Personhood, Politics, Assisted Reproduction, And The Law Post-Dobbs, Myrisha S. Lewis Nov 2024

Personhood, Politics, Assisted Reproduction, And The Law Post-Dobbs, Myrisha S. Lewis

Pace Law Review

With the end of the federal constitutional right to abortion, state legislatures and state courts have become far more important in the sphere of reproductive rights. Before Dobbs, anti-abortion advocates had significant (albeit increasingly porous) ceilings on what they could prohibit in relation to reproductive health care. A significant check on those actions is now gone.

In the wake of Dobbs, societal debates about personhood have increased and expanded in terms of their practical implications. Before Dobbs, anti-abortion advocates admitted that Roe and subsequent cases limited the scope of their arguments, especially in relation to the legality …

Patient-Practitioner Relationship In The Post-Dobbs American Landscape, Lynette B. Martins, Scott J. Schweikart Nov 2024

Patient-Practitioner Relationship In The Post-Dobbs American Landscape, Lynette B. Martins, Scott J. Schweikart

Pace Law Review

The patient-practitioner relationship is among the most sacred and fundamental in health care, particularly in the realm of reproductive care. Laws regulating what practitioners can and cannot discuss in the exam room with patients have made a resurgence in the post-Dobbs era. In the reproductive care context, these restrictive laws impact patients’ access to critical medical services but also the fundamental underpinnings of the patient-practitioner relationship. In a post-Dobbs era, laws restricting abortion are increasingly dangerous to the health of those seeking these services. With no federal protection for access to abortion services and abortion services hinging on …

When To Save The Baby: A Fundamental Conditions Approach, S. Matthew Liao, Jordan Liebman, Corine Astroth Nov 2024

When To Save The Baby: A Fundamental Conditions Approach, S. Matthew Liao, Jordan Liebman, Corine Astroth

Pace Law Review

Parents and physicians often grapple with the agonizing decision of whether to continue life-sustaining treatment for critically ill infants. In this paper, we introduce a novel framework called the Fundamental Conditions Approach (FCA) to guide these difficult choices. Building on S. Matthew Liao’s work, the FCA evaluates whether an infant possesses or can develop the fundamental capacities necessary for engaging in basic activities that constitute a good life. These capacities include the ability to think, respond to facts, develop interpersonal relationships, and interact with one’ environment. We argue that if an infant lacks nearly all of these fundamental capacities and …

We Have Lost Our Minds, Teneille Ruth Brown Nov 2024

We Have Lost Our Minds, Teneille Ruth Brown

Pace Law Review

This Article examines the paradoxical treatment of autonomy in American healthcare law. While autonomy has become the dominant principle in medical ethics and neoliberal market philosophies, pregnant people have been systematically denied this same autonomy through increasingly restrictive abortion statutes. Using the rhetoric of “informed consent,” abortion-restrictive statutes ironically pervert the animating principles behind the doctrine—rendering it almost meaning- less. I argue that this contradiction stems from the dehumanization of pregnant people who seek abortions, particularly through the denial of their capacity to have individual, complex mental states and feelings. Drawing on moral psychology, the Article demonstrates how pregnant people …

Evaluation Of The Effectiveness Of The Implementation Of A New Workflow Process On The Incidence Of High Blood Culture Contamination (Bcc) Rates In The Emergency Department, Angelita Rodgers Nov 2024

Evaluation Of The Effectiveness Of The Implementation Of A New Workflow Process On The Incidence Of High Blood Culture Contamination (Bcc) Rates In The Emergency Department, Angelita Rodgers

Walden Dissertations and Doctoral Studies

The purpose of this Doctor of Nursing Practice Project was to evaluate the effectiveness of a quality improvement (QI) initiative to reduce blood culture contamination (BCC) rates in the emergency department (ED) of a large healthcare organization in the southeastern United States. Evidence-base sources indicated that high blood culture contamination (BCC) rates compromised diagnostic accuracy, leading to unnecessary treatments, increased hospital stays, and elevated healthcare costs. The project was guided by the evidence-based practice question: “How does the implementation of a new workflow process influence the incidence of high blood culture contamination (BCC) rates in the emergency department?” To address …

