A Theoretical Framework For Resilience In Complex System Governance (Csg), Susan A. Caskey Oct 2024

A Theoretical Framework For Resilience In Complex System Governance (Csg), Susan A. Caskey

Engineering Management & Systems Engineering Theses & Dissertations

This dissertation addresses a critical gap in resilience research within complex systems by developing a theoretical framework for governance resilience—an underexplored area despite governance's crucial role in maintaining system resilience. Using the Complex System Governance (CSG) framework (Keating, Katina, Chesterman, et al., 2022; Keating & Katina, 2019), resilience is conceptualized as a system's ability to absorb disturbances while sustaining performance and enabling adaptive transformation. This involves three main capabilities: persistence, adaptability, and transformation in response to both internal and external pressures.

Through a constructivist grounded theory approach involving iterative coding, memoing, and theory development, this study inductively constructs a governance …

Suppression Of Dynamic Aeroelastic Response Of A Semispan Wing Using Traditional And Distributed Sensing, James Ramey Oct 2024

Suppression Of Dynamic Aeroelastic Response Of A Semispan Wing Using Traditional And Distributed Sensing, James Ramey

Mechanical & Aerospace Engineering Theses & Dissertations

Characterization and management of aeroelastic effects are a vital part of aircraft design. Mitigation of these effects often includes control systems to suppress the vibrations. Control systems are constantly being developed and improved, with one such avenue of development being new sensing systems that can increase the information fed into the controller. Fiber Optic Strain Sensing (FOSS) technology is one such system that utilizes Fiber Bragg Gratings (FBGs) on a fiber optic cable to sense the strain on structural elements. This system has promise as a high-density feedback device, and the maturation of the technology has allowed assessment of its …

New Ways Of Teaching Adat (Customary) Law At Indonesian Law Schools, Tody S.J. Utama, Rikardo Simarmata, Jacqueline A.C. Vel, Adriaan W. Bedner Oct 2024

New Ways Of Teaching Adat (Customary) Law At Indonesian Law Schools, Tody S.J. Utama, Rikardo Simarmata, Jacqueline A.C. Vel, Adriaan W. Bedner

The Indonesian Journal of Socio-Legal Studies

While customary law typically is not the sole legal system regulating people's daily lives, it still plays a big role in shaping the behavior of countless individuals worldwide. For this reason, law schools in many countries teach customary law courses, but these courses often present customary law as a sterile set of principles and norms detached from studying social reality. This approach associates customary law with traditional communities whose members live in relative isolation from the world, ignoring the fact that customary law operates in a legally pluralistic universe, interacting with religious and state law systems, and that it adapts …

An Introduction To Open-Source Geographic Information Systems (Gis): Qgis, Ashley York

Library Workshops

In general, Geographic Information Systems (GIS) provide a framework for gathering, organizing, and analyzing spatial data, that is visualized through maps. By arranging spatial information into coincident layers, GIS analyses help reveal deeper insights into a study area by identifying not only where features of interest are located, but also why patterns or processes are occurring. However, a number of various GIS software and online mapping platforms exist, each with a different range of analysis capabilities, but also with different accessibility limitations in terms of user cost (e.g., open-source vs. commercial). In this introductory workshop, participants will become familiar with …

Judicial Individualization of Punishment in UAE Criminal Law

This study addresses the topic of judicial individualization of punishment in UAE criminal legislation through a descriptive-analytical approach. In the preliminary section, the study defines punishment, which is imposed as a consequence of a crime that has already occurred, and precautionary measures aimed at confronting criminal danger to prevent future harm that could affect society. The characteristics and purposes of both punishment and precautionary measures are detailed, as they cannot be applied unless those implementing them understand their goals and intended outcomes.

