A huge number of tort suits in the United States are captioned Plaintiff & Spouse v. Defendant. Why? The answer is at once completely obvious and deeply puzzling. The plaintiff’s spouse is part of the case because, in almost every U.S. state, she has a claim against the defendant too—not for battery or negligence, as her spouse might, but for the loss of her spouse’s “consortium.” And yet, it’s not at all clear why a spouse should have a tort claim of this kind. Gotta Get Those Ill-Gotten Gains: Improving The Ftc's Authority To Seek Disgorgement In Antitrust Cases, Kathryn Buggs

Disgorgement is an equitable monetary remedy that requires a defendant to give up all ill-gotten gains from their illegal conduct. Unlike damages, which can be compensatory, deterrent, or even punitive in nature, disgorgement focuses primarily on deterring future illegal conduct. It relies on the simple moral premise that wrongdoers should not be allowed to retain the profits of their wrongdoing. Especially in antitrust litigation involving complex, multilayered supply chains, damages can underestimate the true harm suffered as a result of anticompetitive conduct. Disgorgement, if calculated properly and litigated thoughtfully, has the potential to provide redress for the full amount of …

The purpose of this research study is to analyze whether there are similarities and differences between how conservative organizations and leaders against integration in the 1960’s and Critical Race Theory today discussed and reacted to these advances for civil rights. While there are drastic differences in the context of both eras, arguments used to justify segregation are still used to justify banning Critical Race Theory. Justice is supposed to be a consistent, fair ideal of our society. If an individual is going to face punishment, there should be reasons why they receive the punishment they do, and two people who commit similar offenses should be punished similarly. These societal ideals are also embraced by the legal profession. Unfortunately, the current practice of plea bargains creates potential problems for our ability to satisfy that ideal of justice. Prosecutors have significant discretion in offering plea bargains. This discretion opens the door for potential arbitrariness. Introduction:
Dysphagia, a complication of traumatic brain injuries (TBIs), can lead to death. Cervical collar (c-collar) restriction may increase the risk for dysphagia. The objective was to determine how c-collars affect dysphagia rates.
Methods:
This retrospective cohort study included geriatric TBIs or cervical spine injuries (January 2016 to December 2018) at a Level 1 trauma center. Outcomes (dysphagia, aspiration, and respiratory failure) were compared by c-collar placement.
Results:
There were 684 patients: 21.5% had a c-collar and 78.5% did not. Demographics, injury severity score, and Glasgow Coma Scale were comparable. Dysphagia (53.7% vs. 39.3%, p = .002) and respiratory failure …

The American Cancer Society estimates that in 2023, 1,958,310 new cancer cases and 609,820 cancer deaths will occur in the United States [16]. A promising therapeutic option that has been supported by recent clinical trials is the use of oncolytic viruses to treat malignant tumors. The mechanism of action of existing treatments, such as chemotherapy, radiotherapy, and surgery, differs from that of oncolytic virus therapy because oncolytic viruses are able to affect cancer cells with specificity, minimizing side effects. When infecting a normal, non-cancerous cell, oncolytic viruses do not replicate, leaving healthy cells unaffected. In tumor cells, oncolytic viruses will …

Peripheral arterial occlusive disease (PAOD) is characterized by atherosclerosis, which is the buildup of plaque, consisting largely of cholesterol, in the arterial walls. This plaque accumulation eventually blocks blood flow to the limbs, causing symptoms such as intermittent claudication and tissue death in cases of critical limb ischemia. The body compensates for the reduced perfusion by enlarging pre-existing bypass arteries, known as collaterals, in a process called arteriogenesis. However, in many cases, collateral networks constructed through arteriogenesis fail to enlarge sufficiently or function effectively in patients. Offshore wind is a developing industry in the Central Coast with the advent of the future offshore wind project planned off the north coast of San Luis Obispo County. This senior design project aligns with the recently leased wind energy project as a detailed study on the structural design, geotechnical design, and construction of a single 14 MW floating offshore wind turbine (FOWT) located 40 km NW of Morro Bay (NOAA buoy 46028). I came to graduate school thinking all I needed to become a stronger writer was an understanding of craft and technique. To my dismay, I discovered that craft and technique, while helpful and important, are not magic bullets. Instead, I discovered that the main obstacle to my growth as a writer is my own self. This thesis discusses my battle with perfectionism and fear of the unknown in the context of writing my thesis play, Anatomy 101 (A Mysterium), and the subsequent production that occurred at The Global Campus Theatre in Fayetteville, AR in March of 2023.

Bone marrow-derived mesenchymal stem cells (BM-MSC) are reported to induce beneficial effects in the heart following ischemia, but a loss of these cells within hours of implantation could significantly diminish their long-term effect. We hypothesized that early coupling between BM-MSC and ischemic cardiomyocytes through gap junctions (GJ) may play an important role in stem cell survival and retention in the acute phase of myocardial ischemia. To determine the effect of GJ inhibition on murine BM-MSC in vivo, we induced ischemia in mice using 90 min left anterior descending coronary artery (LAD) occlusion followed by BM-MSC implantation and reperfusion. Over the past 37 years since the term greenwashing was coined, there have been sparse attempts to regulate this deceptive environmental marketing. The Federal Trade Commission (FTC) created its Guides for the Use of Environmental Marketing Claims, also known as the Green Guides, in 1992. The Guides have been revised on three separate occasions – 1996, 1998, and 2012 – in an attempt to remain relevant with the proliferation of environmental marketing claims and trends. The Healthier Community for Generations to Come report provides Sankofa Community Development Corporation with programmatic recommendations to assist in the revitalization of the Lower Ninth Ward (LNW). This report draws on extensive research in urban planning best practices to propose strategies that promote economic revitalization, housing sustainability, community health, and environmental resilience. The research was guided by an Urban Land Institute (ULI) Technical Assistance Panel (TAP) which engaged the LNW community to inform recommendations. This thesis examines the historical and cultural meanings of the term eunuch and challenges its common definition as simply a castrated cisgender male. Through a comparative analysis of examples from ancient Mesopotamia, Greece, Rome, Byzantium, Europe, and colonial India, the study demonstrates that the label has been applied to a diverse range of individuals, including castrated men, third-gender identities, gender-variant religious figures, intersex individuals, and people assigned female at birth who adopted alternative gender roles. By exploring the intersections of gender, biological sex, religion, politics, and colonialism, the thesis argues that the term eunuch functions as an overly broad and …

This daunting association has raised concerns for Biology professors when considering why students are not succeeding at an acceptable rate. We investigated topics such as social, economic, and other background history as a baseline to enhance course outlines. Purpose
Recognizing sport-related concussion (SRC) is challenging and relies heavily on subjective symptom reports. An objective, biological marker could improve recognition and understanding of SRC. There is emerging evidence that salivary micro-ribonucleic acids (miRNAs) may serve as biomarkers of concussion; however, it remains unclear whether concussion-related miRNAs are impacted by exercise. We sought to determine whether 40 miRNAs previously implicated in concussion pathophysiology were affected by participation in a variety of contact and non-contact sports. Our goal was to refine a miRNA-based tool capable of identifying athletes with SRC without the confounding effects of exercise.
