Anyone You Are Related To Can Be Used Against You: Criminal Discovery Statutes And Investigative Genetic Genealogy, Caroline Levine Oct 2024

Anyone You Are Related To Can Be Used Against You: Criminal Discovery Statutes And Investigative Genetic Genealogy, Caroline Levine

Cardozo Law Review

The use of investigative genetic genealogy (“IGG”) as a basis for arresting suspects in complex and dormant investigations is raising serious concerns about whether the due process rights of criminal defendants in these cases are being violated. This Note provides a comprehensive look at the role of this groundbreaking, yet little-understood technology in criminal prosecutions. Technological advances have historically necessitated that courts expand and reinterpret legal principles. As a novel derivative of traditional DNA testing, this Note argues IGG should similarly require that discovery statutes be amended or rewritten to adapt to this cutting-edge technique, which is so new that …

A Missed Opportunity: Clarifying Presidential Power Under The Procurement Act, Anthony Porcelli Oct 2024

A Missed Opportunity: Clarifying Presidential Power Under The Procurement Act, Anthony Porcelli

Cardozo Law Review

In late 2021, President Biden relied on the Procurement Act to sign an Executive Order effectively requiring every employee of any private company that contracts with the federal government to be fully vaccinated for COVID-19. While the mandate was ultimately rescinded less than two years later, it produced four inconsistent federal circuit court opinions that together expose the problems with existing judicial frameworks for analyzing executive authority under the Procurement Act.

This Note explores the growth of the federal procurement industry, the evolution of executive orders under the Procurement Act, and the existing jurisprudence for executive power under the Act. …

Automatic Multi-Contrast 2d Paraspinal Muscle Segmentation For Assessment Of Sarcopenia And Fatty Infiltration, Juan Pablo Esparza Oct 2024

Automatic Multi-Contrast 2d Paraspinal Muscle Segmentation For Assessment Of Sarcopenia And Fatty Infiltration, Juan Pablo Esparza

Electronic Theses and Dissertations Archive

Cirrhosis is the final stage of liver disease requiring liver transplantation as treatment. In the past, models based on clinical laboratory values would determine the eligibility of liver transplant candidates. However, several patients can still suffer from liver transplantation complications leading to death. Sarcopenia, the loss of muscle mass, and frailty, the loss of muscle function, are common cirrhosis complications, but recently muscle area estimated at the third lumbar level has been studied as a prognostic to predict liver transplant mortality. Muscle fatty infiltration has been hypothesized to be a descriptor of muscle quality. However, a major bottleneck for implementing …

Articles

The development of 3D food printing is evolving, particularly in high-end restaurants, since 2013 when the first complex 3D printed chocolate concept for gastronomy was developed. In 2014, several 3D food printers were launched specifically to suit requirements from the culinary sector. These technology companies often partnered with renowned chefs who developed recipes, showcased the printers and served their food products in their restaurants. Chefs often worked in teams with e.g. food designers, technologists, engineers, and nutritionists to create dishes for events and for their own restaurant customers. From Michelin starred restaurants, pop-up events to pizzerias, 3D food printers were …

In this current research, we conceptualized a novel nanotechnology-enabled synthesis approach of targeting HIV-harboring tissues via second-generation (G2) polyamidoamine (PAMAM) mannosylated (MPG2) dendrimers for programmed delivery of anti-HIV drugs efavirenz (EFV) and ritonavir (RTV). Briefly, here mannose served purpose of ligand in this EFV and RTV-loaded PAMAM G2 dendrimers, synthesized by divergent techniques, denoted as MPG2ER. The developed nanocarriers were characterized by different analytical tools FTIR, NMR, zeta potential, particle size, and surface morphology. The results of confocal microscopy showed substantial alterations in the morphology of H9 cells, favored by relatively higher drug uptake through the MPG2ER. Interestingly, the drug …

An Acute Hepatic Hydrothorax Causing Tension., Dina R Assali, Austin Richardson, Andrew Kalnow