Structural, Thermal, And Optical Spectroscopic Studies Of Sm3+-Doped Ba2znsi2o7 Phosphors For Optical Thermometry Applications, None Tejas, A. Princy, S. Masilla Moses Kennedy, Vikash Mishra

Open Access archive

Samarium-doped Ba2ZnSi2O7 orange red-emitting phosphors for novel applications in temperature measurement were prepared by a solid-state synthesis method. A Ba2ZnSi2O7 akermanite-structured Sm3+ phosphor was allocated to the C2/c space group and monoclinic system. Using FTIR, identification of different bonds with their vibrational modes has been done. Stimulated at 403 nm, the as-prepared phosphors show yellow (560 nm), orange (600 and 645 nm), and red (705 nm) emissions, which were also used to maximize the dopant concentration. Sm3+ ions may be uniformly dispersed throughout the Ba2ZnSi2O7 matrix, and Sm3+ consists of irregular microparticles. Optical energy bandgap values for …

Military Spouses’ Perceptions Of Family Stress And Resilience During Multiple Relocations, Mauranda Nikki Jones Nov 2024

Military Spouses’ Perceptions Of Family Stress And Resilience During Multiple Relocations, Mauranda Nikki Jones

Walden Dissertations and Doctoral Studies

The purpose of this qualitative transcendental phenomenological study was to increase understanding of military spouses’ perceptions of family stress and resilience during multiple relocations. On average, active-duty military families relocate every 2 to 4 years, placing additional stress on them. It has been argued that military spouses, because of their central roles, are uniquely positioned to demonstrate resilience, thus providing an important perspective for this study. Understanding specific risks and resiliency from the perspectives of service members’ spouses can enrich knowledge from which human service professionals can learn. The study was grounded in the resiliency model of stress, adjustment, and …

Teachers’ Perceptions Of Job Stress And Its Meaning On Intent To Remain At A Title I School, Salmata Saaka-Lyons Nov 2024

Teachers’ Perceptions Of Job Stress And Its Meaning On Intent To Remain At A Title I School, Salmata Saaka-Lyons

Walden Dissertations and Doctoral Studies

The shortage of teachers in Title I schools undermines educational equity and quality in underserved communities, necessitating concerted efforts from educators, policymakers, and local communities. The purpose of this qualitative phenomenological study was to explore the lived experiences of Title I teachers regarding job stress and its meaning on their decisions to remain in the profession and within Title I environments. Grounded in Lazarus and Folkman’s transactional theory of stress and coping and Bakker and Demerouti’s job demands-resources model, the study explored how perceived job stress shapes teachers’ commitment to their roles. An interpretative phenomenological analysis was employed to analyze …

Hybrid Energy Systems: Synergy Margin And Control Co-Design, Mario Garcia Sanz Nov 2024

Hybrid Energy Systems: Synergy Margin And Control Co-Design, Mario Garcia Sanz

Faculty Scholarship

Extraordinary properties emerge from subsystems' interactions. Hybrid energy systems (HESs) are a promising concept that could change the renewable energy landscape. By co-designing generation, storage, and conversion technologies, HESs can provide new electrical power services, increase grid stability and control authority, and generate energy and/or nonenergy products such as electricity, hydrogen, ammonia, heat, digital data, or fresh water. This article discusses some conditions the co-design of HESs should follow to optimize the combined system (synergy), avoiding deterioration (dysfunction). It introduces some technoeconomic synergy conditions, develops a synergy margin, and analyses several case studies, exploring also the control co-design methodology to …

Dobbs And Sterilization Decision-Making: Understanding The Coercive Spillover Effects In Reproductive Choice, Thomas Wilson Williams Nov 2024

Dobbs And Sterilization Decision-Making: Understanding The Coercive Spillover Effects In Reproductive Choice, Thomas Wilson Williams

