Black women in the United States are three times more likely to have uterine fibroids compared to any other ethnicity. Existing studies estimate that about 80 to 90 percent of Black women will develop fibroids by age 50. Uterine fibroids are “non-cancerous tumors found in the uterus” (Orellana et al., 2022, p.1184). The exact cause of uterine fibroids is not fully understood, and more research is needed to gain insight into the causes of this debilitating disease (Yu et al., 2018). Idiopathic pulmonary fibrosis (IPF) is characterized by thickening and stiffness around the air sacs. Approved treatments like nintedanib and pirfenidone slow disease progression in IPF and often have tolerability issues. More research is needed to fully grasp the mechanisms behind abnormal cytoskeletal changes in lung cells, notably fibroblasts and epithelial cells, and their role in fibrosis progression. Previous studies suggest that myocardin expression and function, traditionally limited to smooth/cardiac development in physiology, become active in pathophysiological conditions like pleural fibrosis. Myocardin's role in liver and kidney fibrosis is known, but its involvement in IPF is unclear. To get more insights, …

In this Essay, as I did at the Connecticut Law Review’s Symposium, I draw on my experience representing Tribes in Haaland v. Brackeen to discuss more broadly the effective presentation of tribal arguments to the Court. I touch briefly on four main topics. First, I discuss how we collaborated with amici to ensure that the Court would have the full context as it considered the issues in Brackeen. Second, I discuss how we thought about preparing for the argument and the particular importance of understanding the practical operation of the Indian Child Welfare Act. In October 2023, the Connecticut Law Review hosted the Symposium “Interrogating Haaland v. Brackeen: Family Regulation, Constitutional Power, and Tribal Resilience.” The symposium was centered on the state of federal Indian law in the wake of the Brackeen decision. This decision was a victory for Indigenous families and Native nations as it left the Indian Child Welfare Act (ICWA) unscathed and affirmed the constitutional relationship between tribal nations and the United States. However, threats to tribal sovereignty continue as a handful of states and interest groups continue to seek ways to challenge tribal authority and federal laws that support it. …

Words often carry an intuitive meaning that defies explicit definition. While this vagueness typically poses no issue in our daily lives, it presents distinct challenges within the legal realm where words and their definitions wield the power to influence the course of justice. One abstract concept is notoriously elusive: what is an accident? Despite the apparent simplicity of identifying what is commonly understood implicitly, there are inherent challenges in “giving substance to a concept which is largely intuitive.”

In March 2023, the Intergovernmental Panel on Climate Change (IPCC) released its Sixth Assessment Report and confirmed unequivocally that human activities are the cause of climate change. Greenhouse gas emissions over the next few years are capable of causing irreversible and catastrophic damage to our planet. Catalyst litigation plays an important role in tackling climate change by prodding governments to assume a role in implementing adaptation and mitigation measures. Despite the extreme consequences that climate change will have on humanity, jurisdictional issues—such as standing—impose considerable hurdles for climate litigants. In Haaland v. Brackeen, the Supreme Court returned to the foundational question of federal authority over relations between the United States and Native nations, long known as “Indian affairs.” The decision reaffirmed well-established precedent affirming broad federal authority in the area, but it also underscored ongoing disagreement, as Justices Gorsuch and Thomas offered lengthy and dueling investigations of the original understanding.
This Essay explores one aspect of that history: the original meaning of “commerce” in the Indian Commerce Clause. Nearly a decade ago, I wrote an article that sought, as its title indicated, to move “beyond the Indian Commerce Clause.” …

Haaland V. Brackeen And Mancari: On History, Taking Children, And The Right-Wing Assault On Indigenous Sovereignty, Laura Briggs

In June 2023, the Supreme Court upheld the constitutionality of the Indian Child Welfare Act (ICWA) of 1978 in Haaland v. Brackeen, making it harder for (some) Indigenous families and communities to lose their children. The decision left one key question unanswered, however: whether protections specifically for American Indian households served as an illegitimate “racial” preference. Justice Amy Coney Barrett’s opinion for the majority argued that the petitioners lacked standing to raise this issue. Thus, the Court left the door open to continuing challenges by those who have an interest in using ICWA’s cute children and clean-cut evangelical Christian parents …

"Old Cod": The Power Of Storytelling In Conor Mcpherson's The Weir, Sarah Johnson

This paper examines the representation of Irish storytelling in Conor McPherson’s 1997 play The Weir. Drawing on postcolonial theory as well as the historical context of Ireland during the play’s release, I argue that The Weir is uniquely positioned at the intersection of traditional and modern values. Further, I assert that fairy legend is a tool used by the play’s characters to both understand and escape a fluctuating cultural landscape, and ultimately, a way to articulate their own values. Using textual analysis, I examine the rhetorical choices of the play’s storytellers and compare it with established conventions of Irish …

Transnational Repression (TNR) – the act of a government, or authorized group, coercing, repressing, or retaliating against individuals outside its sovereign territory – has significantly increased in recent years. Transnational repression often targets human rights defenders, activists, critics, journalists, and political opponents. Despite its insidious spread, the international community continues to grapple with applying a standard definition, as well as accountability and enforcement.