The Use Of Puffed Rice Biomaterial As An Insulation Layer: Characterization And Simulation Study, Nicolas Monje Mejia Oct 2024

The Use Of Puffed Rice Biomaterial As An Insulation Layer: Characterization And Simulation Study, Nicolas Monje Mejia

Theses

Upon close examination in this study, the feasibility of utilizing puffed rice as an insulation layer for construction is explored. Regions that are warm and receive direct sunlight experience heightened temperatures, which can lead to structures trapping excessive heat, resulting in increased cooling demands, energy consumption, and higher costs all around. As revealed via findings from research conducted over time, puffed rice showcases immense prospects when employed as insulation considering its high level of percolation coupled with low thermal conductivity rates. Conversely, conventional materials tend to have better-quality properties like greater compressive strength than what one sees here, along with …

A High-Order Eulerian–Lagrangian Runge–Kutta Finite Volume (El–Rk–Fv) Method For Scalar Nonlinear Conservation Laws, Jiajie Chen, Joseph Nakao, Jing Mei Qiu, Yang Yang Oct 2024

A High-Order Eulerian–Lagrangian Runge–Kutta Finite Volume (El–Rk–Fv) Method For Scalar Nonlinear Conservation Laws, Jiajie Chen, Joseph Nakao, Jing Mei Qiu, Yang Yang

Michigan Tech Publications

We present a class of high-order Eulerian–Lagrangian Runge–Kutta finite volume methods that can numerically solve Burgers’ equation with shock formations, which could be extended to general scalar conservation laws. Eulerian–Lagrangian (EL) and semi-Lagrangian (SL) methods have recently seen increased development and have become a staple for allowing large time-stepping sizes. Yet, maintaining relatively large time-stepping sizes post shock formation remains quite challenging. Our proposed scheme integrates the partial differential equation on a space-time region partitioned by linear approximations to the characteristics determined by the Rankine–Hugoniot jump condition. We trace the characteristics forward in time and present a merging procedure for …

Unpacking English Language Teachers’ Perceptions And Practices Of Translanguaging: A Case Study Of Secondary Schools In China, Yuling Chen, Fan Fang, Weilei Zhang

Journal of English and Applied Linguistics

Translanguaging has gained prominence as a viable tactic to assist the language learning of L2 learners due to the increasing variety of classrooms globally. Translanguaging pedagogy has been recently studied in diverse contexts. However, most of the research on translanguaging, especially in the Chinese context, is focused on higher education. Limited attention has been paid to secondary school. Therefore, this qualitative case study aims to fill this gap by investigating how language educators employ translanguaging in their English teaching in secondary schools. Data was collected from 4 Chinese EFL teachers across 2 secondary schools through classroom observation and semi-structured interviews, …

Do Women Receive Worse Financial Advice?, Utpal Bhattacharya, Amit Kumar, Sujata Visaria, Jing Zhao Oct 2024

Do Women Receive Worse Financial Advice?, Utpal Bhattacharya, Amit Kumar, Sujata Visaria, Jing Zhao

Research Collection Lee Kong Chian School Of Business

We arranged for trained undercover men and women to pose as potential clients and visit all 65 local financial advisory firms in Hong Kong. At financial planning firms, but not at securities firms, women were more likely than men to receive advice to buy only individual or only local securities. Female clients who signaled high confidence, high risk tolerance, or a domestic outlook were especially likely to receive this suboptimal advice. Our theoretical model explains these patterns as a result of statis-tical discrimination interacting with advisors’ incentives. Taste-based discrimination is unlikely to explain the results.

The purpose of this study was to develop contemporary strength norms for the squat, bench press, and deadlift using powerlifters competing in un-equipped, drug-tested competitions. Design: Retrospective cross-sectional analysis. Methods: Retrospective data from global drug-tested, unequipped powerlifting competitions were collated with 809,986 samples (571,650 males, 238,336 females) included. Strength was assessed according to …

Sequential Investment Decisions For Mining Projects Using Compound Multiple Volatility Real Options Approach, Atul Chandra, Peter R. Hartley Oct 2024

Sequential Investment Decisions For Mining Projects Using Compound Multiple Volatility Real Options Approach, Atul Chandra, Peter R. Hartley

Research outputs 2022 to 2026

Managers evaluating investment decisions in mining projects have reported using the net present value approach (NPV). However, NPV has the drawback of collapsing variations from uncertainties in future project cash flows into a fixed expected project value today. Ignoring future uncertainties and contingencies can lead managers to make incorrect up-front binary decisions, such as investing in or abandoning the project now. The real options analysis approach (ROA) instead captures variations from uncertainties as volatilities in project value and allows flexibility in investment decisions to be contingent on information as it is revealed. Managers we consulted agreed that ROA is superior …