Pace Law Review

The Supreme Court majority in Dobbs v. Jackson Women’s Health Organization argued their decision would have limited impact beyond abortion rights. This Article examines how Dobbs and subsequent state abortion restrictions are likely to increase women’s reliance on permanent sterilization procedures, particularly among already marginalized populations. Drawing on emerging data and historical context, I argue that some post-Dobbs sterilizations should be understood as effectively coerced by state policies, implicating reproductive justice concerns and potentially undermining fundamental rights established in Skinner v. Oklahoma. Then, I demonstrate how interdisciplinary bioethics frameworks and methodologies can help courts better understand the full …

Exploring The Impact Of Player Traits On The Leaderboard Experience In A Digital Maths Game, André Almo, Mariana Rocha, Attracta Brennan, Pierpaolo Dondio

Research Outputs: 2025-Present

Digital Game-Based Learning (DGBL) uses digital games to enhance engagement and learning, but its efficacy is linked to game features. Leaderboards are a commonly used feature to increase motivation through competition, improving engagement and learning outcomes. However, infinite leaderboards, displaying all players in an ordered ranking based on their scores, can demotivate players depending on their performance and characteristics. This study investigated primary school students’ experience with an infinite leaderboard during a digital maths game intervention. 1389 Irish students participated in a 6-week programme with the game ‘Seven Spells,’ which featured an infinite leaderboard. Player traits and opinions about the …

Lengthening Atlantic Hurricane Seasons With Earlier Storm Formation Dates Including Implications From 2020, Barry D. Keim, L. C. Hamilton, V. M. Brown, P. J. Klotzbach, A. B. Lewis, D. T. Thompson Nov 2024

Lengthening Atlantic Hurricane Seasons With Earlier Storm Formation Dates Including Implications From 2020, Barry D. Keim, L. C. Hamilton, V. M. Brown, P. J. Klotzbach, A. B. Lewis, D. T. Thompson

School of Public Health Faculty Publications

This paper analyzes the formation dates of the nth storm in a sequence for all named North Atlantic tropical cyclones (TCs) and assesses whether the intraseasonal length of the Atlantic hurricane season has changed temporally. The record-breaking 2020 season, with 30 named storms, set records for the earliest third TC formation (Cristobal) and from the sixth TC (Fay) onward. Analysis of season length from 1851 to 2022 identifies only one statistically significant breakpoint detected in the early 1970s, roughly coinciding with the introduction of satellite observations. Since 1970, we also find a trend toward longer North Atlantic hurricane seasons. The …

Phagolysosomes Break Down The Membrane Of A Non-Apoptotic Corpse Independent Of Macroautophagy, Shruti Kolli, Cassidy J. Kline, Kimya M. Rad, Ann M. Wehman Nov 2024

Phagolysosomes Break Down The Membrane Of A Non-Apoptotic Corpse Independent Of Macroautophagy, Shruti Kolli, Cassidy J. Kline, Kimya M. Rad, Ann M. Wehman

Biological Sciences: Faculty Scholarship

Cell corpses must be cleared in an efficient manner to maintain tissue homeostasis and regulate immune responses. Ubiquitin-like Atg8/LC3 family proteins promote the degradation of membranes and internal cargo during both macroautophagy and corpse clearance, raising the question how macroautophagy contributes to corpse clearance. Studying the clearance of non-apoptotic dying polar bodies in Caenorhabditis elegans embryos, we show that the LC3 ortholog LGG-2 is enriched inside the polar body phagolysosome independent of autophagosome formation. We demonstrate that ATG-16.1 and ATG-16.2, which promote membrane association of lipidated Atg8/LC3 proteins, redundantly promote polar body membrane breakdown in phagolysosomes independent of their role …

Rare Sugars And Dairy Ingredients: A Synergistic Pairing For The Reduction Of Food Waste And Sugar Consumption, Melinda Michelle Moss Nov 2024

Rare Sugars And Dairy Ingredients: A Synergistic Pairing For The Reduction Of Food Waste And Sugar Consumption, Melinda Michelle Moss