Trauma and Acute Care Articles

Patients with advanced cirrhosis are at risk for numerous complications, including hepatic hydrothorax. Hepatic hydrothorax most commonly occurs in the right pleural space but less commonly can present on the left hemithorax. The exact pathophysiology is not fully understood, but there are several schools of thought for right-sided effusions. In this case report, we discuss the findings of a 76-year-old female who experienced a left-sided hydrothorax likely stemming from her underlying liver disease which created tension pathology in an otherwise stable patient. Interestingly, this accumulation occurred over a couple of weeks despite optimal medical management. A thoracentesis confirmed ascitic fluid. …

Did Stalinism Pave The Way For The Rise Of The Marcos Dictatorship? A Review Of Joseph Scalice’S The Drama Of Dictatorship, Jervy C. Briones, Karlo Mikhail I. Mongaya

Journal Article

Joseph Scalice’s The Drama of Dictatorship: Martial Law and the Communist Parties of the Philippines (2023) offers arguably one of the most definitive Trotskyist critiques of the historical legacy of the Philippine communist movement. Through extensive archival research, Scalice interprets the split between the Partido Komunista ng Pilipinas (PKP) and the Communist Party of the Philippines (CPP) as a local expression of the Sino-Soviet split, arguing that both parties acted as class collaborators by aligning with rival factions of the Filipino elite. This review article critically engages with Scalice’s historical claims from an anti-imperialist, Marxist, and non-sectarian perspective. While his …

Facilitative Fair Use, Michael Mattioli

Denver Law Review

Recent generative artificial intelligence (AI) copyright lawsuits have ignited a crucial debate about the future of intellectual property. The technology involved is complex, but the essential conflict is simple: creators are trying to stop machines that are capable of imitating them from doing just that. These are familiar battle lines. From the loom to the first camera, inventions have long triggered anxieties about technology’s potential to displace artistry. Much of the commentary today focuses on AI’s potential to mimic creators, echoing these earlier concerns. However, this framing misses a key insight: AI is a powerful tool for widely facilitating the …

Safeguarding Children's Voices In Child Protective Proceedings, Stephanie L. Tang Oct 2024

Safeguarding Children's Voices In Child Protective Proceedings, Stephanie L. Tang

Denver Law Review

In child protective proceedings, courts face the difficult task of determining the permanent placement of a child that promotes their well-being and safety, even if it means terminating their parents’ rights. Every year, authorities wrongfully and forcibly remove thousands of children from their families and homes. It is imperative that courts and attorneys adopt steps to provide children a voice and to guarantee children’s rights in these proceedings. Courts hear children’s preferences in child protective proceedings through four primary avenues: (1) appointment of a representative for the child, (2) direct in-court testimony, (3) in camera judicial interviews, and (4) admission …

Net-Zero Requirements For Federal Oil & Gas Leases: A Durable Way For The Executive Branch To Curb Greenhouse Gas Emissions, Adam Fisher Oct 2024

Net-Zero Requirements For Federal Oil & Gas Leases: A Durable Way For The Executive Branch To Curb Greenhouse Gas Emissions, Adam Fisher

Denver Law Review

The Biden Administration committed the United States to achieving net-zero emissions by 2050. Without congressional action on the issue, the Administration’s reach was limited. However, nearly a quarter of all U.S. greenhouse gas (GHG) emissions derive from fossil fuels produced under federal permits. Thus, because the executive branch has significant discretion in the oil and gas permitting process, commentators have suggested that an administration could unilaterally limit U.S. GHG emissions by (1) requiring new federal oil and gas leases to be carbon neutral or (2) updating the lease and permit terms for existing federal leases to require carbon neutrality. However, …

Samia V. United States: The Ghost Of Sir Walter Raleigh Haunts Again, Rebekah S. Atnip Oct 2024

Samia V. United States: The Ghost Of Sir Walter Raleigh Haunts Again, Rebekah S. Atnip

Denver Law Review

In Samia v. United States, the United States Supreme Court grappled with whether the admission of a nontestifying codefendant’s redacted confession that implicates a nonconfessing codefendant violates that nonconfessing defendant’s right to confront opposing witnesses. The Court’s majority framed this issue as a conflict between defendants’ rights and judicial economy and then declared judicial economy the winner. This resolution threatens to elevate governmental interests over defendants’ rights to face their accuser and to test opposing witnesses’ memory and sincerity. Moreover, and perhaps more importantly, in holding that introducing such a confession does not violate the Confrontation Clause, the Court endangers …