Tactical Restructurings, Diane Lourdes Dick Oct 2024

Tactical Restructurings, Diane Lourdes Dick

Fordham Law Review

The traditional legal account of a corporate debtor’s journey into and through bankruptcy reorganization naturally focuses on legal rights and entitlements, such as obligations arising under the debtor’s existing agreements and rights articulated in the U.S. Bankruptcy Code. But the traditional legal account does little to probe why these prior agreements and transactions were entered into in the first place, and how they interact with the bankruptcy system to generate predictable outcomes. Rather, the traditional legal account applies a presumption that the debtor’s financial characteristics, qualities, and features (what this Article calls “restructuring attributes”) are not premeditated, at least insofar …

Ethical Guardrails To Unbounded Procedure, Seth Katsuya Endo Oct 2024

Ethical Guardrails To Unbounded Procedure, Seth Katsuya Endo

Fordham Law Review

Civil lawsuits in federal courts—especially class actions and multidistrict litigation (MDL)—can be messy and complicated, calling for pragmatic interventions that lie beyond what is explicitly addressed by the existing rules. And flexibility is part of the genius of the Federal Rules of Civil Procedure. On the other hand, unbounded discretion and innovation in procedure can lead to illegitimate exercises of power, bias, democratic nonaccountability, and other serious harms. But the choice is not between providing individual courts with nearly limitless authority to experiment with procedure or having a set of rigid rules. Instead, there is a third path: district judges …

The Contemporary Case For Consumer Expectations: Reevaluating The Evolution Of The Original Defect Standard And Its Place In Modern Products Litigation, Alyssa Clune Oct 2024

The Contemporary Case For Consumer Expectations: Reevaluating The Evolution Of The Original Defect Standard And Its Place In Modern Products Litigation, Alyssa Clune

Fordham Law Review

The consumer expectations standard for design defect has been the subject of fierce debate since its inception. Though many see it as the test that best reflects the plaintiff-friendly goals of products liability, others critique it as vague, outdated, and ripe for jury misuse. Once the primary test for design defect under the Restatement (Second) of Torts, the consumer expectations test has since been rejected by the Restatement (Third) of Torts, and its use has been eliminated or restricted in approximately half of all states in favor of the risk-utility test. Much of the reasoning behind this growing rejection revolves …

Section 1983 And Voting Rights: A Case Study On The Materiality Provision And The Future Of Private Enforcement, Paul Feingold Oct 2024

Section 1983 And Voting Rights: A Case Study On The Materiality Provision And The Future Of Private Enforcement, Paul Feingold

Fordham Law Review

A recent ruling by the U.S. Court of Appeals for the Eighth Circuit stating that § 2 of the Voting Rights Act of 1965 is not enforceable by private litigants under an implied private right of action has many voting rights advocates rightfully concerned about the future of federal voting rights protections. Indeed, that ruling appears partly motivated by signals from the U.S. Supreme Court. However, not all hope is lost. In Health and Hospital Corp. of Marion County v. Talevski, the Supreme Court recently reaffirmed its Gonzaga University v. Doe test for enforcing a statute under § 1983. …

Surviving Lender Violence: The Case For Resuscitating Contractual Good Faith In New York, Zachary T. Hanusek Oct 2024

Surviving Lender Violence: The Case For Resuscitating Contractual Good Faith In New York, Zachary T. Hanusek

Fordham Law Review

In recent years, lender violence has become the preferred term for a rapidly developing restructuring market centered on the premise that a subset of lenders in a syndicate can increase their own recovery prospects at the expense of the remaining lenders in their group by engaging in a so-called “liability-management transaction.” This term evokes images of rival factions of corporate lenders engaging in physical combat. Although these hyper-technical restructurings certainly fall short of the barbarity the label suggests, the reality is that lenders participating in the so-called violence can siphon hundreds of millions of dollars away from nonparticipating lenders and …

Surviving The Rule Of Reason: An Antitrust Analysis Of Employment Noncompetes, Erin Lee Oct 2024

Surviving The Rule Of Reason: An Antitrust Analysis Of Employment Noncompetes, Erin Lee

