21st century is not only one of economic inequality, institutions, or political polarization: …

Reflection, Deliberation, And Dialogue: Stipanowich's Contribution To Dispute Resolution, Jacqueline Nolan-Haley May 2023

Reflection, Deliberation, And Dialogue: Stipanowich's Contribution To Dispute Resolution, Jacqueline Nolan-Haley

Texas A&M Law Review

During the late 70s through the early 21st century, the Modern Progressive Era brought into focus a great concern with the manifest lack of justice in law and society. The urgency of the need for justice spawned multiple reform movements. Along with feminism, law and economics, and others, dispute resolution (often referred to as Alternative Dispute Resolution (“ADR”) or the “Quiet Revolution”) is recognized as a reform movement which lends itself to progressive persuasion. Professor Thomas Stipanowich is a significant scholar of the Modern Progressive Era. Professor Stipanowich has shaped and internationalized dispute resolution theory and practice for more than …

The Right To Have Property, Joseph William Singer May 2023

The Right To Have Property, Joseph William Singer

Texas A&M Law Review

Laura Underkuffler has kindly commented on my progressive, social- relations approach to property and property law. I feel humbled, honored, and seen. She notices the core moral commitments manifested in that work. She focuses on my scholarship on discrimination in public accommodations, the violent dispossession and persisting sovereignty of Native nations, and the obligations of the rich toward the poor. She emphasizes my willingness to take a moral stance. And she comments on the fact that I attempt to persuade readers about what the law should be, not just by interpreting authoritative texts, but by making normative arguments that are …

Fineman Speaks To Dobbs, Deborah Dinner May 2023

Fineman Speaks To Dobbs, Deborah Dinner

Texas A&M Law Review

It is an honor to comment on the scholarship of the preeminent legal theorist Martha Fineman. Throughout her pioneering career, she has challenged liberal feminist ideals grounded in anti-discrimination principles. She shows how sex neutrality and formal equality in law and policy fail to realize justice for women and children. In the last few decades, she has broadened her analysis to a critique of autonomy as a foundational ideal in law. In its place, she offers an account of the state’s obligation to respond to universal human vulnerability. As an entirety, I have found Fineman’s scholarship important to my own …

Response To Professor Dinner, Martha Albertson Fineman

Texas A&M Law Review

I want to thank the Texas A&M Law Review for including my work in this special Issue and express my appreciation to Professor Dinner for her thoughtful comments concerning the evolution of my scholarship. Professor Dinner raises the question of whether that earlier work is relevant to the Dobbs v. Jackson Women’s Health Organization opinion, specifically, and to broader issues of reproductive justice, more generally. For me, Dobbs illustrates—once again—how our American obsession with both individual rights and Supreme Court jurisprudence can distort our sense of the possibilities for achieving social (or reproductive) justice. I see my work as an …

Reflecting On The Foundations Of Latinx Civil Rights: Looking Back And Looking Forward, Rachel F. Moran

Texas A&M Law Review

I am grateful to Dean Kevin Johnson for his thoughtful and generous review of my scholarship on Latinx civil rights. Dean Johnson has been tremendously influential in the field, and he has led by example through his long tenure as dean at UC Davis School of Law. So his insightful assessment of my contributions is especially meaningful. Like all good retrospectives, Dean Johnson’s got me thinking—not only about the past but also the future. So much has changed since I began writing about Latinx issues at the beginning of my career, and yet much remains the same. Because demography is …

The Siren Of San Francisco, Emily Gage May 2023

The Siren Of San Francisco, Emily Gage

Whittier Scholars Program

The Siren of San Francisco is a story I have been interested in telling for the longest time focusing on the coming of age of the main character, Mia, and how she deals with change through gaining the power of shapeshifting. A lot of the graphic novel explores the relationships between Mia, her mom, and her close friends and how her relationships with them change during this transitional period.

The driving force behind this story was my enduring interest in relationships, identity, feminism, and how people can shape the people around them, including themselves. I approached this particular story from …

The concept of the Internet of Things (IoT) spans decades, and the same can be said for its inclusion in healthcare. The IoT is an attractive target in medicine; it offers considerable potential in expanding care. However, the application of the IoT in healthcare is fraught with an array of challenges, and also, through it, numerous vulnerabilities that translate to wider attack surfaces and deeper degrees of damage possible to both consumers and their confidence within health systems, as a result of patient-specific data being available to access. Further, when IoT health devices (IoTHDs) are developed, a diverse range of …

Legal Writing Handbook For Clinical Students, Nan Haynes May 2023

Legal Writing Handbook For Clinical Students, Nan Haynes

Books

This handbook is for upper-level students enrolled in a clinic, who are expected to draft legal memorandums, briefs, client letters, and pleadings with minimal supervision. Each chapter focuses on a single writing skill. The exercises and examples consistently and cogently employ the techniques and devices advocated in the book.

Clinical students learn by doing. Still, their legal writing experience is limited, so guiding them through written assignments is challenging. They simultaneously need specific feedback on legal writing from their professors, and the opportunity to do as much as possible on their own. I wrote this handbook with that challenge in …