The 3rd Tampa Summit: Artificial Intelligence in the Era of Strategic Competition was held March 5-7th, 2024 at the University of South Florida and encompassed the 9th event in the Great Power Competition Conference series. The Global and National Security Institute (GNSI), in partnership with U.S. Central Command (USCENTCOM), the U.S. Department of Defense Chief Digital and Artificial Intelligence Office (CDAO), and the USF Institute for Artificial Intelligence (AI+X) brought together over 50 experts from government, academia and private industry to discuss the current and future applications of artificial intelligence in national security.

The rise of generative artificial intelligence (“AI”) has brought questions regarding the permissibility of using copyrighted materials in training generative AI systems around the globe. This article examines whether such use constitutes infringement under the American fair use doctrine, drawing insights from the regulatory approaches of the European Union (EU) and Japan.
Ultimately, this article advocates for United States courts to recognize the permissibility of using copyrighted materials in training generative AI models, rejecting the EU’s rights-holder-centric approach, and going beyond Japan’s limited-permissibility solution. Through a detailed four-factor fair use analysis, this article demonstrates that training generative AI on copyrighted …

Treaties are an essential source of international law, and they are permitted to be terminated. The rules governing termination, namely the 1969 Vienna Convention on the Law of Treaties, highlight two main goals of treaties: the stability and flexibility of agreements. Brexit highlights these goals and illustrates the tensions that arise. When parties terminate their treaties, they are ultimately stuck in a goldilocks dilemma. Essentially, the parties have to balance a combination of factors to achieve just the right outcome. Beijing’s growing global influence has led to increased Chinese participation in various international initiatives, many of which intersect with international law, from trade to climate change. This has prompted scholars to focus more on China’s engagement with international law, aiming to develop effective strategies for interacting with this emerging global power.

The tension between shareholder primacy and stakeholder capitalism embodies a fundamental debate about the purpose of a corporation. These two perspectives offer contrasting views on whether a company should primarily serve the interests of its shareholders or consider the broader spectrum of stakeholders in its decision-making process, taking into account environmental, social and governance factors alongside financial performance. The Dodd-Berle debate from the 1930s and Milton Friedman’s teachings in the 1970s regarding the purpose of a corporation and the tension between shareholder primacy and stakeholderism have been reinvigorated. An outbreak of Avipoxvirus occurred on a small farm in Gorham, ME in spring of 2022. This led to an investigation of the molecular and immunological properties of the virus using polymerase chain reaction (PCR) and enzyme-linked immunosorbent assays (ELISAs) to assess viral presence and antibody presence in domestic and wild turkeys and chickens. Viral presence was found in three visually pox-lesioned birds, and not found in two visually pox-lesioned birds. Viral presence was found in three visually healthy birds and not found in two visually healthy birds. Viral presence was not found in any pooled samples of mosquitoes (n=429 …

When Market Forces Backfire: Mandatory Esg Disclosure And Corporate Innovation, Andi Zhang

Mandatory ESG disclosure makes it possible to incorporate ESG information into stock prices, incentivizing firms to “do good”. This channel, however, may lead to suboptimal investments, according to disclosure theories. This study investigates the changes in firms’ investment in innovation activities following the staggered introduction of mandatory ESG disclosure around the world. Using a sample of corporate patents filed by listed firms across 58 countries from 2000 to 2022, I find that the introduction of mandatory ESG disclosure is associated with less corporate innovation. This paper provides a survey of various research articles on context-aware asynchronous pronunciation training applications. First, a set of seven articles is reviewed and summarized. Next, they are synthesized over the three main topics of 1) automated speech recognition, 2) non-native speaker considerations in language learning, and 3) future directions for research and development within computer-assisted pronunciation training (CAPT). Research in the areas of acoustic and pronunciation modeling (both implicit and explicit), pedagogical considerations for CAPT application design, Goodness of Pronunciation algorithm scoring, accent recognition and neutralization, and more are discussed.

Cryptocurrencies rely on a distributed public ledger (record of transactions) in order to perform their intended functions. However, the public’s ability to audit the network is both its greatest strength and greatest weakness: Anyone can see what address sent currency, and to whom the currency was sent. If cryptocurrency is ever going to take some of the responsibility of fiat currency, then there needs to be a certain level of confidentiality. Rhetoric can be thought of as the means and ways that we, as social beings, use language to create meaning and exchange symbols to better understand the world around us.