Fordham Law Review

When the Federal Trade Commission (FTC) issued a rule banning noncompete agreements as unfair methods of competition, it reinvigorated debates regarding the purpose of federal antitrust law. At its core, federal antitrust law seeks to preserve a competitive economy and promote new entry into the marketplace, primarily to protect consumer interest. Under President Biden’s administration, the FTC has increased its efforts to expand the scope of antitrust protection beyond consumer welfare by applying it to other public policy concerns, such as employee mobility. The FTC points to noncompete agreements as detrimental constraints to employees’ economic freedoms. In practice, employment noncompetes …

Make America Fake Again?: Banning Deepfakes Of Federal Candidates In Political Advertisements Under The First Amendment, Sophie Loewenstein Oct 2024

Make America Fake Again?: Banning Deepfakes Of Federal Candidates In Political Advertisements Under The First Amendment, Sophie Loewenstein

Fordham Law Review

In recent years, artificial intelligence (AI) technology has developed rapidly. Accompanying this advancement in sophistication and accessibility are various societal benefits and risks. For example, political campaigns and political action committees have begun to use AI in advertisements to generate deepfakes of opposing candidates to influence voters. Deepfakes of political candidates interfere with voters’ ability to discern falsity from reality and make informed decisions at the ballot box. As a result, these deepfakes pose a threat to the integrity of elections and the existence of democracy. Despite the dangers of deepfakes, regulating false political speech raises significant First Amendment questions. …

(Synthetic) Stump Speech: Crafting Generative Ai Disclosure Regulations For Political Advertisements, Alex Paget Oct 2024

(Synthetic) Stump Speech: Crafting Generative Ai Disclosure Regulations For Political Advertisements, Alex Paget

Fordham Law Review

Synthetic media, or content generated using artificial intelligence, has begun to infect political advertising. Federal legislation has spent most of its time stalled in committees, but states and online platforms have rapidly implemented regulations. Although synthetic media may pose harms through voter manipulation and democratic distortion, it also can lower campaign costs and more vividly illustrate conceptions of a political choice’s consequences. Some governments and commentators have sought to prohibit the most harmful forms, while others have focused more on transparent approaches to regulation. In the face of yet another contentious election cycle, the question of how to ensure choices …

Exploring Children’S Attitudes Towards Digital Good/Bad Through Hybrid Arts Practices. Final Project Report., Dylan Yamada-Rice, John Potter, Steve Love, Eleanor Dare, Angus Main, Richard Nash

School of Art, Design and Architecture

This report shares the findings of a project funded by the Economic and Social Research Council’s (ESRC) Digital Good Network that sought to explore children’s attitudes towards notions of digital good and conversely digital bad through hybrid arts practice. The project built on our previous work that has centred on one or more emerging technologies, exploring what this might mean in terms of children’s entertainment, play, education and/or health. To tie in with the wider Network’s provocation about whether a digital good society is possible and if so what it would look like, we connected our ideas to a project …

Privacy Law’S Role In An Information Economy, Sari Mazzurco Oct 2024

Privacy Law’S Role In An Information Economy, Sari Mazzurco

Cardozo Law Review

What do we lose when we lose our privacy? A slew of recently enacted state laws suggest that the loss of privacy is merely a loss of individual choice in the market exchange of services for personal information. This Article argues that a loss of privacy risks something greater: the collapse of complex and fluid social identity. Without privacy, individuals cannot nurture their own senses of self because they are no longer free to try on different social roles across diverse relationships. Pervasive, private data collection threatens multifaceted selfhood by eliminating the boundaries that make social roles distinct and hindering …

The Forever Family’S Legal Loophole: A 50-State Survey On Adoption Dissolution, Kira Kilstein Oct 2024

The Forever Family’S Legal Loophole: A 50-State Survey On Adoption Dissolution, Kira Kilstein

Cardozo Law Review

Adoption is said to be “forever”—longing parents fulfill their dream of parenthood and children get a “forever family.” While the legal system intends for adoptive parent-child relationships to be permanent, a happily-ever-after ending is elusive when adoptions are enabled to fail. In the United States, each state can set its own standard for when courts may grant a request to dissolve an adoption, as well as time limits within which a parent may ask the court to vacate the adoption decree. This legal loophole, known as adoption dissolution, has been met with controversy about the permissibility of parents giving up …