Theses and Dissertations

In the future, sustainability in the dairy industry will require creative and scale-able solutions for better utilization of the primary solid component in milk: lactose. One promising avenue of “up-cycling” underutilized lactose is converting it to valuable rare sugars. Rare sugars like D-tagatose and D-allulose are increasing in popularity extremely quickly. D-tagatose and D-allulose are hexose sugars, D-allulose being an epimer of D-fructose and D-tagatose an isomer of D-galactose. They have excellent functional properties in food systems with clean sweetness profiles similar to sucrose. Critically, they also have excellent nutritional characteristics, such as low caloric values and low glycemic indices. …

Computational Medicine Center Faculty Papers

Diffuse Large B-cell Lymphoma (DLBCL) is the most common aggressive non-Hodgkin lymphoma (NHL). Despite the use of newer agents, such as polatuzumab vedotin, more than one-third of patients have ultimately relapsed or experienced refractory disease. MiRNAs are single-stranded, ~22-nucleotide-long RNAs that interact with their target RNA. They are significant regulators of post-transcriptional gene expression. One significant miRNA, miR-155, is involved in the pathophysiology of DLBCL and it is a critical modulator of hematopoiesis, inflammation, and immune responses. Targets of miR-155, such as histone deacetylase 4 (HDAC4), suppressor of cytokine signaling-1 (SOCS1) and immune cells, play a crucial role in DLBCL …

In June 2024, the U.S. Supreme Court eliminated the judicial deference federal agencies previously received for their statutory interpretations, overturning the Court’s landmark 1984 decision in Chevron U.S.A. Inc. v. Natural Resources Defense Council, Inc. While Chevron was never binding on state courts, where the balance of powers and state constitutions may require different or no deference to agencies, numerous states have adopted Chevron deference, Skidmore weight, or similar deference regimes for judicial review of agency legal interpretations. Despite these developments, little scholarly attention has been paid to how and why states have developed administrative law’s deference doctrines, how the …

Allies, Partners, Or Puppets?: American And Chilean Armies, 1961–69, Hugo Harvey-Valdés

The US Army War College Quarterly: Parameters

This article examines the multifaceted exchanges between the American and Chilean armies from 1961 to 1969, asserting that they were strictly professional, devoid of political indoctrination, and aligned with both nations’ foreign policy interests. Utilizing declassified diplomatic and military documents, this research diverges from prior works by integrating an in-depth understanding of military codes and culture with global, regional, and national contexts. It challenges the politicized narratives of the Cold War in Latin America, especially in Chile. This research offers insights into the actual impacts of international military policies on future military exchange programs.

Handwritten. The landlord withdrew the case after the tenant's motion to dismiss highlighted procedural defects under the Good Cause Eviction Law (GCE). The original 90-day termination notice failed to address nonpayment, and the amended petition lacked proper form notice. This outcome demonstrates the early enforcement of GCE protections, reinforcing tenant defenses against eviction for insufficiently substantiated claims.

All Decisions

In this holdover proceeding, the landlord moved to vacate an ERAP stay and obtain a default judgment. The tenant cross-moved to vacate a prior stipulation of settlement and dismiss the case. The court granted the tenant's cross-motion, finding that the landlord failed to provide the tenant with a required notice under the Violence Against Women Act (VAWA). This failure to provide the statutorily mandated notice constituted a fundamental defect in the proceeding, leading the court to vacate the stipulation and dismiss the case.

Genetic studies have identified numerous regions associated with plasma fibrinogen levels in Europeans, yet missing heritability and limited inclusion of non-Europeans necessitates further studies with improved power and sensitivity. Compared with array-based genotyping, whole-genome sequencing (WGS) data provide better coverage of the genome and better representation of non-European variants. To better understand the genetic landscape regulating plasma fibrinogen levels, we meta-analyzed WGS data from the National Heart, Lung, and Blood Institute's Trans-Omics for Precision Medicine (TOPMed) program (n = 32 572), with array-based genotype data from the Cohorts for Heart and Aging Research in Genomic Epidemiology Consortium (n = 131 …
